Dear Bill:
I am in receipt of your letter dated December 29th, 2000. I apologize for not getting back to
you sooner;however, I was in Code School during the first week of January.
Items A and B of your letter have been resolved with Jeff Schwartz and so these items are no
longer at issue.
Item C of the New York State Uniform Code §1004.2(e)(3) requires that any building
containing a fire alarm system must have all ventilation systems tied into the fire alarm system so that
upon activation of the fire alarm system, the ventilation system will shut down. This does not refer to
public assembly nor the use of the building. It strictly states that any building containing a fire alarm
system with a ventilation system will have the interface between the ventilation and fire alarm systems.
I hope this clarifies that issue.
The Fire Marshal and I agree that Item D is acceptable. We will need to inspect to make sure
that this work was done according to your statement.
Item E requires canopies over all secondary exits with the exception of a main exit. I have
been in contact with Jeff Schwartz who tells me that he,is ordering the other canopies on the front of
the building and they should be installed shortly:
Item F of the NYS Uniform Code §771.4(d)requires that all accessory group C-1 occupancies
(office) 1,000' or greater, in a moderate hazard occupancy .(C4.2) be separated from the main
occupancy by a fire separation of not less than one hour. The one hour separation is deemed to be
acceptable when it terminates at the exterior walls as well as the roof. As we have stated before in
conversations with Jeff Schwartz, we will accept a one-hour rated ceiling on the second story if and
when he alters the second story space to become an office and that the exterior wall termination points
will be taken care of when he builds his addition to the building. It is understood that he will have the
general contractor take off the skin of the building and extend the interior fire separation to the exterior
sheeting and then replace the sheeting on the building. As the walls sit right now there is a common
space between the exterior sheeting and the end of the fire separation which does not complete the fire
separation between the office space and the main warehouse.

Septic Design Products) regarding six (6) items remaining "open" under the Temporary CO you issued

In the interest of obtaining a final Certificate of Occupancy for the warehouse constructed in
1999/2000 on Carey Road,I will address these six items here:
a. Site Work
1. Final survey has been completed by Wayne Raymond
2. Handicapped bath signage has been installed&approved by Queensbury Codes
3. Striping of parking lot will be done in Spring 2001--6 employees—no public„no

4. Codes "check off' list notes Site Plan Variance Required. *I have no records
indicating a variance required. Please send me written notice documenting the
specific violation requiring the variance---I will try to address it right away.
5. "As Built"septic documentation has been delivered to your office.
b. Fire Alarm System
This may be done by now. If not, it will be done&certified to your satisfaction as soon
as practicable.
c. Furnace Shutdown
Section 1004.2.e.2 specifically relates to recirculated air for areas of public assembly,
more than one fire area, or more than one story. The Morris Products building does
vt,, NOT fall into any of these 3 categories. Section 1004.2.e.3 requires automatic
I shutdown of a ventilating system installed in a building containing a fire alarm system if
the fire protection equipment is activated. Although the office furnace system is not in
� ti
public assembly space nor is it strictly a "ventilating system", it will be tied into the
building fire alarm equipment to shutdown both the furnace and its fan system if the
alarm is activated. This will protect the furnace if its fan system is shut down and, at the
same time, satisfy concerns by you and Chris Jones.
d. Ventilation Fans
This building has two (2) ventilation fans, either one of which is capable of exhausting
all air required for normal and/or emergency ventilation. One of these ventilation fans is
wired to the fire alarm system so that it will start automatically if the fire alarm system
is activated. The second ventilation fan is wired to a manual start switch so that fire
department personnel can start or stop it for emergency ventilation. Signage will be
displayed near this manual switch for observation and use by emergency personnel.
e. Canopy
ii A canopy has been installed over the secondary exit at the rear of the main warehouse
43„d Irea. The owner, Jeff Schwartz is now considering the installation of similar canopies
,; ver the exteriors of the main entrance and other exits from the building.
f. Tenant Partitions
Please note that this building is of Type 2b construction with an occupancy
classification of C4.2 (as determined by David Hatin). It is not a place of public
assembly, it has no retail operations, there are only six occupants (total), and there is
only ONE occupancy in the entire single-story fire area. The "office" area is accessory
to the warehouse and includes a file room, toilet rooms, utility rooms and a conference
room---it does not include a"stockroom". The New York State Uniform Fire Protection
and Building Code, Section 771.1.d & e states that in a Type 1 & 2 building, tenant
4 CO space may be non-fire-rated. This Morris Products building has only ONE tenant, with
"office" space as an accessory to the warehouse classification. This section will also
fi apply to any future use of the present vacant space over the"office"area. On December
Biel : 7 20, 2000, I contacted Mr. Charles Rush of the "codes interpretation" office in the State
cI,Lvl Education Department in Albany. Mr. Rush advised me to obtain written notification
from you as to the exact code section the Morris Products building is in violation of.
Although the "office" area is enclosed with non-combustible materials as an added
protection for the 3 or 4 office personnel, I do not believe this accessory space requires
any fire barrier of any kind---certainly no extension of vertical walls through the
building insulation to the metal walls& roof! Please let me know, in writing, the code
section of the violation so that I can resolve this problem to the satisfaction of Morris
Products and the applicable building codes.
I trust that the above-listed item-answers of mine are satisfactory and self-explanatory. Jeff
Schwartz and I wish to comply with all reasonable and applicable concerns of yours and
receive a final Certificate of Occupancy as soon as practicable. We are planning an addition
to the building in the Spring of this year and do not want any unresolved concerns for the
present&the new building to be hanging over our heads!

