Anybody wish to speak to this resolution that the Town Board is considering for approving Bay
Ridge Volunteer Fire Company's purchase of a new 2025 Engine Tanker?
PATRICK MELLON, SR.-I'm Patrick Mellon Senior and Treasurer of the Bay Ridge Volunteer
Fire Company and First Assistant Fire Chief.
JACK MELLON-I am Jack Mellon, I am the Assistant Treasurer of the Bay Ridge Volunteer
Fire Company, if you have any questions.
MR. MELLON, SR.-If you have any questions.
SUPERVISOR STROUGH-Does this Town Board have any questions for the Treasurer and the
Assistant Treasurer.
COUNCILMAN FREER-What do you think you're going to get for the old one?
MR. MELLON, SR.-Right now, it's kind of up in the air. We're really not a hundred percent
sure where were, what we're going to get for it right now. Rates are really all over the place
right now.
SUPERVISOR STROUGH-And they've gotten expensive like everything else.
MR. MELLON, SR.-Yes, there's been, since we actually started with the project, there's been
significant price increases. Initially when we had started the project, the truck we were looking
at was 950,000 but since this started, it's actually gone up $300,000 just with the price of
materials and everything throughout the past few years with inflation and everything.

COUNCILMAN MCNULTY-Do you see the used vehicle prices going up as well? I mean the
used cars, they're astronomical. Do you see the same thing with the used fire apparatus?
MR. MELLON, SR.-I really can't answer that, I don't know.
SUPERVISOR STROUGH-This is kind of, I mean this is an unusual thing, it's not like everyone
has one of these old tankers in the backyard.
MR. MELLON, SR.-Yes. There are multiple different vendors that you can go through to have
this sold. So exactly what we're going to get, I can't tell you.
COUNCILMAN FREER-So how many tankers will we have with all five companies or do we
have? I should know that but I don't.
MR. MELLON, SR.-Six and by doing this too, this will actually increase our capacity by 200
gallons of water and also an additional 750 gallons per minute of water flow by replacing the
current engine tanker that we have.
SUPERVISOR STROUGH-Yes in an area that doesn't have a lot of fire hydrants.
MR. MELLON, SR.-That's correct.
SUPERVISOR STROUGH-So we need tankers.
MR. MELLONS, SR.-Yes.
MR. MELLON-And then if you consider the new construction that's being used or lightweight
construction, it burns a lot quicker. So we're seeing just as a trend in the last 10 to 15 years that
you do need more water so that's 200 gallons and you also need a higher water flow. So, that's
why our gallons per minute with the pump that we're buying is going to be 750 gallons per
minute large,just to count for that lightweight construction, the use of plastic and poly and stuff
like that, it's just a much hotter fire that we've got to fight.

RESOLUTION APPROVING BAY RIDGE VOLUNTEER FIRE CO., INC.'S
PURCHASE OF NEW 2025 ENGINE TANKER AND AUTHORIZING
INCURRENCE OF TAX-FREE FINANCING FOR SUCH PURCHASE
RESOLUTION NO.: 410,2023

WHEREAS,the Town of Queensbury and the Bay Ridge Volunteer Fire Company,Inc. (Fire
Company) have entered into an Agreement for fire protection services,which Agreement sets forth a

number of terms and conditions including a condition that the Fire Company will not purchase or
enter into any binding contract to purchase any piece of apparatus, equipment,vehicles,real property,
or make any improvements that would require the Fire Company to acquire a loan or mortgage or use
money placed in a"vehicles fund"without prior approval of the Town Board, and
WHEREAS, the Fire Company has advised the Town Board that it wishes to purchase a
new 2025 Rosenbauer Engine Tanker (Tanker) for a purchase price not to exceed $1,299,000 to
replace its 2004 American LaFrance Engine Tanker 324, such proposed purchase included in the
Fire Company's five (5) year capital plan that forecasts future capital needs and expenditures,
including anticipated vehicles, equipment, tools, other apparatus, facilities or improvements to
facilities to be used for firematic purposes, and
WHEREAS,the Fire Company proposes paying for the Tanker by using a maximum amount
of$1,299,000 in tax-exempt financing with the Adirondack Trust Company, and
WHEREAS, proceeds from the Fire Company's sale of Engine Tanker 324 will be placed
against the principal of the new,proposed Tanker and/or toward other Fire Company debt, and
WHEREAS, once the new Tanker is placed into service, the Fire Company will remove
Engine Tanker 324 from service and sell it after all potential warranty/service issues are resolved with
the new Tanker, and
WHEREAS, Town Board approval of such proposed purchase is required by the Fire
Company's Agreement with the Town and such proposed tax-exempt financing requires a public
hearing under the Internal Revenue Code, and
WHEREAS, on Monday, December 4t', 2023, the Town Board held such public hearing
and duly heard all interested persons, and
WHEREAS, the Town Board believes that this new Tanker will provide additional safety
protection for the Town while eliminating an aging Engine Tanker from the Fire Company's fleet and
therefore the Town Board wishes to adopt a Resolution authorizing such Tanker purchase and the
Fire Company's incurrence of tax-exempt debt,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves of the Bay Ridge
Volunteer Fire Company, Inc.'s purchase of a 2025 Rosenbauer Engine Tanker Truck (Tanker) to
replace its 2004 American LaFrance Engine Tanker 324 for a sum not to exceed$1,299,000, and
BE IT FURTHER,

