ALL persons present at this hearing have the right to present written and oral comments on the proposed uses of FRS funds. The amount of FRS funds the recipient government anticipates receiving during its fiscal year is $160,643.00. Supervisor Walter- it is a complicated formula which is put together by the Federal Government—it is based on population, income. . .they have estimated what we are going to get, this year on the final quarter payment they indicated to us that we would be Five Thousand Dollars Less then originally estimated—we have been told by Congressmon Solomon that the formula would remain the same for 1983. Discussion held in regard to Fire Prevention Code. . .noted that next resolution in regard to the Fire Code would be to set a public hearing. . .Councilman Eisenhart noted that the Board had met with the Fire Study Committee and reeommenhtions were made. . . RESOLUTION TO APPROVE BINGO LICENSE RESOLUTION NO, 310, Introduced by Mr. Daniel Morrell who moved for its adoption, seconded by Mr. Daniel Olson: RESOLVED, that Bingo License No. 17023 be and hereby is approved allowing Glens Falls Lodge No. 81 Elks to hold Bingo from September 29, 1982 through March 23, 1983. I'm very interested in the responsibilities and functions of this council within the Township of Queensbury. Since the placement of members on this Council is "Appointment b the Town Board", p y I'am formally requesting that I be considered for filling one of the currect vacancies. I feel that this Council is very important to the welfare tf the Town and its natural resources and should not be Left stagnant. Sincerely, /s/ Frank LaBatore The following reports were placed on file: Town CZerkmonth of August Building & Zoning-month of August. 206 Councilman Olson- noted he received a call from a resident on Sweet Road requesting that the speed Limit be Lowered Mr. Bill Bishop- presented the Town Board with a petition from the Residents of the area requesting a Lower speed Limit on Sweet Road and that the Stop Signs on Sweet and Montrazy Road be replaced. . . Discussion held- it was noted that in June the Town Board requested a study of the speed limit on Sweet Road, in August the state replied setting the speed limit at 45 mph. it was suggested that the Town resubmit its request and urge that the speed Limit be Lowered to 30 mph. . . i RESOLUTION TO REQUEST LOWER SPEED LIMIT RESOLUTION NO. 32 , Introduced by Dr. Charles Eisenhart who moved for its a adoption, seconded by Mr. Daniel Olson: WBEBEAR , the Town Board on September 14 received a petition from residents of Sweet Road requesting a speed Limit of 30 mph on *ir street, and WHEREAS, the Town Board is also concerned over the speed Limit recently set by the State Department of Transportation NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby requests that the State Department of Transportation r6ovaZuate the speed Limit it recently set on Sweet Road and consider Lowering it to thirty miles per hour. Councilman Monahan- Today I met with your committee and with Mr. Coughlin and toured the Landfill, they brought out the points that they were concerned about and I think., got some answers.. . Councilman .Olson- in regard to cleaning up the Landfill, the Landfill has been completely fenced and grass areas. . . Frank Labatore- Has the closure plan for the dump site been done yet? CounciZman Olson-Reviewed the Landfill committee and how it is set up . Mr. Coughlin is working on plans and some surveying work has been done, the work will begin this fall and next spring to close off the landfill. . . Supervisor Walter- the State is looking for Engineering plans and we are now doing the preliminary work. . . Mrs. Huzar- Do you have a time in which this will be completed? Councilman OZson-Our plans call fdr next year, if the State,requirements do 'not change between now and then. At one time the requirements were to top szZ it, seed it and mow it --,zbhich we could meet very easily. Councilman Olson- Also a collection system was built at the lower site to collect `-' the run off that may appearjwhieh was built at the direction of ENCON. . . f Mrs. Huzar-Rainbow Trail-read Ze6ter that was sent to Mrs. Walter, from Region 5 Environment at Quality dated September 10, 1982 (on file) read the tabular of Lead, Mercury, Chromium, Iron and Manganese Listing the standards and the analysis samples at the test site. . . Supervisor Walter- On-:;quit ,the t5tk 'Towtt 'Board would like to be provided with a data which based your statment that the monitoring wells is contaminated by Zeachg#e. Your Letter is Lacking in specifics and I asked in my Limited technical knowledge the word contamination runs a broad spectrum from minute to severe. I said residents of the landfill area appeared at the Town Board Meeting Last evening are extremely upset with the information garnered from the ENCON files. I enclosed copies of the petition that Mr. Labatore referred to at the beginning of the meeting. Files of the Town do not contain any reference to these OZZeged concerns of ENCON. Since I have been the Town Supervisor there has been no correspondence to the Town from ENCON relative to the same. He went back to the Sept. 81 Letter whi-12h we did discuss., but which in your conversation�whre you were concerned with the operation of the Zandfill� that these,;parameters that were discussed are in areas of the old ZandfiZZ,, so we are not determining from the information as to whether our present operation is in fact full of contaminants. UNKNOWN- I was under the understanding that the test were taken from the test wells. Supervisor Walter- This L-otter was 1981 add Dunn-Geo Science drilled their own wells severdLoof which were inoperable after a time and other wells were drilled. 