Project Description
Applicant proposes to construct a telecommunications facility - 130' monopole with 9 antennas, associated
equipment shelter and pad all within a fenced area. Pursuant to Chapter 179-5 & 179-9 of the Zoning
Ordinance Telecommunication Towers shall be subject to Planning Board review and approval. Variance:
Use Variance required as telecommunications facilities are not allowed in a MDR zone. Planning Board shall
provide a recommendation to the Zoning Board of Appeals.
Staff Comments
The applicant proposes to utilize a 10,000 sq ft area to install a 130 ft monopole cellular tower and associated
equipment. The applicant has indicated that the area will be fenced in with a 40 x 60 ft area and to include a
equipment shelter and a generator. The site is a new cell tower and is subject to a use variance for utility usage.
The application provides details of reviewing sites that have an existing tower for shared use and locating in
areas that allow new towers where neither met the needs of placement of new tower. The applicant has
provided a visual analysis and gap coverage maps. The project is located in the Adirondack Park and is already
in the review process where the APA has asked for the local review to be completed before they proceed. The
applicant is also completing the necessary materials for NYSDEC as the project site has an existing mining
permit that is subject to modification with the DEC.
NATURE OF VARIANCE
The applicant requests a use variance for placement of a cell tower in area that does not allow towers. The
criteria is specific for telecommunications this includes providing information about necessity, compelling
reasons for the tower, and the extent of burden on the community.

The applicant has submitted an application for the following:

Dear Mr. Brown:
The Chazen Companies (Chazen) has received a submission package from your office for the above
referenced project. The applicant intends to construct a new telecommunications tower and auxiliary
facilities within a 40' x 60' fenced area at 1359 Ridge Road. Submitted information includes the
following:
• Application document by Phillips Lytle LLP, dated September 15, 2015, which included the
following items:
o Site Plans titled, "Construction Plans For AT&T Telecommunication Tower at 1359 Ridge
Road,Queensbury, New York 12804", by Vision Engineering, PLLC,dated October 2014;
o Stormwater mitigation letter titled, "New Cingular Wireless, LLC Telecommunications
Tower Application(s)Stormwater Mitigation",dated August 8,2015.
Your office has requested that we limit our review to the design of stormwater system as it relates to
compliance to local, state or relevant codes and regulations. Based upon our review, Chazen offers the
following comments for the Town's consideration:
Stormwater Management& Erosion and Sediment Control:
1. The project proposes to disturb an area of 9,148 square feet of land (According to Exhibit P
Stormwater Mitigation letter dated August 8, 2015 by Vision Engineering) and will not be
subject to NYSDEC Phase II Stormwater Regulations. However, this project falls within the Lake
George watershed and will be subject to the requirements of Section 147-11,for Projects within
the Lake George Park.

2. Per Section 147-11(I)(2)(a)of the Town code,the Applicant has chosen the alternate stormwater
runoff calculation approach for the basis of design, which utilizes 1.5 gallons of stormwater
capacity for every square foot of net increase in impervious area. The Applicant intends to use
the void space within the 12-inches of No. 1 &2 stone bedding of the tower compound bedding.
The Applicant states that the entire stone bedding is being utilized as a temporary storage
device(utilizing voids) until the "runoff" can infiltrate into the subsurface below.
3. The project's proposed stormwater design, which utilizes the tower compound bedding as
runoff storage, was discussed with the Lake George Park Commission. The Lake George Park
Commission considers the tower compound bedding as an impervious surface, and as such, the
Commission does not allow tower bedding to be utilized as a stormwater features. The
Applicant shall revise the site plan accordingly.
