1. PURPOSE
1.1 To comply with OSHA regulations concerning the handling of
hazardous materials in the workplace.
1.2 To provide employees with hazard information involving chemicals
in the workplace.
1.3 To establish guidelines for training and informing employees of
hazard information.
1.4 To promote safety within the Company.
2. APPLIES TO
2.1 All store and/or station personnel, Area Supervisors, Retail
• Marketers, District and Regional Managers.
3. DEFINITIONS
3.1 Material Safety Data Sheets (MSDS): A sheet providing specific
information about a chemical and its common name; a chemical and
the common name of all hazardous ingredients in the substance;
the physical and chemical characteristics of the substance; the
substance's physical and health hazards; the manner of contact
with the substance that could cause health risks (skin contact,
inhalation, absorption); permissible exposure levels; whether
the chemical is considered a carcinogen; precautions for safe use
and handling; protective equipment and other information ensuring
safe industrial use of the chemical; emergency and first aid
measures; the name and address of the chemical manufacturer or
supplier who prepared the MSDS; and the date the MSDS was prepared.
3.2 Occupational Safety and Health Administration (OSHA): The
federal agency which issued and monitors the Hazard Communica-
tion Standard.
3.3 Hazard Communication Standard (HCS): The government directive
requiring companies to provide employees with hazard information
for chemicals being used in the workplace.
4. POLICY
. 4.1 All store and/or station managers must maintain the information
supplied along with any future correspondence supplied by the
corporate office.
4.2 All employees must be trained upon hire in the proper handling
of any chemicals at the location and the procedure for handling
accidents or spills involving hazardous materials.
4.2.1 Training of new employees is the manager's
responsibility and must take place before the new
employee assumes responsibility for his/her duties.
4.2.2 Training of new managers will occur in the Training
Store and/or Station and be reinforced at the Company
Training Center.
4.3 All employees must know the location of this information for their
store and/or station and know whom to call in the event of a
question or emergency.
4.4 Any changes, additions or revisions to this information will be
issued to each store and/or station by the corporate office.
5. PROCEDURE
• 5.1 Any vendor or manufacturer who supplies product to Cumberland
Farms or Gulf shall be required to supply MSDS for that product.
5.1.1 For products produced and/or distributed by Cumberland
Farms or Gulf, an updated listing shall be issued to
each store and/or station.
5.2 Cumberland Farms or Gulf defines "hazardous chemicals" as does
OSHA in the HCS. A "hazardous chemical" is any chemical which
creates a physical hazard or a health hazard.
5.3 A list of hazardous chemicals and mixtures known by Cumberland
Farms or Gulf to be present in the workplace will be sent to all
stores and/or stations. The list will be updated as hazardous
chemicals are removed from or introduced into the store and/or
station.
5.4 All MSDS covering hazardous chemicals or mixtures known by
Cumberland Farms or Gulf will be kept in the corporate office.
MSDS's will be supplied upon request to any employee.
5.5 All containers of hazardous chemicals must have labels affixed
to them identifying the chemical and appropriate warnings.
Labels should not be removed or defaced nor should employees
transfer hazardous chemicals from a labeled container to an
. unlabeled container. Employees should not use chemicals that
are found in unlabeled containers.
• ' 5.6 Training for all new employees will occur before the new employee
assumes responsibility for the position. Verification that the
training has taken place will be indicated in the New Hire Hand -
Book.
5.6.1 The training will cover the following areas:
- The location'of the written hazard communication plan.
- The location of hazardous materials.
- Provisions of the Hazard Communication Standard.
- Detection of the presence or release of hazardous
substances.
- The location of information obtained through monitoring
or surveys on airborne toxic materials exposure or other
similar information on hazardous substances.
- Protecting one's self with appropriate apparel and by
way of safe work practices.
- The physical and health hazards of the chemicals in the
work area.
- Performing non -routine tasks involving hazardous chemi-
cals (such as cleaning up spills or unlabeled pipes) in
a safe manner.
