Dear Supervisor Strough and Town Board Members:
This office represents the Tarrant family with respect to their tear-down and new home
construction project and a new enhanced treatment on-site wastewater treatment system at their
308 Cleverdale Road property, which has 61-ft of lake frontage upon Sandy Bay, Lake George.
The property has a camp with 4-bedrooms, which was built in the late 1800s and has been owned
by the applicants and previous family generations for many years.
The camp is in a condition such that it is not financially feasible to perform the extensive repairs
needed, such as the pier foundation, thus the applicants desire to tear-down the camp and build
a new, smaller 3-bedroom home. The new building will be situated slightly further away from the
shoreline and will be zoning compliant aside from the 50-ft shoreline setback.
Presently, the camp has an old wastewater system, which we suspect is a cesspool, situated at
the northeast corner of the camp, approximately 40-50 feet from the shoreline. It is proposed to
remove the cesspool as part of the project and to install a new Puraflo® Peat Biofilter on-site
wastewater treatment system on the roadside of the parcel.
Given,the site and neighborhood constraints, it is not possible to install a compliant absorption
field upon the parcel, therefore several variance requests to the Local Board of Health are
requested for the project. These requests are itemized on Sheet S3 of the project plans and
consist of: setback relief for the Septic Tank, Pump Station and forcemain (shoreline, property
line and house) and setback relief for the fill associated with the new absorption field (shoreline,
house, northerly property line and westerly neighboring well): Please note that the location of the
stone absorption bed is compliant the required setbacks; it is the locations of the fill and walls for
the absorption field to which the setback relief is requested.
We respectfully request that this application be placed upon the Town Board's meeting agendas
for the March meetings. It is our clients' goals to pursue the necessary Planning and Zoning
Board approvals this spring and to begin construction after Labor Day of this year. Please contact

This office represents the Tarrant family with' respect to their tear-down and new home

In accordance with our.discussions at the April 4th Board of Health Meeting, revisions have been
made to the plans, specifically the previously proposed Puraflo® Peat Biofilter system has been
revised to a Fujiclean Enhanced Treatment Unit with a shallow pipe-in-stone absorption bed.
The absorption bed has been shifted further away from the shoreline, so that it's toe of fill is now
compliant with the 100=ft shoreline setback. Subsequently, an increase in setback relief to
westerly neighboring well is requested. The updated variance requests are itemized on Sheet S3
of the project plans. In addition, the proposed house has been shifted-further away from the
shoreline than as previously proposed.
Enclosed please find 9 sets of updated plans and applications. We respectfully request that this
application be placed upon the agenda of the Board's May 2, 2022 meeting. It is our clients'goals
to pursue the necessary Planning and Zoning Board approvals this spring and to begin
construction after Labor Day of this year. Please contact me with any questions that you may

WHEREAS, Robert and Jean Tarrant (Applicant) filed an application for variances from
provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to install
a new enhanced treatment on-site wastewater treatment system with its components proposed to be
located as follows:
1. Absorption field toe of fill to be 81' from the westerly well in lieu of the required
100' setback;
2. Absorption field toe of fill to be 2' from the northerly property line in lieu of the
required 10' setback;
3. Fuji Clean Enhanced Treatment Unit (ETU) to be 5' from the house in lieu of the
required 10' setback;
4. Fuji Clean ETU to be 7' from the northerly property line in lieu of the required 10'
setback;
5. Pump station to be 40' from the Lake George shoreline in lieu of the required 50'
setback;
6. Pump station to be 7' from the property line in lieu of the required 10' setback;
7. Pump station to,be 4.5' from the house in lieu of the required 10' setback;
8. Force main to be 3' from the house in lieu of the required 10' setback; and

within 500 feet of the subject property,
NOW,THEREFORE,BE IT
RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the
variances would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicants;.and
BE IT FURTHER,
RESOLVED,that the Local Board of Health hereby approves the application of Robert and
Jean Tarrant for variances from the Town of Queensbury On-Site Sewage Disposal Ordinance.to
install a new enhanced treatment system with its components to be located as follows:
