Specifically, the relief granted with Area Variance No. 5-1998 was based on the information supplied with the application which depicted an elevated deck at the second floor level. information submitted with bath the variance application and building permit application planned for the elevated deck to be closest to the lake. Neither application depicters a lower level porch and steps. A November 22, 1999 field inspection revealed a lower level deck and steps to be constructers within 39 feet of the shoreline. This additional construction, closer to the shoreline than previously approved does not comply with the variance granted. A Certificate of Occupancy can not be issued until this matter is corrected. There appear to be two options available to you to remedy this situation. removal of all construction not previously approved or, secondly, area variance application requesting additional relief, The current temporary Certificate of Occupancy for this building permit will expire on December 13, 1999, Please contact the building department for an extension, if necessary. Y _ 12845 Re: Polonski Residence Assembly Point Queensbury (T) ©ear Craig : At your request, 1 visited the Polonski residence on Assembly Point, Town of Queensbury , Lake George, N . Y . on July 17 , 1998 , The purpose of the visit was evaluation of the existing wastewater system . My on site observations included the following : The property is accessed from Bay Parkway and has approximately 70 feet of frontage on Lake George. - The existing wastewater system was partially hand excavated . The system , based on the site inspection as well as records obtained from the Town of Queensbury consists of a septic tank, pump chamber and a disposal field . Available plans indicated that the existing septic tank is 1000 gallons capacity . It is proposed to relocate the tank during building construction : the tank size and condition should be assessed upon reinstallation _ - The existing pump chamber is indicated by records to be 500 gallon capacity . Based on my site inspection , the chamber is at least several hundred gallons in capacity . More than 100 gallons of water was discharged into the pump chamber. The pump control system did start and stop the pump. The effluent was in fact discharged . The extremities of wastewater disposal field were hand excavated . Five laterals are presently installed at 3' and 4' on center- Overall width of the field ( lateral to lateral) is approximately 12 .5' . The length of each lateral was measured to be 18' +/ Based on the limited hand excavation and a series of probes, the stone above and below the distribution system was determined to be continuous. The stone also extends beyond the laterals_ - A test hole was excavated and logged as follows: (}" - 8"" Topsoil 8" - 32" Brown Fine Sand , Little: Silt A percolation test at 32" was recorded as 1 "/ 15 Minutes . The rate was rejected as being inconsistent with soil profile . The hole was excavated several days prior to inspection . Rainfall may have washed excessive fines to the bottom and influenced percolation rate . A second percolation test was conducted adjacent to the first hole, Percolation rate stabilized at 1 "/4 minutes for 3 ( three) successive trials . The stone is assumed to extend 2-3 feet beyond the laterals. Lateral separation from the O' Keefe property line was measured to be 9 .5' and 7 ' . It was reported that the Polonski , Morse , and O' Keefe properties all utilize a lake intake for water source. - The existing house has "low water usage" toilet fixtures installed - consumption is reported to be 1 .0 + /- gallon/flush . - Setbacks from Lake George were measured as follows : Lake to Septic Tank !00' + /- Lake to Pump Chamber 105' + /- Lake to Wastewater Field 1 13'+ /- In order to assess compliance with the Town of Queensbury standards, - the following have been consulted : Town of Queensbury Sanitary 8 Sewage Disposal Ordinance ( 1 982) NYS Department of Health - Appendix 75-A - Wastewater Treatment Standards - Individual Househould Systems N 'YS Department of Health Individual Residential Wastewater Treatment Systems - Design Handbook ( 1996) The proposed house contains three bedrooms_ A septic tank capacity of 1000 gallons is therefore required . The existing septic tank will be relocated during construction . The size and condition of the tank should be verified at that time. The existing wastewater field is assumed to be an "absorption bed" system . fSee page 20 of Appendix 75- A ) . Based on field measurements, the effective area of the bed is computed to be 363 + /- square feet ( 1 65' x 22') . The measured dimensions plus 2' on each side of the bed was utilized for area computation ( 1 2. 5' + 2' + 2' and 184 2' + 2' + ) . Witt- a design percolation of 1 " = 5 minutes, the bed application rate is 0.95 9011on/day/square foot. Bed capacity is therefore 345 gallons/day . Design flow for a home with post 1991 reduced flow fixtures is 1 10 gallons/day/bedroom or a total of 330/gallons/day . Based on the above observations, assumptions, measurements, and analysis, it is my opinion the existing wastewater system does conform to the standards of the Town of Queensbury with the following exceptions. Wastewater field setback from property lines is less than 10' . Wastewater field setback from proposed structure is less than 20'_ Craig , I trust the above is responsive to your request.
