As I understand your project, you have constmeted an approximately 3,000 sf freestanding garage
on your property. As our records snow that you alread have 3 existing garages on the pruperty
and this recently constructed garage constitutes a 4 garage, an Area Variance is needed.
Specifically, Area Variance relief is needed for the 4h garage where only one is allowed and, as
this garage exceeds the maximum allowable square footage for a garage, garage size relief is
needed as well. please note our established submittal deadlines and our pre-submission meeting

Please be advised that I have been retained by Iris D. Roglieri relative to the area variances
he is seeking for his property at 40 North load. Specifically,he is requesting relie f for an accessory
stricture that he had constructed for the purpose of storing his automobile collection. Unfortunately,
Mr. Roglieri hived a contractor who developed the plans and constructed the accessory structure
without obtaining the necessary permits from the Town of Queensbury. When a second contractor
was hired to complete the pool, the Town was contacted to complete a site visit due to a question
the contractor had regarding the fence. During this visit, MJ•. Roglieri was advised that no permits
were obtained for the accessory structure,and that relief was needed for the structure to remain. No
enforcement action has been commenced and Mr. Roglieri moved forward with the area variance
application as soon as he learned an issue existed.
This property is 14.11 acres in size and is a secluded parcel with a long private driveway.
The property has a number of existing mature trees which creates a very private setting. The
property is improved with a single family residence which is approximately 10, 000 square feet in
size and was constructed in 1964. The residence does have a 3 stall attached garage,which is used
by the Applicant to store the family's vehicles as well as his children's out door toys. The property
also maintains a one stall garage,closest to the residence, which is primarily utilized for the storage
of the property's necessary lawn equipment. Along the western property line there is a wood shed
that is not enclosed and holds firewood for the numerous fireplaces which are located in the
residence. Further north along the western property line is a second shed which is used exclusively
to store the fountain which is located in the driveway during the winter months. During the non-
winter months.the fountain is located in a landscaped arca of the driveway which is located closest
to the residence.

Although the property may maintain a nuinber of accessory structures, all of which are said
to have been constructed in th 1960s, nose of these structures could have served the purpose for
which this new accessory structure was constructed. The accessory structure that is the subject of
this application is approximable 50 feet by 60 feet in size. It serves as storage facility for the
Applicant's car collection. These oars, which he had in the past stored off site, were than difficult
to access and hard to use. He constructed this accessory structure to be used as a show room and or
as storage for his collection. No automobile repairs are done in this structure. The interior of the
structure is decorated, heated and clean. It is connected to the electricity and water on site. It also
contains a bathroom and maintains its own septic tank.
The two variances needed for this request are due to them being more than three accessory
structures on site,and because the structure is larger than 2,200 square feet in size. In reviewing the
criteria for these variance,the benefit to the Applicant absolutely outweighs zny detriment that can
be considered in granting this relief. The Applicant has unfortunately already constructed the
structure without knowledge that the builder did not obtain the neces&uy permits from the Town of
Queensbury. As a result, removing the building would be a very large financial undertaking. Iii
addition,the property at issue, although in a densely populated area,is very large at 14 acres in size.
Moreover, the property is protected by many mature trees on site and on the adjacent iands. The
vegetation together with the setback of'the existing structure makes the improvement hard to see
from adjacent properties;. It is also important to note, that in addition to the large parcel being in a
secluded setting, the adjacent uses include KeyBank, Hannaford Supermarket, a "forever wild"
forest,a bike path,C R Bard and Aldis. As a result,this accessory structure will not have an adverse
impact on these adjacent uses and or their values. As a result of these reasons, the granting of this
relief cannot be deemed to create a undesirable chane or an adverse impact. Although it may be
considered substantial, this should not be the case when considering the amount of land that is
owned by the Applicant and that the structure does not exceed the size of the residence. Overall, it
would be reasonable and equitable for the Zoning Board to granted the variances requested.

subject Accessory Structure as well as the other accessory structures on the site,the Application fee,
the survey and the Shoil Form EAF. I did not have an elevation drawing to provide for the height,
however I will have one for the meeting if not before. Please advise if this is anything further that

1. Whether an undesirable change will be produced in the character of the neighborhood or a
detriment to nearby property will be created by the granting of this area variance?

his car collection. The new building requires relief because it creates mare than the allowable
number of accessary structures on the site and duet he gaLae� being larger.than 2, 200 square
feet. Ho wp,-ver, h d iti on of this new buildin does not create an undesirable e for a
number of reasons. The building has a siding which is an earth tone and blends with the
surrounding mature vegetated state of the r ert . It is not visible and or barely visible to the
ad` cent lands. The buildin&was needed and constructed for the storage of the A licant's
possessions. The other buildings on site allow for I gm eguipment and lawn decorations to bv-
stored and protected from the outdoor conditions. As a result, the existing t etures were not
meeting the storage needs of the Applicant. In addition, it was not feasible for the automobile
collection to be stored in qLig 0 f the exi ti n&accesso structures. Moreover, it sh 1d be noted
that the new buildine does not exceed the size of the Dame. As a result, no undesirable changes
will be produced with the gmting of this variances to the character of the ngighborhood or to
nearby properties.
2. Whether the benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than ars area variance?

property is, the size of the residence and the use of the ogler accessory structures. The variances

Commencing at a point which is the northeast corner of lands
conveyed to Samuel P. Hoopes by Fred J. Hovey and Cornelia
Hovey, his wife, by daed dated August 5th, 1932, recorded in
the warren Coxxnty Clerk's office on September 5th, 1932 in
