Description It is our understanding that the proposed project consists of the following: 1 . The property is a vacant 1 . 86±-acre nonshoreline parcel located in the Town of Queensbury, Warren County on the West Mountain Road, tax map designation 123-1-25 .351 . Clendon Brook which crosses the property is not navigable; there- fore, for purposes of applying building setback, vegetative cutting and lot width restrictions, the property is considered to be a nonshoreline parcel . 2 . The property is owned by you and Tammy C. Silvernell as described in a deed recorded on April 21, 1997 in Liber 1018 of Deeds, page 160 in the Warren County Clerk' s Office. 3 . The subject property is lawfully existing in that it was created pursuant to Adirondack Park Agency Project and Permit Number 87-189, which authorized the subdivision which resulted in the creation and conveyance of the subject lot and also the construction of one single family dwelling on each of the four lots in the subdivision which were proposed to be conveyed. FOR YOUR INFORMATION This determination is based upon the existing laws, regulations and Park Plan Map administered by the Agency. If they change before substantial commencement of the proposed project, this determination may also change . The portion of the property within the Adirondack Park is located in a Hamlet land use area on the Adirondack Park Land Use and Development Plan Map. Agency staff has determined during a site visit conducted during the review of Project 87-189 that there are wetlands subject to Agency jurisdiction on the property. The permit describes the location of the wetlands as being 400± feet from West Mountain Road. The property is not otherwise located in a statutory "critical environmental area. " The property is not located in a designated river area pursuant to the New York State Wild, Scenic and Recreational Rivers System Act . The Town of Queensbury administers an Agency-approved local land use program, which means that the Town has authority over Class B regional projects and nonregional projects and also administers shoreline restrictions . The local development administrator or zoning officer should be contacted in order to determine project requirements and the procedures and standards to be followed for such projects . The Adirondack Park Agency retains its authority over Class A regional projects, wetlands projects and rivers projects, and incorporates local regulations and consults with the local planning board in its review of these projects . Restrictions Although the proposed project described above does not require a new or amended Agency permit, the following restrictions are imposed by law. Please note that the conditions contained in Douglas M. Silvernell February 17, 1999 Page 3 Agency Permit number 87-189 remain in effect and must be met. In the case of conflict, the more restrictive condition applies . Please also note that the Town of Queensbury may have stricter land use restrictions and standards than those administered by the Agency set forth below. Please check directly with the Town, as the stricter provisions would apply. 1 . Projects must be undertaken in accord with Agency regula- tions implementing the State Freshwater Wetlands Act . Enclosed is a flyer describing some of the activities which require a wetlands permit. 2 . The local land use regulations administered by the Town limit the use of the property and specify lot size and dimensions, setbacks for structures, building height and septic system requirements .
