Dear Dave:
This letter is to confirm our recent telephone conversation regarding wastewater disposal at Len
and Peg's Restaurant. As we discussed, when Rubin Ellsworth, the contractor for the restaurant,
investigated the sewage disposal system serving the restaurant he found that the septic tank and
dry wells had not been pumped in some time. He then called this office for assistance. 1 visited
the site and discussed with he and the owner the options available. Based on the fact that it is
advantageous to have residential and commercial systems separated, we proposed a new
wastewater disposal system for the apartment. A new system was subsequently permitted through
your office and installed by Mr. Ellsworth.
From my conversations with you and Brian Fear, there are apparently no documented failures or
complaints related to the original system that served both the apartment and restaurant.
Therefore, it is my understanding that a new wastewater disposal system to replace the system
that now serves (only) the restaurant portion of the facility is not required at this time. Should a
failure of the restaurant system be evident in the future, the owner will be required to install a
new wastewater disposal system designed in accordance with New York State Department of
Health/New York State DEC's Standards. The design for that system must be completed by a
licensed professional.
