Brown 27 Antigua Road Lake George, NY 12845 Re: Building Permit 2000-528 Proposed Addition / Wastewater Disposal System Dear Mr. Brown: I have reviewed the information you filed with the above referenced building permit application and offer the following information. The April 26, 2000 letter from James E. Hutchins, P.E., addressing the disposition of the wastewater system at the Antigua Resort, is not specific enough in describing the existing system and its conformance with Chapter 136 of the current Town of Queensbury Code to satisfy our requirements. Should you wish to proceed with your proposed addition, you must first provide information stating that the wastewater disposal system servicing the building conforms to Chapter 136 (i.e_, meets area requirements, design flows, separation distances, etc.) of the current Town of Queensbury Code. If this is not possible, an upgrade of the system will be necessary. Additionally, the 4%TR.-1A zone, §179-16 does not allow commercial uses by right. The Antigua on Plum Point is categorized as a pre-existing non-conforming use and is allowed to be maintained, in reasonable repair, as such. § 179-79, D_ cites that " any non-conforming use may be increased only by variance granted by the Zoning Board of Appeals." Additionally, I have examined information from the Town of Queensbury files which you supplied. On April 18, I visited the site. Based on my records review and site visit, I offer the following : 1. I personally logged soil strata on the site for design of the motel system in 1975. 2. I conducted a percolation test for the 1975 design. 3 . While I did not design the household system in question, I examined document copies from the Town of Queensbury. It is apparent the design for the household system was reviewed for conformance with Town standards and that the system was inspected by the Town upon completion of construction. 4. My site observations on April 18, 2000 indicate that the location depicted on the drawing which you supplied appears realistic, no evidence of failure was noted. The indicated location provides adequate (100+ feet) separation from the water supply and Lake George. 5, No increase in flow generated is anticipated as a result of the proposed kitchen addition . Based on my site visit and the information referenced, it appears the household system did meet Town of Queensbury requirements at the time of installation. i would further conclude that the existing system is presently functioning and with proper maintenance, may very well function properly for a number of years.
