Mathias Town Counsel SUBJECT: Regan & Denny Building Permit DATE: December 20, 1985 As you recall we have had several conversations regarding the need for Regan & Denny to obtain a variance prior to the issuance of a building permit for the construction of a crematorium on lands adjoining Pineview Cemetery. After review of applicable case law it is my opinion that a variance is unnecessary for this project. Our ordinance clearly requires a variance where a business non-conforming use is expanded or enlarged. Courts in New York, however, have recognized that in special circumstances certain uses would not be subject to a variance requirement. These special cases have in common uses which by their nature expand and examples of such uses are airports, marinas and quarries. New York State defines a cemetery to include a crematorium, and therefore I believe that cemeteries fit into the category where courts would not require a variance. Your property is located on the tax maps in Section 63 - Block 1 - Lot 1. 2 In zoning regulations for the Town of Queensbury, a funeral Home is, a permitted use, only by site plan review, in Rural Residential and Suburban Residential zones. Your property is located in a Plaza Commercial zone. Regan & Denny Funeral Home is a pre-existing, non-conforming use in that zone. To add acrematorium (or cemetary) to the property will re- quire a use variance. You will be asking to add to a non- conforming use. Also, your plot plan shows the proposed building would have a 15ft. rear setback. It will be necessary to provide for a 30ft. setback as shown in the regulations for a Plaza Commercial Zone, or apply for an area variance as well. Part of your application for the variance should be a corrected plot plan and indication that you have applied to ENCON as applies to air quailty control.