RESOLVED, that the Town Board further approves of the Fire Company's incurrence of
up to $1,299,000 maximum amount in debt/tax-exempt financing for such purchase for up to a 15
year term with the Adirondack Trust Company with the understanding that the Town Board is relying
upon the Fire Company's assurance that the Tanker is serviceable and suitable for its long-term
intended use, and
BE IT FURTHER,
RESOLVED, that the Town of Queensbury does not guarantee such debt with the
Adirondack Trust Company on behalf of the Fire Company nor does the Town Board create or
intend to create any assumption on the part of the Town of any obligation or liability for the
financing, and
BE IT FURTHER,
RESOLVED,that the Town Board authorizes and directs the Town Supervisor and/or Budget
Officer to take all actions necessary to effectuate the terms of this Resolution.

1.2 Public Hearing—2024 Amended Agreement for Fire Protection Services with South
Queensbury Volunteer Fire Company, Inc.

SUPERVISOR STROUGH reviewed proposal and the changes for a one year contract with a six
percent increase. We decided to do a one year because there are so many unknowns coming up
and purchasing apparatus and everything else. We also added a phrase to the contract, all seven
contracts that the use of vehicles and apparatus should be restricted to official uses as determined
by the company. Each company probably has bylaws, should have bylaws and probably speaks
to the use of their vehicles. Only authorized occupants pursuing official purposes or duties in the
company are allowed to use company vehicles and that would be determined by the bylaws. If
you don't have bylaws, you should adopt bylaws. Such company authorized occupants may use
company vehicles and apparatus while pursuing authorized duties of the company. I'll open the
public hearing.

MR. HARRINGTON-First of all I'd like to say I appreciate you guys opening our contract and
raising us six percent. You didn't have to do that,you went above and beyond on that. The only
issue I have is John's just last phrase on the use of Company vehicles. We just had a meeting
between the five Town Chiefs, the rest of them, Chip is here with me now and will be
approaching you on this. Our concern is, you've got a garbage guy who picks up your garbage.

Contracts with you, same as I'm contracting with you. Do you tell him how many people, what
he can do with his vehicles? No, you don't, right?
SUPERVISOR STROUGH-Do we pay for that vehicle?
MR. HARRINGTON-You contracted with me, you didn't pay for my vehicle. I pay for my
vehicle. Right?
SUPERVISOR STROUGH-Well we pay for the vehicle.
MR. HARRINGTON-Just because another somebody went out and did something that they
shouldn't have done, and I totally agree with you, they shouldn't have done it, I shouldn't get a
red flag over me. I've never done anything wrong. I use my vehicle as my bylaws state. You
keep coming back to our bylaws, I don't understand why you want to govern our bylaws. I think
you want to govern them.
SUPERVISOR STROUGH-My suspicion is your bylaws probably reflect the very same
language that we have here.
MR. HARRINGTON-Probably a little bit stringent there because I will be sending them to you
but I just don't understand why it's in our contract.
SUPERVSIOR STROUGH-We decided what we do for one, we do for everybody.
MR. HARRINGTON-I understand that but I didn't do what the other company did. I mean that
is just plain out wrong if you ask me. I mean but that's your gig.
SUPERVISOR STROUGH-And I don't think you would...
MR. HARRINGTON-I mean we're volunteers, they're, he's being paid to do his service. I do
mine for free. Now I've got to worry about what I do is wrong by, and I'm going to get ... by
the Town.
SUPERVISOR STROUGH-Well what part of this would you change? I mean it says, use of
vehicle and apparatus should be restricted to official uses as determined by the company.
MR. HARRINGTON-I understand that so why is it in...
SUPERVISOR STROUGH-Is that a problem?
MR. HARRINGTON-No it's not a problem because my bylaws are stricter than that. But why is
it in my contract is what I don't understand?
SUPERVISOR STROUGH-Well because the Town Board wishes it to be in all of the contracts.
MR. HARRINGTON-And I didn't get a form of contract with this in it. The one you sent me
has nothing to do with this.
SUPERVISOR STROUGH-The one I sent last week did.
MR. HARRINGTON-Not with that in it. You added that and sent us a verbiage.
SUPERVISOR STROUGH-Yes I said I was proposing this verbiage and if you had anything to
say, I was looking for the emails suggesting different language.
MR. HARRINGTON-But we...

