The purpose of my inspection was to verify compliance with the State Pollutant Discharge Elimination System (SPDES) General Permit (No. GP-02-01) for Storm Water Discharges from Construction Activity ("the general permit"). The overall rating for the project at the time of the inspection was marginal. A copy of the inspection report is enclosed for your information. In addition to the report, I would like to elaborate on the following: • A complete copy of the signed Storm Water Pollution Prevention Plan (SWPPP) was not being retained at the construction site as required by Parts 111.B.1 and IV.0 of the general permit. Your failure to retain a complete copy of the SWPPP at the construction site is a violation of Parts II1.B.1 and IV.0 of the general permit. • A copy of the general permit was not retained at the construction site as required by Section 750-2.1 (a) of Title 6 of the Official Compilation of the Codes, Rules and Regulations of the State of New York (6 NYCRR). Your failure to retain a copy of the general permit at the site is a violation of 6 NYCRR 750-2.1(a). • Your SWPPP did not describe the erosion and sediment control measures to be employed at the site as specified in Part III.D.2.a(7) of the general permit. At the time of my inspection, the inspection reports were not signed. Your failure to sign the required reports is a violation of Part V.H.2 of the general permit. Please be advised that Part V.A of the general permit gives the Department the authority to order an immediate stop to all construction activity at the site upon the finding of significant noncompliance. In addition to the possibility of a stop work order, permit noncompliance also constitutes a violation of the Environmental Conservation Law (ECL). The civil liability for violations of Article 17 of the ECL are described in ECL 71-1929. Any person who violates any provision of Title 7 of Article 17 shall be liable to a penalty of not to exceed thirty-seven thousand five hundred dollars ($37,500) per day for each violation. Please correct the above noted violations immediately. An unannounced follow-up inspection may be conducted in the future to verify that these deficiencies have been addressed. To reiterate several items we discussed: • Your plan did not indicate how you will hot hold pizza and calzones. • Your plan did not indicate a steam table for hot holding. (According to you, you intend to hot hold soups.) • Your plan did not indicate a separate food preparation sink, which, with your menu, you should provide. • Your plan did not adequately address how the dishwasher will sanitize. At least one urinal still needs to be lowered to a height of 17 inches above finished floor. It appears there is a service counter for the food concession area, and therefore that must be provided with a handicap service counter at 34 inches as well. We still need details on the hood system and suppression system to be installed in the kitchen area. There is no indication on the fire alarm plan as to whether it will be monitored off site as required by the Code or not. The fire connection for the sprinkler system must be a five inch storz connection. Please change the detail on the plans accordingly. There is no note on the drawings that shows that the identification for truss construction will be installed on the exit doors to this support building.
