STAFF COMMENTS:
The applicant's project to grade approximately 3 acres of property and to install a culvert for existing drainage
on the site was approved in July 2011 with the condition the applicant obtain engineering sign-off. The
applicant described at the previous meeting the current status of the project and the documentation that was
developed in response to the engineering comments. The applicant has received engineering sign-off as of
10/30/13, letter attached.
SUMMARY
The applicant will proceed with the application process that includes working with the DEC to determine if a
Notice of Intent needs to be completed. No other action by the Planning Board is necessary at this time.

The Chazen Companies (Chazen) received a submission package to supplement previous submissions
and correspondence for the grading of approximately 3.5 acres of land at 207 Fuller Road. Submitted
information includes the following:

• New York State DEC Letter, Endangered and Threatened Species Determination, Dated
September 30, 2013;

Your office has requested that we limit our review to the erosion and sediment control items as it
relates to compliance to local, state or relevant codes and regulations. Based on our review of the
information provided, we have no further technical comments. However, in the applicants response
submission he notes that for the proposed modification to the waterway and steep slopes he will
implement erosion & sediment controls per the blue book. In the case of the waterway we take no
exception, as the 25 year storm produces no flow through the culvert. However in the case of the steep
slopes the town may wish perform inspection visits to ensure the methods are suitable and effective.
It is our opinion that the applicant has sufficiently addressed the concerns of our previous letter dated
July 13, 2011. The Army Corps of Engineers, New York State DEC and Adirondack Park Agency all claim
no jurisdiction over this site. The applicant has provided documentation indicating the area of the
proposed disturbance is not associated with known habitat for endangered species or known
archeologically significant sites.

RESOLUTION APPROVING SITE PLAN 45-2011 KELLY CARTE
A site plan application has been made to the Queensbury Planning Board for the following: Applicant
proposes to grade approximately three (3) acres of cleared land. Further proposal to culvert existing drainage
course and existing spring requested. Clearing/disturbance on greater than one (1) acre requires Planning
Board review and approval.
A public hearing was advertised and held on 8/2/2011; and
This application is supported with all documentation, public comment, and application material in the file of
record;
MOTION TO APPROVE SITE PLAN NO. 45-2011 KELLY CARTE, Introduced by Stephen Traver who moved for its
adoption,seconded by Donald Krebs:
According to the resolution prepared by staff:
1) Pursuant to relevant sections of the Town of Queensbury Zoning Code [Chapter 179-9-080], the Planning
Board has determined that this proposal satisfies the requirements as stated in the Zoning Code; and
2) Type II, no further SEQRA review is necessary; and
3) Final approved plans, in compliance with the Site Plan, must be submitted to the Community Development
Department before any further review by the Zoning Administrator or Building and Codes personnel. The
applicant must meet with Staff after approval and prior to issuance of Building Permit and/or the beginning
of any site work. Subsequent issuance of further permits, including building permits is dependent on
compliance with this and all other conditions of this resolution; and
4) As-built plans to certify that the site plan is developed according to the approved plans to be provided
prior to issuance of the certificate of occupancy; and
5) Waiver requests granted: landscaping & lighting plans;and
6) The limits of clearing will constitute a no-cut buffer zone, orange construction fencing shall be installed
around these areas and field verified by Community Development staff; and
7) Engineering sign-off required prior to signature of Zoning Administrator; and
8) If curb cuts are being added or changed a driveway permit is required. A building permit will not be issued
until the approved driveway permit has been provided to the Planning Office; and
9) The applicant must submit a copy of the following to the Town:
a) The project NOI (Notice of Intent) for coverage under the current NYSDEC SPDES General Permit or for
coverage under an individual SPDES prior to the start of any site work.
b) The project NOT (Notice of Termination) upon completion of the project; and

10) The applicant must maintain on their project site, for review by staff:
a) The approved final plans that have been stamped by the Town Zoning Administrator. These plans must
include the project SWPPP (Storm Water Pollution Prevention Plan) when such a plan was prepared and
approved;and
b) The project NOI and proof of coverage under the current NYSDEC SPDES General Permit, or an
individual SPDES permit issued for the project.
11) This application is approved with the following conditions:
1. That the applicant obtain and submit all of the required documentation to the Town, including the
SWPPP.
2. Obtain an engineering signoff.
