PROJECT DESCRIPTION: Site Plan: Applicant proposes removal of existing gas canopy and
replacement with a 46 x 50 sq. ft. canopy with an increase from 2 pumps to 4 pumps. Activity includes an
increase in paved area around the canopy and relocation of one planting bed. Site improvements in a CI zone
require Planning Board review and approval. Variance: Relief requested from front yard setback, travel
corridor, and permeability requirements. Planning Board shall make a recommendation to the ZBA.

STAFF COMMENTS:
The applicant proposes to remove an existing canopy with two gas pumps to install a 2,300 sq. ft. canopy with 4
pumps. The new canopy will increase the impermeable pavement and relocate an existing flower bed closer to
the corner of Bay and Cronin Road. The height of the canopy is to be 14 ft. 6 in from the canopy bottom to the
ground. The canopy will not be backlit and lighting underneath the canopy will be about 8 recessed code
compliant fixtures. The existing flower bed will be relocated to be closer to the corner of Bay and Cronin Road.
The sign within the flower bed will remain and is not moving. The plans also show a new bike rack to be
situated on the Bay Road side. The site plan also includes the proposed addition that was approved as SP 36-13.
The exterior of the building has a new entry door and the outdoor eating tables have been located to each corner
side of the building.
NATURE OF AREA VARIANCE
The installation of the new canopy requires setback relief and permeability relief. The canopy will be setback
from Bay Road 42 ft. and 31 ft. from Cronin Road where the required setback on both roads is 75 ft. as well as a
travel corridor overlay setback on Bay Rd where 75 ft. setback is also required. Also proposed is a decrease in
permeable surface on the site from 31%to 21%where 30% is required.

Dear Mr. Brown:
The Chazen Companies (Chazen) has received a submission package from your office for the above
project.The Applicant intends to remove an existing canopy and replace it with a 46' by 50' canopy with
4 gas pumps. The Applicant also proposes to extend the blacktop to accommodate the wider canopy.
Submitted information includes the following:
• Plans and Details, prepared by L.H. Rutland Jr., P.E.,July 31, 2013, and;
• A Site Plan Application with supporting documentation.
Your office has requested that we limit our review to the design of stormwater management and
erosion and sediment control items as it relates to compliance to local, state or relevant codes and
regulations. Based upon our review of the information provided, Chazen offers the following comments
for the Town's consideration:
Site Plan:
1. The proposed site improvements disturb approximately 3,700 square feet of land and will not
be subject to NYSDEC Phase II Stormwater Regulations.
2. It is noted that the applicant proposes the use of two drywells on site to mitigate runoff from
the proposed increase in impervious surface associated with the project. It is requested that the
Applicant furnish calculation supporting the sizing of the drywells. Also, the Applicant shall
advance soils investigation at the location of the proposed drywells to confirm that adequate
separation between the bottom of the drywell and groundwater (3-feet per the NYSDEC
Stormwater Management Design Manual), is provided. If the drywells are sized for a certain
infiltration rate, infiltration testing shall also be performed.

3. The Applicant does not depict any erosion and sediment controls on the site layout plan. As
such, the Applicant shall implement the use of silt fence downgradient of the proposed
disturbed areas and it is recommended that the Applicant consider inlet protection on the
existing catch basins. Also, the Applicant shall indicate the seed mixture, mulch and application
rate that will be used on site to establish vegetation following construction. The Applicant shall
include details and construction specifications for these measures in accordance with the NYS
Standards and Specifications for Erosion and Sediment Control.
4. In order to verify that there are no conflicts from stormwater infiltration devices being located
above water service lines, the Applicant shall show the approximate location of the water
service line to the store.
Conclusions and Recommendations
It is our opinion that the applicant should provide clarification for the above items and incorporate the
changes in subsequent plan submissions.