SUPERVISOR STROUGH-But I mean I think the Town Board is pretty firm on sticking with
this but if you have language that you would like because you would be more comfortable with
that language than the language we're putting forward, we're open to that.
MR. HARRINGTON-Maybe we should have a meeting between the five Town Departments
because like I said, we just came out of a meeting prior to this meeting, as we do the Town of
Queensbury Fire Departments are very strong together right now, we've already discussed it. So
I don't know what that does for our fire contract but we'd like to have a meeting set up where we
can discuss it with you guys.
COUNCILMAN MCNULTY-John if I may. Truth in lending, I was called during their meeting
so I listened, actually I was talked, spoken to at that meeting and I did get to converse with the
Chiefs. There is some concern among all five. If we could and gentlemen and ladies, you have
to understand that when we saw the initial pictures and we saw the initial text, all of us, all of us
to a man on the Board because it's all family now said that's not right. What do we have to
control this? And all of us took a stand that we've got to control this. We have that
responsibility to the Queensbury taxpayers. So I'm okay, John from my perspective, I won't
speak for the Board, to a sit-down to discuss it. I talked to Counsel before, I think the word
should and the way it's written now, we are not adding any additional administrative or burden
to the companies because you're already doing this stuff. But if the taxpayer asks me, Tim, what
are you doing to stop from a Town vehicle from going to a football game, I've got to say that, I
have to personally be able to look them in the eye, I didn't agree with it and this is what we've
done. And as John said, I can't, we're going to do different contracts but the wording has got to
be the same because there is already some discussion about some budget issues where we've
deviated a little bit and all of us got different phone calls from different Fire Chiefs about why
did you do this and not and so from our perspective, we have to be consistent. And I think the
wording is and I spoke to many, I talked to all of you tonight when we say should and we say
follow your own guidelines, I think that's okay but obviously there's a rub there. So I'm all for
having an opportunity to discuss with you all to, the worst thing we want to do is put together,
the Town Board vote on a resolution today, this is your contract and you guys come back and say
you're not going to sign it. That's the worst case and I don't think we're there now. I don't see
the rush, although as I said before, the contract starts one of January and I'd prefer not to see it in
the papers or whatever that here we go again, the Town hasn't signed a contract with the Fire
Department because we're ready to do it but we've got to agree to it as far as I'm concerned. So
John thanks for giving me the floor,that's all I've got on it.
SUPERVISOR STROUGH-Any other Town Board members have thoughts?
COUNCILMAN FREER-Yes, truth in lending, Tim and I discussed this as well and I was the
one who said, you know, we should make a systemic look at how to reform or tweak this, not
just for the Fire guys, not just for the EMS guys but we have Town staff who have vehicles and
so we asked Counsel to give us some wording so that we could be consistent and that we have,
that we're doing something. It's going to be in the paper tomorrow I suppose that and you know
for us to be able say well we didn't have any recourse and we don't have any control, that's not
what we want or what you guys want in terms of moving forward and you know working
together as first responders.
MR. HARRINGTON-I think the biggest thing of it is, is that we're all being painted with
somebody else's mistake. I didn't do it. My company didn't do it. Why do I have repercussions
from EMS who isn't even Fire, but EMS? You know what I mean? That's like calling me to the
Principal's office and slapping my hand because some kid punched somebody else. I mean it's
not, I didn't. Like you said, my bylaws are probably stricter than that what you're writing is, I
don't disagree with that. I mean...
SUPERVISOR STROUGH-John, I am asking what in that I just read?
MR. HARRINGTON-No,to be honest with you John, there's nothing really wrong with what
you just read.

