"The basic poiition of the Court is that the 1 municipal entity will not be ZegaZZy allowed to retain the advantage of a contractor's honest mistake and that fair dealing requires under such circumstances j that a contractor be relieved of its bid.. . " noted that this is the circumstance 1 with the Zow bid of Wicker Ford, failed to include the price of the plow in the bid, have withdrawn the bid. . . Councilman Eise rrd-t-asked if there was any pickup trucks under State Contract Mr. NayZor- there wasn't anything. .. RESOLUTION TO ACCEPT BID ON 314 TON PICKUP TRUCK 'F..�nrtITTON RR, Introduced by Mr. Daniel Morrell who moved for its adoption, seconded by Mr. Daniel Olson: WHEREAS, Mr. Paul NayZor, Highway Superintendent for the Town of Queensbury did recommend that we advertise for bids fir a new 314 Ton Pickup Truck and WHEREAS, Two bids were submitted and received and opened at the specified time and place by the Director of Purchasing/Town Clerk Donald A. Chase, and such bids were then turned over to Mr. Naylor for his recommendation, and WHEREAS, Town Counsel by Zetter (on fiZe) has noted that the low bid from Wicker Ford, Ticonderoga , New York was in error and has been withdrawn, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby accepts the bid of MaZtbie Chevrolet Inc., Lake George, N.Y. in the amount of $12,057.00 with a rebate of $562. 00 making the price of the Chevrolet Truck $11,495.00, and be it further RESOLVED;' that the financing for such materials is included in the 1982 Highway Budget. Duty adopted by the following vote: (' Ayes: Mr. Olson, Dr. Eisenhart, Mr. MorreZZ; Mrs. Monahan, Mrs. Walter _ Noes: None Absent: None (Ltr. on FiZe-Highway Supt, re Operation Manager Position) RESOLUTION TO ABOLISH POSITION RESOLUTION Nn_ 91- Introduced by Dr. Eisenhart, Seconded by Mr. OZson: [ C, WHEREAS, the Highway Superintendent has notified the Boar& that' the position of Operations Manager is not necessary for the efficient operation of his department and WHEREAS, the Town Board is concerned that tax dollars are being spent underwriting an unnecessary position, NOW, THEREFORE BE IT RESOLVED, that the position of Operations Manager created by Town Board.Resolution No. 97 of 1980 will be abolished effective April 2, 1982.
