1.1 1.1 WASTEWATER-SEWER\APPROVE\Gibson—Absorption,Septic&Pmnp Station-Setbacks—7-15-13 RESOLUTION APPROVING JUDY GIBSON'S APPLICATION FOR SANITARY SEWAGE DISPOSAL VARIANCES RESOLUTION NO.: ,2013 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, Judy Gibson has an existing failed septic system which is proposed to be removed completely and replaced with a new septic tank, pump station and absorption bed on an adjacent parcel owned by Ms. Gibson, and WHEREAS, Ms. Gibson filed an application for three (3) variances from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 regarding such proposed replacement system to allow: 1. An absorption system to be located 184' from her well in lieu of the required 200' setback; 2. A septic tank to be located 18.3' from her well in lieu of the required 50' setback; and 3. A septic tank/pump station to be located 47 from the north property line and 5' from the east property line in lieu of the required 10' setback; on property located at 106 Sunnyside Road in the Town of Queensbury, and WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's official newspaper and the Local Board of Health conducted a public hearing concerning the variance requests on Monday, August 5t', 2013, and WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners within 500 feet of the subject property, NOW, THEREFORE, BE IT RESOLVED, that 1. due to the nature of the variances, the Local Board of Health determines that the variances would not be materially detrimental to the purposes and objectives of this Ordinance or other adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan or policy; and 2. the Local Board of Health finds that the granting of the variances is necessary for the reasonable use of the land and is the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect Judy Gibson, applicant; and BE IT FURTHER, RESOLVED, that the Local Board of Health hereby approves Judy Gibson's application for variances from the Sewage Disposal Ordinance to allow: 1. An absorption system to be located 184' from her well in lieu of the required 200' setback; 2. A septic tank to be located 18.3' from her well in lieu of the required 50' setback; and 3. A septic tank/pump station to be located 47 from the north property line and 5' from the east property line in lieu of the required 10' setback; on property located at 106 Sunnyside Road in the Town of Queensbury and bearing Tax Map No.'s: 279.17-1-26&27, 279.17-2-17. 2 Duly adopted this 5h day of August, 2013, by the following vote: AYES NOES ABSENT: 3