SUPERVISOR STROUGH-Okay.
MR. HARRINGTON-The whole thing is you're trying to govern us when we didn't do nothing.
COUNCILMAN METIVIER-But we're also trying to prevent this from ever happening again.
COUNCILMAN FREER-Right, that's the purpose.
COUNCILMAN METIVIER-You've got to realize, it doesn't matter whose vehicle it is, I don't
care.
MR. HARRINGTON-Well it does because.
COUNCILMAN METIVIER-No, stop. Just stop. It doesn't matter whose vehicle it is. The fact
that it is an EMS or a Fire vehicle, it's part of the Town. The different proprieties are there,
we're not going to let it happen again. We're not saying you guys did anything wrong. We're
not saying that anybody else did. We're going, we are just simply saying this will never happen
again, period. If you don't like it, I'm not sure what to tell you, it's going to be part of the
contract. If you guys want to put your bylaws in place, that's fine. We're not telling you, you
can't but we are telling you that we are not going to let this happen again, period. If you want to
vote if fine. If you don't, we will table this and we'll discuss it but it's going to be part of the
contract whether or not you like the words or not, it's going to happen, period.
COUNCILMAN MCNULTY-But I think we're saying we'll work on words that we can all
agree to but as Tony said and I laid it out, we owe it to the Town of Queensbury that the
residents can see that, we all didn't appreciate it, don't, can't stand the use of a vehicle like this
to go to the Meadowlands or to go to Buffalo to watch a Bills game or a Rangers game in the
City, I should say the Islanders by the way. So the intent is, we have to show and it's not a
showing, it's not just oh we've got to do something, it's common sense. You don't take a
vehicle like this out. And John, I've also asked them if they could provide us copies of all of
their, the appropriate parts of their SOP's or SOG's. Not how to put up a ladder but how you can
show your vehicles so we can review those as well.
SUPERVISOR STROUGH-Alright so what I'm hearing is that the Town Board wants some kind
of wording, we've put this proposal forward. Do we change a couple of words here or there and
will that make things more acceptable to you?
MR. HARRINGTON-Sure as long as we can all agree on it.
SUPERVISOR STROUGH-Well.
COUNCILMAN FERONE-Well should we table this tonight so we can have that conversation?
SUPERVISOR STROUGH-Well we won't act on it and we'll keep the public hearing open and
we'll deal with it on our next meeting which will be the 18t'.
MR. HARRINGTON-Good.
MR. MELLON-Will we be able to have a meeting in between now and then John, do you think?
SUPERVISOR STROUGH-Yes.
MR. MELLON-And I think maybe we can come to an agreement of some sort.
SUPERVISOR STROUGH-Yes so I will arrange a meeting, we'll try to get at least three Town
Board members there. Pulling a meeting up that will happen in the next two weeks and with
everyone's schedule, we'll do what we can. So, I'll have Victoria gather the meeting with all

interested parties and we just won't act on this tonight. And whatever we do, I want to do for all
seven agencies, okay.
COUNCILMAN FREER-John, I have a question about exhibit A where I see an increase in your
debt service. I hope that's just a budgeting kind of thing.
MR. HARRINGTON-Yes. We're looking to approach the Town Board about a new engine.
Where in the mist of rescue, we're in the midst of...
COUNCLMAN FREER-So this debt service isn't for the renovation?
MR. HARRINGTON-No the renovation is done.
COUNCILMLAN FREER-Okay.
MR. HARRINGTON-We're good. I think our five year plan was a couple of doors and some
heat in the garage where we don't have heat, that's all we had for renovations.
COUNCILMAN FREER-Thank you.
SUPERVISOR STROUGH-Okay so we will hold off on this until December 18t' and probably
similar to the others, we'll see it how it goes because whatever language we adopt for one, I want
it to be consistent.
MR. HARRINGTON-That's why I think it needs to be all five Town Chiefs and Town
Presidents of the Fire Departments and the Boards.
SUPERVISOR STROUGH-And two Squads.
MR. HARRINGTON-You're going to bring them too?
COUNCILMAN FREER-Yes, that's the point. You know, this is not rocket science right.
There's a best practice out there. The Sheriff brings theirs, they have access. We have Water
and Highway people who are on call that and so we have to try to find something that makes
sense and so that we have some control and not more control than what we want, right? They're
not our vehicles, they're your vehicles, we understand that but we pay for essentially your whole
budget. So there's, you know...
MR. HARRINGTON-I don't disagree. And like I said, but I'm not going to say it again, I've
said it ten times, it is what it is.
SUPERVISOR STROUGH-Okay. Alright well that's what we'll do. We'll hold off on
approvals of these contracts until the 2018. We're setting Norths for 2018 and so hopefully at
2018, 1218 I mean 2023 we will approve everybody's budget.