2 Mrs. Huzar- we are dealing with the current operation, there was no testing taken from the old landfill site, these 'test and results are from the monitoring wells two and three at the new Landfill site. . . Supervisor Walter- In talking with Mr. CoZden Today he indicated that my information was correct and that we do have testing reports on the office weZZ and other two wells. . . but this information in the Letter goes back to the Dunn-Geo Science where they had thr own wells. Mrs. Huzar- The only one that the Dunn-Geo Science report deals with is the manganese. . . and it iO so stated--in the letter. Supervisor WaZter- I have information from Dunn that they have tested for various elements. . . I understand that the State Dept. of HeaZth has tested a well in your area•►is the test results back? Mrs. Huzar-no We are saying that the test wells are contaminated with lead, Mercury, Chromium, Iron , Manganese-at this moment we do not know as of this date what other substances they are contaminated with, we would like an extensive test taken of those I wells, we are asking for a priority one analysis on those wells. . .if it finds out that it is further contaminated, it is only 100' from Mud Pond it seems only inevitable that it is traveling. We would Like to know what contamination there is at the landfill if it is there]how far has it gone. If it has gone, then find out if it has done into our water. . .if it has,we would Like a solution, if"it has not.,we would Like a program set up to monitor this. . . Supervisor WLilter- wouldn't it be wise to waitc.�for the well test to come back? Mrs. Huzar- They did not give a priority one analysis Councilman Monahan- Fran, what they are asking for is a more eomplete test, than anything that we do, do—because of all the different kinds of substances that they believe 208 are coming into the Landfill. Mrs. Huzar- in the Dunn-Geo Science Report they:-were concerned about the suspected PCB's dumping at the old Landfill site-they do not know that the contamination in the monitoring welts is coming from the old ZandfiZZ site or if the Ziner at the new ZandfiZZ is contributing Zeachate,.they do not know, no testing has ever been taken, to prove where it is coming from. Supervisor Walter-Mr. CoZden, in my conversations with him and I think he indicated to you that there were no PCB's, is that correct? Mrs. Huzar- no that is not correct. Supervisor Walter- I have talked with Mr. CoZden and his �oss�-I ,�j d if we were having a problem with ENCON and what we were doing up at; edai?-T#Sre was any l cause for concern I was assured by ENCON that they have no problem with the Queens bury ZandfiZZ. . .I talked today with Mr. CoZden and Mr. CorZiss, I indicated that the residents in the Town were very concerned and I felt that we needed to continue a dialogue and to find out whether there was in fact a problem. If there is determined that there is a problem by the results of the water that you are concerned about at your residen ass then the Town would certainly work with both State Agencies in doing something to eliminate the problem. . .but we have got to find out there is a -rproblem and in our conversations we are dealing with results of wells are being tesadftow by the Dept. of HeaZth. Mrs. Huzar- There is definette contamination at the Landfill on site. Supervisor Witter- yes, in Zeachate collection systems which are pumped. . .in a Letter that was dated August 23rd. Mr. CoZden sgys it looks Like it is not working, I replied to him, Zets get together and find out what does work, if you do not want us to dump it on top maybe you want us to truck it out, we are going to do that. . .I do not believe we are in the maket for expensive testing of the water on the site because the water on the site could be very very different off the site because of such thi.ngstas dilution . .so the water testing is going to be different in the various areas, if the water has traveled and you are picking it up in your we Us,, then that will be a time when we can Zook at it. Mrs. Huzar- you must start at the source, we are asking for a priority one test. . . on those wells. . . then we will know what to Zook for in our wells. . . Councilman Monahan- I think what they are trying to say is the Town is testing for five heavy metals and another test for twentyone chemicals, they feel that the testing is inadequate for all the Wings that are going into that ZandfiZZ they would Zike to find out what is in the Zeachate, so they know the type of thin#s they should be looking for in their own weZZjif it is seaping from the ZandfiZZ into whew they are. Sandra B.vwn - If we pay $1300 for testing our wells and it shows that our wells are contaminated from the dumpy wiZZ be be reimbursed for that money? Supervisor Walter- Thos-,Town is