Your letter discusses discharges and wastewater treatment facilities as referenced in the Environmental Conservation Law and attempts to include holding tariksras a.unit that can either "discharge" or "treat" - waste water. This approach is not consistent with ECL 17-1709 subdivision 3 which clearly applies to, "The discharge of sewage . . . into the drainage basin of Lake George . . ." NOT to sewage stored in holding tanks which will be treated at and discharged from permitted waste treatment facilities. The regulation of residential on-site sewage treatment and disposal systems (including wastewater holding tanks) with a design capacity of 1,000 gallons per day or less is the responsibility of the local municipality and the local health department. The property is assessed as residential property.(i.e., 18±years of taxes) and Mr. Salvador proposes to construct a residence on the lake side of Rt. 9L and pump the resielenSel wastewater to a holding tank on.the south side of Rt. 9L. The property on the south side of Rt. 9L currently comprises Mr. Salvador's Dunhams Bay Lodge, a Part 7 Temporary Residence. Mr.Fear correctly advised Mr. Salvador that the proposal to.develop a new residence with a bolding tank is out of accord with Section 75-A.10(a) of 10NYCRR Appendix 75-A. "The use of holding tanks shall_ngt be permitted for new home construction.,.." • Our Environmental Health Manual Technical Item CSFP 526 titled • "Individual Sewage Treatment Systems-Design,Review and Approval Responsibilities" clearly indicates the local health-department has responsibility for plan.review and approval of new alternative and other individual sewage treatment systems as noted in sections 75-A.9 and 75 A.10 of Appendix 75-A. Mr. Salvador was aware of another Town of Queensbury resident at the northerly end of Assembly Paint recently reconstructing an existing 4,100 square feet home into approximately 14,000 square feet and installing a holding tank for wastewater handling and requested equal treatment for his proposed residence. The two situations are different and are addressed by different regulators. The Salvador proposal is new construction and is addressed by the local health department. The reconstnctecl residence is addressed by the Local Code Enforcement Oicer of the Town of Queensbury. The provisions of the Uniform Code are applicable to the reconstruction project since the cost of alterations, additions or repairs made within any 6-month period exceeds 50% of the cost of replacement of the building at the beginning of the 6-month period as per MAR-04-1998 14:46 CODES, D_I U I SI ON :.';'r_ . 518. 486' 4487 R.03 • Section 1231.3(b)of the Uniform Code. This letter is written in response to your letter of January 22, 1998 and our subsequent conversations relative to Department of Health actions on an application by Morse-to.the Queensbury Board of Health for a sewage variance. The Department of Health did not approve the request for a variance to allow the use of a holding tank. By letter dated 12/8/97 the applicants attorney was advised that the project was non-jurisdictional. The basis for that determination was the status of the property in that a structure currently exists on it and that the application was for a remodeling/renovation of that structure. Subsequent to that letter you have provided me with certain additional information relative to that project. Specifically a copy of the application for the variance which indicates that a conforming sewage disposal system could be placed on the lot and secondly a ' copy of the resolution passed by the Town Board of Health requiring, as a condition of approval, the approval of the Department of Health. On January 29; 1998 I had a telephone conversation with Mr. David Hatin at the Queensbury Town Hall. I advised him that the Department of Health had not approved the use of a holding tank on this parcel and that given the fact that a conforming subsurface system could be installed on the lot the Department would not approve use of a holding tank. Mr. Hatin advises the application is incorrect and that a conforming system cannot be installed on the parcel.. Further, the Town leaves the responsibility for obtaining DOH approval to the applicant and does not require proof that this has been obtained. The electrical sub was running wiring to each window head for the motorized blinds. Ductwork and design of the house mechanical system is still in progress. The mechanical subs were working in the area of the basement. No work was in progress on the Office elevator. Kevin, the Vermont stone mason, was working on the stone veneer on the basement fireplace._ They had completed the light box stone veneer surround for the eagle sculpture. Some rough in plumbing drain work had been started on the outdoor hot tub. Jim and I noted that the pitch on the hot tub drains would need adjusting. The existing hearth of the original fireplace had been removed. The original steel beams of the existing structure were exposed now that the hearth had been removed. The screen porch storm shutters had been closed down. The slate tile work on the screen porch floor had been completed._ The outside deck handrails had been completed on the main deck and screen porch decks with the exception of the diagonal rails. Handrails..still needed to be installed on the two decks of the three car garage wing. A mock up of a light cove detail in Phil's office cupola was installed, presumable for Phil's approval. The Billiard room sliding door and its respective rail/hardware mechanisms had been installed. __ While at the site the insulation crew was installing the prop-a-vent in the roof eaves and re-installing some loose batt insulation once the vent was secured. When at the site, John O'Brien the Town of Queensbury Building Inspector, Jim Mason and myself toured the second floor observing the fire caulking and blocking that had been installed. Areas that still required caulk or blocking were pointed out by John O'Brien and were immediately taken care of by Jim Mason's crew. Upon completion of the walk thru, Jim was given approval by John O'Brien to start the process of insulating the second floor only. John O'Brien also mentioned that he would be back to check the progress of that work once it had started. A much similar process to that discussed above, will need to be repeated on the first floor prior to insulation.
