RESOLUTION AUTHORIZING ADDITIONAL PAYMENT TO
BURDEN AQUATICS FOR FEES RELATED TO PROVISION OF
HERBICIDE TREATMENT FOR LAKE SUNNYSIDE AQUATIC
VEGETATION MANAGEMENT PROGRAM

WHEREAS, by Resolution No.: 83,2022, the Queensbury Town Board authorized
engagement of Burden Aquatics for an Aquatic Vegetation Management Program for Lake Sunnyside
in 2022 providing for herbicide treatment for control of Eurasian water milfoil within portions of Lake
Sunnyside up to a total cost of $27,150 in accordance with Burden Aquatics' February 7t", 2022
proposal, and
WHEREAS, the Lake Sunnyside Aquatic Plant Growth Control District Advisory Committee
(Committee) requested that Burden incur additional costs outside the scope of Burden's February 7th,
2022 proposal including the New York State permit fee of $100 and additional fees totaling $800
related to downloading GPS way points and creating a PDF file map, for a total additional cost of
$900, and
WHEREAS, the Town Board wishes to authorize these additional costs and payment due to
Burden,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes additional payment in the
amount of$900 to Burden Aquatics relating to the Aquatic Vegetation Management Program for Lake
Sunnyside in 2022 for the additional fees/costs incurred by Burden as delineated in the preambles of
this Resolution to be paid from Lake Sunnyside Misc. Contractual Account No.: 052-8790-4400, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to
take all actions to amend the Town Budget and transfer $900 from the Lake Sunnyside Undesignated,
Unassigned Fund Balance 052-0000-0909 to the Lake Sunnyside Misc. Contractual Account No.:
052-8790-4400 and increase the budget by such amount, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town
Budget Officer and/or Town Accountant to take any and all actions necessary to effectuate the terms
of this Resolution.

WHEREAS, by Resolution No.: 273, 2012, the Queensbury Town Board adopted its Final
Order authorizing, approving and establishing the Lake Sunnyside Aquatic Plant Growth Control
District,and
WHEREAS, by Resolution No.: 310, 2021, the Town Board adopted the Lake Sunnyside
Aquatic Plant Growth Control District Benefit Tax Roll for 2022, and
WHEREAS, by Resolution No.: 35, 2022, the Town Board appointed (5) persons who are
property owners within the District and/or Protective Association of Lake Sunnyside (PALS)
members, to the Lake Sunnyside Aquatic Plant Growth Control District Advisory Committee
(Committee), and
WHEREAS, the Town Purchasing Agent requested and received proposals for professional
services for an Aquatic Vegetation Management Program and herbicide treatment of Lake
Sunnyside, and
WHEREAS, the Purchasing Agent and the Committee reviewed the two (2) received
proposals and have recommended that the Town Board authorize engagement of Burden Aquatics
for the Aquatic Vegetation Management Program for an amount of $27,150, such Program to
provide for herbicide treatment for control of Eurasian water milfbil within portions of Lake

Sunnyside, and
WHEREAS, a copy of Burden Aquatics' February 7`h, 2022 proposal is presented at this
meeting,
NOW, THEREFORE,BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes engagement of Burden
Aquatics for an Aquatic Vegetation Management Program for Lake Sunnyside in 2022, such
Program to provide for herbicide treatment for control of Eurasian water milfoil within portions of
Lake Sunnyside, in accordance with Burden Aquatics' February 71h, 2022 proposal presented at this
meeting,up to a total cost of$27,150, which includes Burden Aquatics' administration of the liquid
formulation ProcellaCOR EC aquatic herbicide, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to pay
expenses incurred from appropriations in the Lake Sunnyside Misc. Contractual Account No.:
052-8790-4400 not to exceed $27,150 and/or take any actions necessary to provide for such
payment,and
BE IT FURTHER,
RESOLVED, that the Town Board fizrther authorizes and directs the Town Budget Officer
to take all actions to amend the Town Budget and transfer $15,500 from the Lake Sunnyside
Undesignated, Unassigned Fund Balance to the Lake Sunnyside Misc. Contractual Account No.:
052-8790-4400 and increase the budget by such amount, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs `the Town Supervisor to
sign the Proposal and any other needed documentation and the Town Supervisor, Town Budget
Officer and/or Town Purchasing Agent to take any and all actions necessary to effectuate the terms
of this Resolution.
