Staff Note Packet.12.19.13 AP- Department of Community Q,u¢¢rtsbury: Development •250• Queensbury Planning Board Staff Notes November 27, 2012 (Sketch), November 19, 2013 - Lead Agency Request December 19, 2013 ACKNOWLEDGE LEAD AGENCY STATUS, CONDUCT SEQR APPLICATION: Subdivision 8-2012--SEQR APPLICANT: Cerrone Builders REQUESTED ACTION: Lead Agency request LOCATION: Sweet Road EXISTING ZONING: MDR-Moderate Density Residential SEQRA STATUS: Planning Board requesting Lead Agency request PARCEL HISTORY: SB 5-2010: Sketch review-Cluster subdivision of a 29.45 +/-acre lot into 27 residential lots ranging in size from 0.38 +/-acres to 0.47+/- acres. 4- 27-10 PROJECT DESCRIPTION: Applicant proposes a Conservation Subdivision of a 29.45 acre parcel into 29 residential lots ranging in size from 0.28 to 0.35 acres. STAFF COMMENTS: The applicant proposes a 29 lot Conservation Subdivision. Where 24.22 acres would be broken down so 29 lots occur on 9.077 acres and 17.672 acres is open space, 2.539 acres is roads, and 0.202 acres is a sewer easement. The subdivision is considered a Realty subdivision and as such the project has been designated a Type I for an environmental review. The Planning Board has sought Lead Agency status and should acknowledge Lead Agency to conduct SEQR. The applicant has submitted a long form for review. The applicant is working with the Town Wastewater in regards to updating the map plan and report to meet the requirements of the Town. The applicant has requested a waiver from Road Length. The plans indicate the road length is approximately 1,200 linear feet; where per §A183-27, 1,000 feet is the maximum without relief. The applicant is to provide additional information in regards to HOA language in regards to open space ownership. The applicant proposes that sidewalks would not be part of the project to minimize disturbance but the project would create walking paths within the project area. The project proposal includes lot sizes ranging from 0.282 acres to 0.347 acres with front and rear setbacks as 30 ft. and sides to be 10 ft. Where the current zone is MDR with a 1 acre size requirement and side setback as 25 ft. as outlined in the dimension requirements for the zone. The application has also received comments from the Town Highway Department in regards to location of medians. The Town Designated Engineer has requested additional information from the applicant for review. The Fire Marshal has indicate there are no site issues at this time. SUMMARY The Planning Board may consider conducting SEQR. The project will then go to the Town Board for an extension of the sewer district and back to the Planning Board for preliminary subdivision approval as proposed. The Conservation Subdivision Section X allows the Planning Board to modify the minimum lot area, lot width and setback requirements. The Board may consider the applicant's proposed conservation subdivision for 29 lots and request for modifications to the road length, sidewalk, as well as the lot size width and setbacks. -2- RESOLUTION REQUESTING QUEENSBURY PLANNING BOARD TO SEEK LEAD AGENCY STATUS REGARDING PROPOSED SUBDIVISION AND EXTENSION OF SEWER DISTRICT AND CONSENTING TO PLANNING BOARD SERVING AS LEAD AGENCY RESOLUTION NO. 210, 2013 INTRODUCED BY: Mr. John Strough WHO MOVED ITS ADOPTION SECONDED BY:Mr.Brian Clements WHEREAS, the Queensbury Town Board has been asked to approve an extension of the Route 9 Sanitary Sewer District to serve a planned 29-lot residential subdivision to be developed on property adjacent to Sweet Road,and WHEREAS,prior to taking any further action or making a decision about whether to approve the requested Sewer District extension, it will be necessary for the extension and the proposed subdivision it will serve to be reviewed together as one project (the Combined Project) in a Coordinated Review under the New York State Environmental Quality Review Act (SEQRA), for potential environmental effects,and WHEREAS, the Town of Queensbury's Planning Board will be undertaking a detailed review of the planned subdivision for purposes of deciding whether to approve the subdivision, and WHEREAS, it appears that there would be significantly greater development activities associated with the residential subdivision than with the extension of the Sewer District,and WHEREAS, the Planning Board has the necessary knowledge and experience to review and evaluate the potential environmental effects of the Combined Project, NOW, THEREFORE,BE IT RESOLVED, that the Queensbury Town Board hereby requests that the Queensbury Planning Board seek Lead Agency status for purposes of conducting the Coordinated Review of the Combined Project as required under the New York State Environmental Quality Review Act(SEQRA),and BE IT FURTHER RESOLVED, that in the event the Queensbury Planning Board seeks to be Lead Agency for SEQRA Coordinated Review of the Combined Project, the Queensbury Town Board hereby consents to the Planning Board serving in that capacity,and BE IT FURTHER RESOLVED, that the Town Board hereby directs the Applicant to provide any and all information about the proposed subdivision and sewer district extension, whether or not the information was previously supplied to the Town Board, to make the necessary copies of all such information and provide it to the Planning Board for its use in evaluating the potential environmental effects of the Combined Project,and BE IT FURTHER RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town Supervisor to execute any documents and take any other necessary actions to effectuate the terms of this Resolution and further authorizes and directs the Town's Department of Community Development to notify, if and when appropriate, any other Involved Agencies of the Town Board's consent to the Planning Board serving as Lead Agency for SEQRA Coordinated Review of the Combined Project. I'm not sure if the numbers of bedrooms are necessarily that specific, but if so, maybe you could just come up with a max flow/gallon number and you could configure the houses any way you want as long as you don't go over that flow total.
