DISCUSSION HELD ON THE PUBLIC HEALTH PROBLEMS
i
SUPERVISOR BRANDT-THE TOWN BOARD HAS TAKEN A PRETTY SIFONG STAND ON
PUBLIC HEALTH MATTERS , TO NOTIFY THE PUBLIC THAT IT WILL NOT TOLERATE
SOME OF THE HEALTH HAZARDS IN THE WAY HOMES ARE MAINTAINED THAT WE
HAVE OBSERVED. THIS IS THE FIRST STEP IN PUTTING SOME TEETH INTO THE
SITUATION , WE ARE PUTTING EVERYONE ON NOTICE IT IS NOT ACCEPTABLE TO
HAVE FILTH AT HOME SITES IN QUEENSBURY . IF WE HOLD A PUBLIC HEARING
AND WE FIND WHAT NEEDS TO BE DONE THE TOWN EMPLOYEES WILL GO CLEAN
UP THE MESS AND THE COST OF THAT CLEAN UP WORK WILL THEN BE ASSESSED
AGAINST THE TAXES OF THAT PROPERTY. THERE IS A MECHANISM TO DO THAT
AND WE ARE IN THE PROCESS OF DOING4 IT IF NECESSARY .
COMMUNICATIONS :
LTR.
MR. MIKE BRANDT, SUPERVISOR
QUEENSBURY TOWN OFFICE BUILDING
BAY ROAD
GLENS FALLS , N.Y. 12801
DEAR MR. BRANDT :
IT HAS COME TO MY ATTENTION THAT A VACANCY PRESENTLY EXISTS
ON THE QUEENSBURY CONSERVATION ADVISORY COUNCIL. I WISH TO BE f
CONSIDERED FOR APPOINTMENT TO THE COUNCIL. J
I HOLD A M. S. DEGREE IN URBAN AND ENVIRONMENTAL STUDIES FROM
RPI AND A B .S. DEGREE IN BIOLOGICAL SCIENCES FROM BROCKPORT STATE
COLLEGE. PRESENTLY I AM EMPLOYED BY THE N.Y. S. DEPARTMENT OF
ENVIRONMENTAL CONSERVATION AS A SENIOR ENVIRONMENTAL ANALYST IN THE
DIVISION OF LANDS AND FORESTS .
IT SEEMS THAT THE PROBLEMS AND ISSUES FACING OUR GOVERNMENTAL
DECISION MAKERS GET MORE COMPLEX AS TIME GOES ON. THERE ARE FEW
EASY OR SIMPLE SOLUTIONS . A CAC CAN BE A USEFUL TOOL OF TOWN
GOVERNMENT BY PROVIDING GUIDANCE ON ENVIRONMENTAL MATTERS IN A
CONSTRUCTIVE MANNER.
AS A LIFELONG RESIDENT OF QUEENSBURY I HAVE AN INTEREST IN
THE TOWN 'S ECONOMIC AND ENVIRONMENTAL VIABILITY. I FEEL THAT I
CAN MAKE A CONTRIBUTION TO THE COUNCIL ' S EFFORTS AND THEREFORE:
SUBMIT MYSELF AS A CANDIDATE FOR THE VACANCY.
SINCERELY ,
/S/
TERRY J . CRANNFLL
RD 2 LUZERNE RD.
GLENS FALLS , NEW YORK 12801
COUNCILMAN ROBERTSON- HE IS QUALIFIED BUT WOULD HE RUN INTO A
CONFLICT OF INTEREST?
SUPERVISOR BRANDT- HE WOULD BE IN A POSITION TO REMOVE HIMSELF SO
AS TO AVOID CONFLICT. . . I HAVE KNOWN TERRY ('O9, YjFARS. . . I THINK
HE WOULD BE AN IDEAL TYPE OF PERSON TO GFT C(Tp '(HIS TYPE OF
COMMITTEE. . .
COUNCILMAN EISENHART- I WILL SPEAK TO MR. ARTHUR TO SEE IF HF
FEELS THAT WE SHOULD APPOINT ANOTHER MEMBER. . .
COUNCILMAN WALTER- ANNOUNCED THAT THERE ARE VACANCIES ON THE
BEAUTIFICATION COMMITTEE. . . . APPLICATIONS ARE WELCOMED. . .
OPEN FORUM :
MR. FLOYD PICKETT- OUE=STIONEU IF THE BOARD COULD LOOK INTO FALSE
ADVERTISING BY LOCAL MERCHANTS. . . ADVERTISING A NUMBER OF ITEMS
TO BE SOLD AT A CERTAIN TIME AND THAT NUMBER IS NOT AVAILABLE. . .
SUPERVISOR BRANDT- REQUESTED THAT MR. PICKETT GIVE THE SPECIFICS
TO MRS. SHENK THAT SHE WILL BE ABLE TO PASS THE PROBLEM ON TO
THE PROPER STATE AGENCY. . .
MR. DANIEL MORRELL- VOICED HIS CONCERN OVER THE PROPOSED REGULATIONS
I
FORTHCOMING FROM THE STATE YN REGARD TO MARINA 'S AND MOORINGS ETC.