- The company's warning label and MSDS system.
5.7 Questions or inquiries regarding chemicals in the store and/or
station should be directed to the Risk Management Department at
the corporate office.

stores and/or stations and must be maintained in a binder avail-
able to all employees.

CUMBERLAND FARMS/GULF HAZARD COMMUNICATION PLAN
• Everyone uses chemicals of one kind or another at work and at home. Some of
those chemicals can cause physical or health hazards if used improperly or
carelessly. Some chemical hazards are well known. For example, most people
realize that acid burns and that gasoline is explosive. However, many chemi-
cal hazards are not common knowledge.
While the risk of exposure to hazardous chemicals pervades our society, perhaps
the greatest risk is in the workplace. The Federal Government has issued the
Hazard Communication Standard (HCS), 29, C.F.R. Sec. 1910.1200, in order to re-
duce the risk of hazardous chemical exposure in the workplace. The HCS re-
quires chemical manufacturers, importers and distributors to evaluate the dangers
of their products and pass along information about the hazardous chemicals to
other employers and employees who may come in contact with the hazardous chemi-
cals.
Consistent with the HCS, Cumberland Farms/Gulf (Company) has adopted this
Hazardous Communication Plan (Plan) as part of its continuing effort to pro-
vide its employees with safe working conditions. The purpose of the Plan is
to inform employees of chemicals known by the Company to be in their workplaces
that may create a hazard if improperly or carelessly used, and to explain
safety procedures the Company has adopted to protect employees against the
health and physical risks posed by these chemicals.
All questions or inquiries regarding the Plan or chemicals in the store and/or
. station should be directed to the Store Manager or Area Supervisor who in turn
will contact the Risk Management Department at corporate headquarters.
The Company defines "hazardous chemicals" as does the Occupational Safety and
Health Administration (OSHA) in the HCS. A "Hazardous chemical" is any chemical
which creates a physical hazard or a health hazard. A chemical is a health
hazard if there is statistically significant evidence, based on at least one
valid scientific study, that acute or chronic health effects may occur in ex-
posed employees. A chemical is a physical hazard if there is scientifically
valid evidence that it is a compustible liquid, compressed gas, explosive,
flammable (reactive) or water reactive.
A mixture of chemical products, in some cases, may be tested as a whole to
determine whether it is a health hazard or a physical hazard. The result of
this testing will determine whether the mixture will be considered a hazardous
chemical. If the mixture is not tested as a whole, it will be assumed to be
a health hazard if any of the component chemicals comprising at least one per-
cent of the mixture is itself a health hazard. If any ingredient accounting
for at least 0.1 percent of the mixture is a carcinogen, then the mixture will
be deemed to present a carcinogenic hazard. Any mixture presenting a physical
or health hazard will be labeled to or by the Company as a hazardous chemical
and an appropriate Material Safety Data Sheet (MSDS) will be maintained with
the relevant information.
The Company will maintain a list of all the chemical products used in the
• stores and/or stations and will evaluate, to the best of its ability, the
potential health exposure of a particular chemical product before deciding
to use it.
• The Company has adopted a system under which a member of the Risk Management
Department will maintain MSDS's supplied by suppliers of chemical products.
A. Maintaining MSDS files that would be available to employees and
to local jurisdictional authorities and health or medical officers
as required by the regulations.
B. Representatives in Cumberland Farms or Gulf are required to advise
the Risk Management Department of any new products covered under
the Hazard Communication Act.
A list of hazardous chemicals and mixtures known to the Company to be present
in the stores and/or stations is included in this Plan. The list identifies
the chemical and mixture and the work areas in which the chemical or mixture
is used or stored. This list will be updated as hazardous chemicals or mix-
tures are removed from or introduced into the workplace.
For each chemical that is hazardous, the Company will keep a MSDS on file.
This sheet will provide specific information about the chemical, including:
1. The chemical and common name of the chemical substance.
2. The chemical and common name of all hazardous ingredients in
the substance.