1.3 Public Hearing—2024 Emergency Ambulance Services Agreement with West Glens
Falls Emergency Squad, Inc.

SUPERVISOR STROUGH reviewed proposed changes for the one year contract with six
percent increase with total amount of$1,516,817.00 for 2024. Noted same language as with all
seven contracts, the use of vehicles and apparatus should be restricted to official uses as
determined by the Squad. So I will open the public hearing on the proposed contract, one year
contract with West Glens Falls Emergency Squad. Is there anybody that wishes to speak to the
proposed contract for West Glens Falls EMS? So, I'm going to hold off on approving the
contract with the hope that we resolve the language in terms of vehicle use that will be language
that everyone is comfortable with. The Town Board is insistent that there will be some kind of
language. Does it have to be exactly what we proposed? No it doesn't but whatever we end up
with at the end of the day, I would like it to be the same language for all seven contracts. So
invited to the meeting will be the two Squads and the Five Fire Companies and we'll try and get
as many of the Town Board members we can there and publicize the meeting, it will be a
Workshop and we'll discuss it. Alright so I leave this public hearing open. I don't see any
interest at this time so I'll leave the public hearing open for West Glens Falls EMS and hopefully
we'll approve it on December 18t'.

1.4 Public Hearing—2024 Emergency Ambulance Services Agreement with Bay Ridge
Rescue Squad, Inc., DBA Queensbury Emergency Medical Service

SUPERVISOR STROUGH reviewed proposed changes for the one year contract with six
percent increase with total amount of$1,563,500.00 for 2024. We have to change exhibit B, it's
not on the contract but I think we understand $5,000 is going to change to $8,000 the same as
what we did for the Fire Departments. We'll make sure that Pam changes that, okay?
CARLINE KELLY-BARNES-That is perfectly fine.
SUPERVISOR STROUGH-Yes, so identify yourself for the matter of the record and we'll talk.
MS. KELLY-BARNES-Carline Kelly-Barnes, President of Queensbury Emergency Medical
Services, Inc., formerly known as Bay Ridge Rescue Squad Inc.
SUPERVISOR STROUGH-Thanks Carline. Anything you want to add to what I said?
MS. KELLY-BARNES-I understand based off of the previous individuals here that there's going
to be further negotiations on Paragraph E in regards to the use of company vehicles. At this time
Queensbury EMS has no objection but would like to be a part of that conversation and
understand that the Town would like uniform across all contracts. So we understand that that
conversation is going to continue. As far as the numbers on our contract they look the same and
my only comment was Exhibit B reflecting the $8,000.
SUPERVISOR STROUGH-Okay, alright. Thanks Carline.

COUNCLMAN MCNULTY-In your SGO's or SOP's, do you have provisions for the use of
vehicles?
MS. KELLY-BARNES-We did not and we have since rectified that and we have as a Board
solidified terms and conditions for company vehicles and that is going to be implemented at the

next membership monthly meeting because the bylaws are still required to have a membership
vote.

Introduction to Public Policy where they look for solutions to fix problems. Dave Duell,
Highway Superintendent,Mark Demers,Deputy Highway Superintendent and Senior Planner
Stu Baker were also present. We looked at traffic management in front of the school and
shared what we are working to do and we'll see what their report will be.
• Reported that the Town's Candy Lane was a huge success and read the following Dear Santa
letter:
`Dear Santa, thank you for the gifts last year, I really loved the warm clothes. I am
writing to ask something very special. Please oh please, can you get Queensbury to
allow chickens in Ward 2. My backyard needs to chickens to get rid of ticks and the
farm fresh eggs will be a gift that keeps on giving.'
• Wanted to share with the Board and the public. I received a letter from Jamie Thompson
from Cleverdale, `I recently purchased a home in Cleverdale just over a year ago. I've
attended two meetings in the past year in order to meet and observe portions of the
community. I was impressed at the speed, depth and knowledge and manner in which the
Board addresses items. Nice to see and sometimes we don't share enough. Please feel free
to share.