not going to reimburse you for anything, I indicated at the Last meeting,we neith6r had the money or the expertise here, that the Town reZ zes on the state agencies Dept. of HeaZth and ENCON for expertise and for these kinds of testing. Right now, I am having the results of the testing reviewed by an engineer other than ENCON, I will take the opinion of the expert. . .we are going to deal with the facts not emotions. . .Enc6n is very happy with the way the landfill is running they are not taking any Legal steps, I asked today if they were going to do sow they said they were not. Mr. Watt Stevenson- you cannot stand the smelt of my water. . .the well was perfect until the liandfiZZ was started. . . Supervisor Walter- The ZandfiZZ was started in 1946. Mr. Watt Stevenson- I have been here since 1932. . . .I am sure you will not give us a- tax break because you ruined the water in the area. . . Unknown- the old dump site is unlined, no matt�r what is put on top to cap its the fact that there is no Ziner under this, that cannot Shanged. . .you have fifteen acres of unlined dump site., god knows what was dumped in there. . .it is inevitaiZe that all of this is coming down. . .one priority test on well two or three would be sufficient for now. . . Edward Marino-If something does show up in these tests, these companies should be held back, this is another concern we have , . asked if waste oils are bring dumped at the ZandfiZZ? Supervisor Walter- I think the policy, and I have discussed it with Mr. Coughlin as I think the members of the ZandfiZZ committee have over the years, the purpose of the landfill is for eommerciaZ and household garbage that is what its is designed for. . . the employees certain#et Mr. Coughlin know when anythingo -unusuaZ comes into the dump. I spoke on the testing that was done 6k the liner material before it was used. . .we have tried to do what they said was right in order to control the quality of the environment. .. we could be doing everthing right here and coZZecting the Zeachate, youtweZZs could be contaminated but it may be coming from another area who is not doing anythin4.. . it will be difficult to determine that even through testing when other areas are not being tested at all. dames Broderick-Zett ,-say that the test do come back and they seem to shoal that the test Wells are contaminated, would you recommend to the Board of wealth or Encon that they take the necessary tests, I will offer my well as a test site. . . Supervisor Walter- In talking with Mr. Corliss today I assured him that we would have a continuing dialogue until we got some answerer at which time Z would hope that they would be ready to come with some solution. UNKNOWN- We have done a lot of research on our own and we feel that the:'-Town basically has done nothing. .. Supervisor WdZter- You are saying that the Town hasn't done anything-the Town has .done everthing that they are supposed to do, the testing that you are requiring are done by other agencies, the oler agencies are saying that we are not concerned with this potential problem at this time. Councilman Monahan- As a Town Board member I am concerned with some of these results and these reports. Supervisor Walter- 09, Betty I think that you are going to be the representative to ENCON and I would really welcome you trying to talk with them at this particular point to get them to go in any direction at all. The story that you have heard, that I have heard is that t,' -?xrrve A0 they have is priority-this is not a priority-they have major problems in other areas and they will be dealing with those. They are currently testing and when they get the results of the tests and are an4khq d they will then determine a course of action. Councilman Monahan- I think what these people would like is when the test results are back., they would like a roudd'.table meeting with the Town Board, ENCON, the landfill committee and some representatives of this group. Supervisor Walter- anyone that deals with government, understands that these things do not happen over night. . . . UNKNOWN- We would like to see the Town Board one step ahead and do these things on their own. Is there a limitation as to where they can pickup the debris and bring it in? Supervisor Walter -The Haulers have State requirements, as far as the Town for the use of the ZandfiZZ., then buy a permit on a yearly basis, there is no Zegislation that says it must dome from the Town of Queensbury. Mrs. Huzar- The Town CZerk 's Office issues the permits?,who's responsibility is it to enforce that they do have a permit? Supervisor Wdtter- we rely on the ZandfilZ superintendent, and the f6ZZows at the landfill. Mrs. Huzar- spoke about a hauler that was late getting the permit from JuZy 31 expiration renewed in September. . . . J&nee Broderick- What is the total income for the landfill? Sueprvisor Walter- noted that she did not have the figures in front of her but it would be around $150,000. . .we are trying to g6t this off the tax base and have it run from the fees. . . James Brodv-ii A_a man at the dump said, they don't question anything that goes into the dump, I do not ask where it comes fromjwe don't care. . .I have a problem with the monmtoring Mrs. Huzar- how can we get a stipulation that wastes from other