The purpose of the evaluation is to determine whether the existing system complies with the technical requirements of current cosies and standards for the existing uses at the facility and for proposed renovations to the building. Applicable codes and standards include the NYSDEC Design Standards for Wastewater Treatment Works in the Lake George Basin and the Town of Queensbury Codes Chapter 136 — Sewers and Sewage Disposal and Chapter 137 — Septic Systems_ Existing Facilities Evaluation On January 18, 2023, 1 conducted a site visit and observed the facility and the wastewater treatment system components. The existing wastewater treatment system consists of two (2) sewage pump stations, one located at the office f retail store building and one located at the boat shop building, both of which deliver sewage to a 1 ,250-gallon capacity septic tank. Effluent from the septic tank flows by gravity to a distribution box that distributes septage to a shallow trench absorption field, consisting of five (5) 50400t long absorption trenches_ The system appears to generally comply with engineered plans titled Castaway Marina Wastewater System prepared by James Hutchins, P.E. , dated November 6, 1998, with the exception of the location of the sewage pump stations and septic tank. Actual locations for these components are depicted on the attached SRA Engineers drawing titled Castaway Marina Existing Conditions and Parking Plan_ According to accounts by the existing facility operator, the system has functioned properly with no problems during its 25 years of operation_ A recent property transfer inspection of the septic system by the Town of Queensbury Building and Codes Department identified minor deficiencies, including a damaged distribution box, unsealed pipe penetration at one of the pump stations, and exposed wiring at a pump station alarm. All deficiencies were repaired and the Town issued a final inspection on January 12, 2023 report indicating the system has passed inspection and appears to function properly under current loading conditions_ At the time of my inspection, all components appeared to be operating properly and there were no signs of current or historical failures at or around the absorption field such as staining, stressed vegetation, water breakout, or odors_ According to the 1998 wastewater system plans, the system was designed for a daily design flow of 500 gallons per day (gpd). Based on our review, the sizing and design of the system Craig Brown and John O'Brien February 17, 2023 Page 2 SRA Job #23-069 components are met for current codes and standards for a system capacity of 500 gpd. Minimum horizontal and vertical separation distances are met for all system components with the exception of the existing condition location of the sewage pump station for the office 1 store building, which does not meet the horizontal separation requirement to the on-site drilled well and Lake George. Activities at the facility include the seasonal operation of a marina with slips available for a maximum of 74 boats. There is one wastewater pump-out station on the docks and one fuel dispenser. Restrooms and showers are available for members on shore. There is a retail store, office, recreation room, and boat repair maintenance shop located on-premise. A maximum of 14 employees work at the facility including 10 full-time in the shop, 2 full-time in the office I store, and 2 seasonal deck hands. According to the NYSDEC design standards, one method of determining design flow is in accordance with Table 13-3 Typical Per-Unit Hydraulic Loading Rates, which are summarized forth is facility in Table 1 below: Marina with shore side 20 gpd per 74 slips 17480 gpd restroom facilities including slip shower Marina additional for 7 gpd per slip 74 slips 518 gpd wastewater dump station Employees 15 gpd per 14 employees 210 gpd employee Total Design Flow Per Table B-3 2 208 gpd There is a significant discrepancy between the design flow of the existing system of 500 gpd and the wastewater demand determined by unit flow rates of 2,208 gpd. That the system has operated for over two decades with no apparent problems suggests that the actual wastewater flows generated by the facility are significantly less than the design flows determined from the tables in the code. Other methods for determining design flow are allowed by code, including obtaining metered daily wastewater flow data from existing and similar facilities (Section B.6.b). It is recommended to measure daily wastewater flow rates at the facility for a minimum of one full operating season. This can be accomplished by installing run timers on the two sewage pumps and comparing the daily run times for each pump to its pumping flow rate in its current configuration. After obtaining actual wastewater Flow data over the course of a season , a determination can be made regarding existing system adequacy or the need to expand or otherwise modify the existing wastewater treatment system. Proposed improvements at the Facility Proposed improvements to the existing office I retail store I bathroom/recreation building include the continued renovation of the recreation room to include a storage room, kitchenette with a sink, and a single laundry washer and dryer for use by members only and updating the finishes in the existing bathrooms and showers_ The addition of the sink in the recreation room will Craig Brown and John O'Brien February 17, 2023 Page 3 SRA Job #23-069 coincide with the removal of an existing sink used by members in the vicinity of the showers and bathrooms. With the exception of the addition of the washer 1 dryer, these improvements do not constitute any change in the uses at the facility that would cause an increase to wastewater flows. It is therefore proposed to allow building permits to be issued to complete the renovations to the building, with the exception of the installation of a washer 1 dryer. Fallowing the collection of actual existing wastewater design flows, a determination can be made regarding any improvements to the wastewater disposal system that would be necessary to include the washer / dryer. This letter identifies our determination that no marina uses have been approved for tax parcel 16-1 -37. 1 . Tax parcel 16-1 -37. 1 and the properties comprising the Castaway Marina are currently zoned Waterfront Residential One Acre (WR-1A). Commercial uses such as marinas are not allowed uses in the WR-1A zone. Non-conforming uses that legally pre-exist the zoning ordinance are allowed to be continued and maintained in reasonable repair, but not expanded. Based on a review of the historical record associated with this use and a site visit conducted by Craig Brown with your cooperation on March 10, 2000, it is our determination that the storage of boats, boat trailers, and associated items on tax parcel 16-1 -37. 1 constitutes an illegal expansion of the marina operation sifacilities. The complaint specifically refers to a violation of the zoning ordinance for illegal use of residential property by the J&D Marina for boats, trailers, and equipment storage as well as automobile parking during boating season. I am referring specifically to the undeveloped residential parcel at the very end of Seelye Road in Cieverdale located between the land of James and Mary Ellen Merrigan tax map #16- 1 -37.3 Seelye Road and the boat storage area of the J&D Marina. This is parcel 92 on the enclosed map dated November 22, 1972. The use violation, as identified on the enclosed map, represents an ongoing development of that section of the residential lot into marina parking and boat/trailer/equipment storage. The parking, lot has gradually been expanded approximately 20' X 90'onto the residential lot. The latest expansion occurred this fall ( 1999) when the owner built a septic system and at the same time extended the parking area to the current depth of 2W . This complaint does not include the septic system. It should be noted as well that a 10 kious marina owner, Henry Heirn, was granted a variance (#605 dated 2/79) and the minutes of the proceedings of the Zoning Board of Appeals refers to a buffer zone being established between the residential area and the new marina boat storage building and parking-area- At that time, Mr. Heim indicated that the residential lot would remain wooded to satisfy the concerns of the ZBA regarding protecting the quality of the residential community. I would appreciate the zoning department looking into this matter_ I have researched the matter carefully with Craig Brown, the zoning enforcement officer, and believe that my complaint is valid and that the zoning ordinance applies to this situation and needs to be enforced.