3. The physical and chemical characteristics of the substance.
4. The substance's physical and health hazards.
5. The manner of contact with the substance that could cause health
risks (Skin contact, inhalation, absorption).
6. Permissible exposure levels.
7. Whether the chemical is considered to be a carcinogen.
8. Precautions for safe use and handling.
9. Protective equipment and other information ensuring safe indus-
trial use of the chemical.
10. Emergency and first aid measures.
11. The name and address of the chemical manufacturer or supplier who
prepared the MSDS.
12. The date the MSDS was prepared.
The Risk Management Department is responsible for maintaining the necessary
MSDS supplied by the appropriate chemical manufacturers, suppliers or dis-
tributors and for reviewing them to make certain they are complete. The Risk
Management Department is also responsible for updating the MSDS when new
and significant health information is provided by the supplier. Copies of
all written requests will be kept on file by the Risk Management Department.
The chemical listing covering hazardous chemicals or mixtures known by the
Company is to be in the stores and/or stations in the General Operations
Manual. This information will be accessible during each work shift. Upon
written request, the Risk Management Department or other designated person
will permit employees to review MSDS.
In storage

in lieu of individual container labels.
If any materials are to be transferred from a storage tank or container through
pipes, labels with the required information will be affixed to the line at the
discharge point (e.g. dispenser).
The Area Supervisor is responsible for ensuring that labels are prominently dis-
played on all containers of hazardous chemicals. In order to maximize employee
safety, the employees must assist the Area Supervisor in this task. Employees
should take care not to deface or remove warning labels from containers of
hazardous chemicals. The labels must remain on the containers and remain legible
at all times. Employees should promptly notify the Area Supervisor of missing
or defaced labels.
In addition, an employee should not transfer a hazardous chemical from a
labeled container to an unlabeled container (pail, bottle, can or the like)
unless the unlabeled container will be under the employee's exclusive control
during the employee's work shift. The chemical should not be left in the un-
labeled container after the employee leaves work. Employees should not use
chemicals they find in unlabeled containers.
Independent contractors who are retained by the Company to work in a store
and/or station will supply the Company with MSDS for any and all hazardous
chemicals the independent contractor will bring into the workplace to perform
his or her tasks. If the independent contractor introduces a new chemical
into the workplace, employees in the work areas where the new hazardous chemi-
cal is used or stored will receive the required training and information set
forth below.
EMPLOYEE TRAINING
All employees who may be exposed to hazardous chemicals under normal operating
conditions, or while performing non -routine tasks, or under foreseeable emer-
gencies, will receive training on how to use or handle safely all hazardous
chemicals present in their work areas.
For your store and/or station, the Manager (or Supervisor in the Manager's
absence) will be responsible for conducting training sessions.
Employee training sessions will include specific instruction on:
1. The location of the written Hazard Communication Plan.
2. The location of hazardous materials.
3. The location of MSDS.
4. Provisions of the Hazard Communication Standard.
5. Detection of the presence or release of hazardous substances -
for example, how to use mechanical detection devices, what to
look for or smell, or what to do if an alarm rings.
6. The location of information obtained through monitoring or sur-
veys on airborne toxic materials exposure or other similar infor-
mation on hazardous substances.
7. The physical and health hazards of the chemicals in their work area.
8. Performing non -routine tasks involving hazardous chemicals (such
as cleaning up spills or unlabeled pipes) in a safe manner.
9. The Company's warning label and MSDS system.
All new and transferred employees will receive training prior to their per-
forming assigned duties in work areas where hazardous chemicals are used or
present. All employees will receive appropriate training whenever a new chemi-
cal hazard is introduced into their work area. Training may be lecture, question
and answer, or other appropriate delivery methods.
The Company will have new employees sign the appropriate page of the New Employee
Handbook indicating that they have received training as outlined above. This
signed page will be maintained in the employees' personnel file at corporate
headquarters.
