I am writing to you in order to document my review of your proposed project at the above-
referenced location. I have reviewed your proposed plan and find that an Area Variance will be
needed for your project.
Specifically, your plot plan in your building permit application for a porch on your property
shows that the porch does not meet the minimum front setback of the Moderate Density
Residential, (MDR) district. As such, an Area Variance is needed.

THIS INDENTURE,made the ZZ.day of QC¢Q ,Two Thousand Three
BETWEEN
GARRY L.HAMLIN and BARBARA J.HAMLIN,his wife,as tenants by the entirety,
residing at 1069 West Mountain Road,Queensbury,New York 12804
parties of the first part,and
DARLENE HAYES and MICHAEL T. HAYES, as joint tenants with right of
survivorship,residing at 28 Norman Street,Lake George,New York 12845
parties of the second part
WITNESSETH,that the parties of the first part,in consideration of One and 00/100 Dollars
($1.00)lawful money of the United States and other good and valuable consideration paid by
the parties of the second part,does hereby grant and release unto the parties of the second
part,their heirs and assigns forever,
ALL that piece or parcel of land situate,lying and being in the Town of Queensbury,County
of Warren and State of New York,more particularly bounded and described as follows:
BEGINNING at an iron pipe set in the westerly bounds of West Mountain Road at the
southeasterly corner of premises now or formerly owned by Kenneth E. and Elsie Raynor
and running thence on a course south 36 degrees 29' 10"west along the westerly boundary
of West Mountain Road a distance of 232.16 feet to an iron pipe marking the northeasterly
corner of premises conveyed by Richard A.and Linda Fecteau to Joseph Santa Lucia by deed
which was recorded in Book 617 of Deeds at page 84;running thence along the northerly
line of said parcel that was conveyed to Joseph Santa Lucia on a course north 61 degrees 22'
west a distance of 53.55 feet to a point;running thence on a course north 53 degrees 27'west
a distance of 112.46 feet to an iron pipe;running thence on a course north 09 degrees 02'30"
east a distance of 80.96 feet to an iron pipe;running thence on a course north 10 degrees 32'
40"east a distance of 114.97 feet to a point;running thence on a course north 08 degrees 36'
30"west a distance of 25.05 feet to an iron pipe;running thence on a course south 63 degrees
14'30"east a distance of 274.81 feet to the point or place of beginning.
BEING the same premises conveyed by Warranty Deed from Richard A.Fecteau and Linda
Fecteau,his wife,to Garry L. Hamlin and Barbara J. Hamlin,his wife, as tenants by the
entirety,dated April 17,1986 and recorded in the Warren County Clerk's Office on April 24,
1986 in Book 680 of Deeds at page 750.
TOGETHER with the appurtenances and all the estate and rights of the parties of the first
part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the parties of the second part,
their heirs and assigns forever,
And said parties of the first part covenants as follows:
FIRST,that the parties of the second part shall quietly enjoy the said premises;
SECOND, that the said parties of the first part will forever WARRANT the title to said
premises.

THIRD,That,in Compliance with Sec. 13 of the Lien Law, the grantor will receive the
consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
IN WITNESS WHEREOF,the parties of the first part have hereunto set their hands and
