1978-08-29 SP Noes : Absent: Mr. Robertson i' i SPECIAL TOWN BOARD MEETING AUGUST 29, 1978 MEMBERS PRESENT: Michel Brandt-Supervisor Daniel Olson-Councilman Dr. Charles Eisenhart-Councilman Mrs. Frances Walter-Councilman Hammond Robertson-Councilman Joseph Brennan-Town Counsel PRESS: Glens Falls Post Star WWSC TOWN OFFICIALS- Mr. Townley, Mrs . Shenk, Mr. Hansen, Mrs . Joslyn Representatives of the CSEA GUESTS- Residents of Meadowbrook Road Meeting Opened 6 : 37P,M. Salute to the Flag led by Supervisor Brandt. Councilman Hammond Robertson- wished to have it noted that he has to leave the meeting at 7:20 P.M. due to a previous engagement. . . Supervisor Brandt- A great deal of work has been put into arrive at a contract, Councilman Robertson has spent months in negotiations with the CSEA because of his schedule Councilman Olson has stepped%.and helped out. Noted that the final signing will take place as soon as the CSEA representative has had a chance to read the final form of the contract. Councilman Eisenhart- I will not vote in favor of any contract that includes agency shop. I feel that it is unethical, inequitable and undesirable part of any labor negotiations , I will vote no on any contract that includes agency shop. Councilman Walter- I agree with Dr. Eisenhart, A great deal of work has gone into coming to some kind of an agreement. . .my negative vote will not reflect my attitude toward the increase of wages or benefits for any of our employees I am sure they are deserving of it. I believe a man should have a right to join a union or not,nobody should be forced to ray to work for his own government. Supervisor Brandt-So that there is proper information it is my understanding under New York State Law CSEA by law must defend and protect and handle grievance procedure for any town personnel , member of not. Because of that situation I think that is why we are being asked to address agency shop. They are asking for their fees whetzhersa person ,joins or not, and then they will be reimbursed that way for the legal defense of anybody that has a grievance that they handle. Councilman Olson- People that have the union dues deducted do not have to join the union. . .There are certain Department Heads, who are management or confidential positions that have been removed from the union. . . I support `-� Agency Shop. . .I feel that people that are not in the union are gaining and receiving the same benefits ae the Union people are. . . . do not feel that it will hs a hardship on those that have the dues deducted from their pay. The contract will run from January 1, 1978 through December 31, 1980. Councilman Robertson- will meal allowance be retroactive? Town Counsel Brennan- no f Councilman Olson- the deductions of union dues will not be retroactive. . . RESOLUTION AUTHORIZING THE ACCEPTANCE AND SIGNING OF THE PROPOSED AGREEMENT BETWEEN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, AND THE TOWN OF QUEENSBURY UNIT CIVIL SERVICE EMPLOYEES ASSOCIATION INC. RESOLUTION Introduced by Councilman Hammond Robertson who moved for its a optinn, seconded by Mr. Daniel Olson: 110 WHEREAS , the proposed agreement between the Town of Queensbury, Warren County, New York, and the Town of Queensbury Unit Civil Service Employees Association, Inc. , has been submitted for consideration by representatives of the respective parties a copy of which is attached hereto, vtth certain amendments thereto, and WHEREAS, the submitted proposed agreement embodies all aspects of the agreement readied by negotiations and WHEREAS, Joseph R. Brennan, Town Counsel for the Town of Oueensbury has informed the Town Board of the Town of Queensbury that he has reviewed and approved the agreement in its attached form, NOW, THEREFORE BE IT RESOLVED, that the proposed agreement annexed hereto as amended be and the ' j same approved by the Town of Queensbury and Mr. Michel R. Brandt , Superviso' ! of the Town of Queensbury is hereby authorized to execute said agreement on behalf of the Town of Queensbury and Joseph R. Brennan as Town Counsel is hereby authorized to execute said agreement in that capacity, and that said agreement will run from January 1, 1978 through December 31, 1980. Walter Absent: None Discussion held on proposed resolution to enter into agreement with Torring- ton Construction Co. . . _. Councilman Brennan-the agreement will allow Torringtons trucks to be weighted on the scales plus Torringtons customers that will be coming into I the landfill. . . Supervisor Brandt-that is what was agreed to. . . RESOLUTION TO ENTER INTO AGREEMENT WITH TORRINGTON CONSTRUCTION COMPANY, INC. RE LANDFILL PROPERTY Z49, 237, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr. Hammond Robertson: WHEREAS, by deed dated September 7, 1972 Torrington Construction Company, Inc. conveyed certain premises to the Town of Queensbury under the terms of which deed Torrington excepted and reserved to itself the use and occupancy of certain protions of the premises conveyed for certain periods specified in said deed, and WHEREAS, Torrington further retained all stone , sand, gravel , mineral ane water rights to said portions of the premises during the specified periods , and WHEREAS , said premises are situate at the existing sanitary landfill presently being operated by the Town of Oueensbury and the City of Glens Falls on Ridge Road, and WHEREAS , it is essential for the successful operation of said joint landfill facility that provision be made for the expansion thereof 'onto the lands conveyed by Torrington by said deed, and WHEREAS, Torrington is desirous of extanding the period within which Torrington will retain the rights which it reserved unto itself under the provisions of the deed to a date ten years in the future, and -- WHEREAS , it would be beneficial to the operation of the joint landfill to allow Torrington to continue mining and excavation activities upon the lands conveyed by Torrington in order that the useful life of said landfill facility might be expanded and WHEREAS, Torrington has further offered to process sand and materials for use by the Town of Queensbury in sanding Town highways during the winter months , and WHEREAS, Torrington is willing to make available to the Town for use in the operation of the joint landfill truck weighing scales owned by Torrington and k 's WHEREAS , negotiations and discussions have beep held by th Su ervi or wiht Torrington Construction Com parry, Inc. for tie purpose of at?emptfng, to arrive at an acceptable agreement , and I WHEREAS, a proposed agreement between the Town of Queensbury and Torrington Construction Company, Inc. has been prepared for consideration by the Town Board for approval, a copy of which proposed agreement is attached hereto, j and TMEREAS, under the terms of said agreement, the Town of Queensbury would receive fair and adequate consideration in exchange for the benefits therein described to be conferred upon Torrington Construction Company, Inc. , and ' WHEREAS, it appears that the Town of Queensbury would receive benefits thereunder which would eliminate the necessity for certain financial expenditures to be made in operating the landfill , NOW, THEREFORE BE IT RESOLVED, that the Town of Queensbury enter into the proposed agreement with Torrington Construction Company, Inc. in the form as attached hereto, and be it further RESOLVED, that the Supervisor be and he hereby is authorized to execute said agreement on behalf of the Town of Queensbury.