areas cannot be brought into our ZandfiZL. . . Supervisor Walter- that should be brought up at a ZandfiZl meeting. . . Mr. Labotore-we have made observations that the-.Town- s .probabZy losing thousands of dollars a year the way the landfill is being operated. . . UNKNOWN- we do not have any proof. . . James Brochr iek-I observed the Zandfill Zast rgaturday from -;across the road and we noticed trucks going in who did not stop, we salt garbage trucks going in and paying fifty cents going through the turnstiles, I saM one go in, stop at the shed and a man coming out and'4�dti d him on, he did not get near him to have the ticket stamped. -We sal a sewage tankers come in, he is supposed to pay one dollar a cubic yard, he paid fifty cents,does that seem reasonable, I pay fifty cents and I felt slighted I have three to four bags of garbage. . . Supervisor Walter- you have made some allegations here this 'evening, you realize that, they are public. —you are willing to sign a complaint or something on that? James Brodei-irk-The arguments that we are trying to bring up tonight are all in support of what we first requested, to get our water tested. . . if there is not the inspection, Zets say the ZandfiZZ is not inspected for what chemicals are thrown in there and trucks can dump what they want, that is supporting the problem of having the chemicals as a possible contaminaht to my water•avZZ. . .we want to get support enough to make sure our water is safe and if it is note to help moliiVate you people to start the plans bring us Town water. Supervisor Walter- we could do that tomorrow but it will cost you. . . .a study would have to be done by an engineer as to what would be needed. . .! UNKNOWN- do any of the commercial haulers have keys to get into the Landfill after hours? Listed items that were requested. . . Mrs. Huzar- in regard to the Conservation Advisory Council files, I was told by Barbara Howe that they do not know where the files are. . . Mrs. Howe- noted that she had Zocated two files for the Conservation Advisory Council but the box that Mr. Tara= r had vantioned was not found. . . Mrs. Huzar- I wanted the Town Board to know that there is no subject matter List and that I have had difficijZty in getting i*to,--the.,fiZes. . . Mr. Donald Chase- in regard to the'" ubjeet matter List, that list was put on the wall win it first came out, I was being bothered by people who wanted the Birth, Death and Marriage Records, insurance companies coming in going through my marriage records so they could sell insurance. In regard to other records, there is a Lot of work that has to be done down stairs, as far as I am concerned as Records Access Officer there will not be a List until we can get the Recreation Dept. the Police Dept. and ugho ever else may be using the room down stairs, where we can put the records in some type of an order. ..I have only been here from 1970 there are records back to the 1920 's and 301s. When the Town Board gives me a room for files and records-1 can assure you we will be in weekends setting up a filing system and then we will know what is down there. At this point I know what is down there since 1970 on but before that I cannot help you. In regard to files in my office don't worry about a List. . . Mrs. Huzar- I have not had a problem with your office. Supervisor Walter- He does not have personnel records in his office. . .we have negotiati®n;l Legal matters most of those things are not open to the public. Councilman Monahan- I would Like to comment on a remark you made Mr. Lcrbatore in the an petition, depositing pesticides in the ZandfiZl, I would Like #ou,:to ask ENCON if they have told AbaZene how to get rid of pesticides that they are no Longer supposed to have in their care. I was talking with a gentZemen ,& handles pesticides that the directive come out from Encon that they could not use them any more, he,zaid, I waited months, toy try and find out how they wanted me to dispose of these. ', Because of the fact that they did not respond to me I finally took it upon myself to dump them in the Landfill. (noted that this wgstnot our Landfill) This is part of the problem, the State is issuing orders but gelling people how they can follow these through. Councilman Olson- We will move very swiftly. . .noted that thi re will be a Landfill meeting J Thursday at 4:30 P.M. we will bring your request to the committee meeting. . I 212 - Miss Lucas- Asked if any consideration had been given to a regionaZ, county ZandfiZZ. . . Supervisor Walter- noted it was a very expensive proprosition. . .noted that in June the Town Board looAdat a resource recovery system. . .no decision has been made. . . I believe all of us on the Board feel that this is the way of the future. .. Councilman Eisenhart- noted that if we did go to such a system the energy generated from the system could be sold to Niagara Mohawk. . . UNKNOWN- asked if the Sludge generated fronthe City,Ciba Gegy Sewage Plant wouZd be i brought to the G.F. Qsby. LandfiZZ? i Councilman Olson- Queensbury has gone on record with the State and EPA by Resolution, by letters that we are not going to accept the sludge from the sewer plant. . . f Supervisor Walter- ore of the things that the City is considering is burning the sludge at the site. . .