Dear Jeff:
The following items remain open under the Temporary CO that was issued for June 23,2000,and
will expire on September 23,2000.
Listed are the following items which you need to complete.
1. All site work needs to be completed in compliance with your site plan approval,which would
include landscaping,striping of the parking lot,installation of handicap signage,and any other
• items that were required by your site plan approval.
2. The fire alarm system must be operational and inspected and certified by the alarm company.
3. The fan shutdown for the furnace must be tied into the fire alarm system, so that upon

Following my last fire inspection, Peter Brown asked me to clarify several points related to
the fire alarm system, with the State of New York.
Attached, please see my letter to Mr. Steve Rocklin, from the State of New York, and his
responses.
Your fire alarm, HVAC, and Emergency Ventilation System, may or may not need to be
modified,based on this information. If you have any questions, please feel free to call me at

Dear Steve,
Would you please clarify the following points, as they relate to the requirements
the l,Tniforus Code, Section 1004.2?The occupancy in question is a 10,000 uaaree of
foot C4, with no windows.
1. The office space, which contains several rooms, is heated with a "conventionar
hot air heating system, If the building is equipped with a fire alarm system, .
the furnace have to be tied into a shut down cellenoid to automatically shut down
the furnace upon activation of the.ire alarm, as required by 1004.2 (e) (3)?
'\,_ 2. Because the building has no windows, the Town of Queensbury,required an
emergency ventilation system be installed. The builder installed an electric fan
en one side of the building and a power louver on the other. Does section
1004.2 (±) require that the emergency ventilation system be tied directly into the
fire alarm system in order to start ventilating the building automatically? ,f j
3. Does Section 1004.2 (f)intend for the emergency ventilation system to •
operate, automatically, prior to the arrival of the fire department? . ...._...
4. The builder has also installed a second fan and a second power louver, which is
intended to operate via a manual switch. If this switch is located near an exit
and is appropriately Iabeled, would it comply with the provisions of

Dear David Hatin,
This letter is in reference to the new warehouse constructed on Carey Road,
Queensbury for Morris Products, which you inspected on Thursday June 22, 2,000.
I have inspected the building structural steel on several occasions during its
errection. The errection of all structural steel for this building, and the steel, itself,
are in conformance with the building plans,
As you pointed out to me that morning, and the building owner now understands , if
the area above the present office area is used for office space in the future, this
2nd story area must be provided with a one-hour fire-rated ceiling.
Please let me know if any additional information or changes are required of me
with respect to this new warehouse.
