WHEREAS, the Town of Queensbury owns an approximately .25 acre parcel of land located
off of Stonehurst Drive in the Town of Queensbury, which is a portion of the property conveyed to
the Town by Maine Enterprises, Inc. by Deed dated February 27, 1996 and recorded in the Warren
County Clerk's Office on March 14, 1996 in Book 973 of Deeds at Page 68 and which is described
more fully at Schedule A attached hereto (the "Sale Parcel"), and
WHEREAS, since the Sale Parcel was conveyed to the Town to date, it has remained vacant,
unimproved and wooded and has never been opened or used for public purposes; and
WHEREAS, the Town Board wishes to sell the Sale Parcel as authorized by New York State
Town Law §64(2), and
WHEREAS, based upon the opinion of the Town Assessor, the fair market value of the Sale
Parcel is $1,400, and
WHEREAS, the Town Board has received an offer from Greenwood Builders, LLC to
purchase the Sale Parcel for a purchase price of$1,400 (the "Sale Price"),
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board hereby determines that the Sale Parcel is not needed for
Town purposes, and
BE IT FURTHER,
RESOLVED, that the Sale Price constitutes fair, adequate and reasonable consideration for
the Sale Parcel, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes the sale and conveyance of the Sale
Parcel to Greenwood Builders, LLC for the Sale Price in accordance with Town Law Section 64(2),
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute and deliver instruments and documents necessary and take any other actions he deems
necessary or reasonable to effectuate the sale, and
BE IT FURTHER,
RESOLVED, that this Resolution is adopted subject to permissive referendum in accordance
with Town Law Article 7 and shall not take effect until such time as provided therein and the Town
Board authorizes and directs the Town Clerk to post and publish the notice required for Resolutions
subject to permissive referendum and take such other actions as may be required by law.
