Dear Mr. Hendley:
By letter dated December 4, 1975, you supplied the
following information in regard to the above-captioned
matter:
1) Your clients have subdivided an approximately
seven acre parcel of land into fifteen lots ;
2) The parcel of land is located off Route 9L in
Dark Bay, Town of Queensbury, Warren County,
New York;
3) Some of the lots in the subdivision abut Lake
George;
4) A copy of the subdivision map was filed in
the Warren County Clerk's Office on September 26 ,
1969 ;
5) The subdivision was approved by the Department
of Health on July 11, 1969 ;
6) At least six lots from the subdivision were sold
prior to June 1, 1973 ( lots 1, 2, 3, 7, 9 and 10) ;
7) All sales have followed the description of the
lots shown on the map;
8) All roads shown on the map have been developed;
9) You have personal knowledge that houses have been
constructed on lots 1, 2, 3 and 7 prior to
June 1, 1973;

10) The Town of Queensbury Planning Board approved
the subdivision on August 6 , 1969 ;
11) The land as located in your letter is situated
in a Rural Use area on the Official Adirondack
Park Land Use and Development Plan Map .
Based on the information supplied by you and recited
herein, I can state that the aforementioned activities
constitute a preexisting subdivision of land as defined
under Adirondack Park Agency Act §802 ( 49) . Consequently ,
lots in this subdivision may be sold along the lines of
the subdivision map without Adirondack Park Agency permits .
Additionally, a single family dwelling may be built on
each vacant lot without being subject to Adirondack Park
Agency review.
I should point out , however, that any new construction on
lots with shoreline must comply with the lot width and
setback requirements of Adirondack Park Agency Act §806 .
This determination is based on facts supplied by you and
recited herein. Should the actual facts be different from
those recited, my determination could vary accordingly.
Please be advised that this determination does not excuse