ON LK. GEORGE. . . REQUESTED THAT THE TOWN BOARD CHECK INTO THE NEW
PROPOSED REGULATIONS. . .
COUNCILMAN ROBERTSON- THERE WILL 'BE A HEARING ON DEC. 8TH AT THE
TOWN OFFICE BUILDING IN LAKE GEORGE AT 10 : 30 AT WHICH TIME ANY ALL
PERSONS WILL BE HEARD IN REGARD TO THE REGULATIONS . . .
COUNCILMAN WALTER-THE PLANNING BOARD FROM THE TOWN OF QUEENSBURY WILL
ATTEND THAT MEETING ON BEHALF OF THE TOWN . . .
SUPERVISOR BRANDT- NOTED THAT THE TOWN HAD TRIED TO HAVE SOME TYPE
OF REGULATIONS OF MOORINGS ETC. ON THE LAKES , THIS LED TO A DISCUSSION
OF THE WHOLE PROBLEM WITH THE LAKE GEORGE PARK COMMISSION. . . COPIES OF THE
PROPOSED REGULATIONS ARE AVAILABLE. . .
( QUEENSBURY BOARD OF HEALTH IN SESSION )
HEARING-PREMISES ON OHIO AVENUE-
' TOWN COUNSEL-I DO NOT BELIEVE THAT MRS . LAFRENIERE DISAGREES WITH THE
HEALTH NOTICE IN ANY RESPECT, SHE IS ONLY THE TENANT ON THE PREMISES . . .
THERE IS A QUESTION CONCERNING THE OWNERSHIP. ACCORDING TO THE RECORDS
THE PROPERTY IS OWNED BY MR. ELIJAH THORPE AND INA FOX BOTH OF WHOM
ARE DECEASED, THERE APPEARS TO BE NO ESTATE PROCEEDINGS CONCERNING EITHER
I PARTY. ACCORDING TO MRS. LAFRENIERE THERE HAS BEEN NO PROBATE 07 THE WILL,
SHE UNDERSTANDSIUNDER THE TERMS OF INA FOX ' S WILL. THE PROPERTY WAS LEFT
TO MRS. LAFRENIERE' S MOTHER WHO DIED FIVE YEARS AGO. . . IT IS MRS.
LAFRENIERE UNDERSTANDING THAT UPON THE EXPIRATION OF THE LIFE ESTATE
CLAUSE OF MRS. LAFRENIERE ' S MOTHER THE TITLE WOULD PASS TO A EUGENE
FOX. MRS. LAFRENIERE HAS SAID THAT MR. FOX HAS NOT INDICATED ANY INTEREST
IN THE PROPERTY, HE WOULD NOT BE THE LEGAL OWNER UNLESS THE WILL IS
BROUGHT TO PROBATE. EVEN THOUGH THE PROPERTY HAS NOT HAD ITS TAXES
PAID ON IT FOR SEVERAL YEARS THE CO. HAS NOT ACQUIRED TITLE TO THE PROPERTY.
MRS. LAFRENIERE HAS MADE ARRANGEMENTS TO LIVE AT THE HENRY HUDSON
TOWNHOUSES AND WILL BE MOVING IN A SHORT TIME. . .
SUPERVISOR BRANDT- HOW LONG HAS THE WARREN CO,. SOCIAL SERVICES DEPT.
BEEN INVOLVED IN THIS SITUATION?
62
MRS. LAFRENIERE- SINCE JULY,
COUNCILMAN WALTER- THERE ARE NO ARREARS IN TAXES?
TOWN COUNSEL- IT IS MY UNDERSTANDING THAT TAB ON THIS PROPERTY HAVE
NOT BEEN PAID FOR SEVERAL YEARS. . .
[QUNCILMAN ROBERTSON- IS THERE ANY LEGAL GUIDE SO THAT NO OTHER
TENANTS MOVE INTO THIS PROPERTY WITHOUT THE HEALTH SITUATIONS
BEING REPAIRED?
TOWN COUNSEL- THE TOWN BOARD CAN DETERMINE UNDER DR. REIDS REPORT
THAT A HEALTH HAZARD DOES EXIST, THAT THE EXISTANCE OF THE HEALTH
HAZARD CONSTITUTES A PUBLIC NUISANCE, THE TOWN WOULD THEN BE EMPOWERED
BY THE ACTION OF THIS BOARD , ACTING AS A LOCAL HEALTH BOARD , TO TAKE
THE ACTION NECESSARY TO CORRECT THE CONDITIONS AND ALLEVIATE
THE HEALTH HAZARD. THEN A PROCEEDING CAN BE EMPLOYED SO THAT THE
TOWN CAN PROCURE A JUDGEMENT FOR THE AMOUNT EXPENDED TO ALLEVIATE
THE CONDITION AND THE JUDGEMENT BECOMES A FIRST LEIN AGAINST THE
PROPERTY . . . THE PROPERTY CAN BE SOLD TO SATIgY THAT LEIN .
COUNCILMAN OLSON- DOES MRS. LEFRENIERE PAY RENT?
MRS. LEFRENIERE- NO
COUNCILMAN OLSON- I SUGGEST THAT THE TOWN HAVE THE :PROPERTY POSTED
