SCHODER, PE - SCHODER RIVERS ASSOCIATES PRESENT CARL SCHODER-My name is Carl Schoder, I am with Schoder Rivers Associates, I am representing the applicant, the O'Learys in this matter. Basically we are here for you to request several variances in order to build a replacement, a septic system on an existing site. If I may, I would like to give you a bit of project background and why we are all sitting here. Recently the O'Learys purchased this property which is a small lot, approximately a third of an acre in size. Basically half of the property has an existing plus or minus, a thousand square foot, footprint REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 898 cabin. It has an existing non-conforming septic system which basically has a seepage pit of sorts down low and what is or was a leach field at the higher end of the site where we're proposing to actually work. The house as it stands is an existing non-conforming structure, with respect to zoning; it's too close to the setbacks, lake wise, sideline setbacks, etcetera. What the owner wishes to do as an overall project, again, if I can give you the big picture background, is to improve this property by improving the house. Basically, currently the first floor of the house was deteriorated, close to rock;joists were rotting out, that sort of thing. So they want to do some work inside the house. They also want to improve the septic system to bring it to a system that will function well from now for quite a while. They are not intending to work outside of the footprint of this existing property or existing building. One thing that will be needed in doing this project and actually interestingly it has to do with septic system, proximity of the bedrock, is that they anticipate raising the house approximately three feet (3'). The reason for that is to be able to allow for enough grade outside to bury a septic tank and a pump tank without pumping into bedrock. The neighbors are quite close; the concept of removing rock by blast is not something very desirable. Needless to say with a third of an acre on a quite site limited, as far as area to be able to work, we've tried to design a system into this that will accommodate their needs and work with the site as best as possible and maintain setbacks from the lake to the extent that we could. The new system will be a three (3), it will be for a, I forgot if I mention it but the existing house is a three (3) bedroom, the new system will be also for a three (3)bedroom. They are not anticipating increasing design flows to this whatsoever. When we first started this project, the first step of course in any septic system design is try and figure, figure out where you have soil. I had initially headed to a concept where we would possibly be able to get way back to the backside of this property, it was the first thing that I would have liked to have done. SUPERVISOR STROUGH-Right, so now you're reading my mind. MR. SCHODER-Well that was the first hole that was dug for that matter, directly in front of the ... and when the backhoe teeth go in and hit bedrock at about eight inches (8"), seven inches (7) or so, you realize you're in trouble. Then you look down that way and find that there's wetland flagging all over the place that would be well within that back area. Well, didn't need the wetland flagging, won't have any soil to work with so I kind of abandoned that idea and decided that we would look elsewhere. I did want to maintain a hundred foot (100') separation to the lake, if at all possible. So, we dug two (2) additional test pits. I got to follow the mic with me, I dug two (2) additional test pits then to try and see if there were some usable soil in these areas which is back behind what is currently, I don't know if you folks had the opportunity to be at the site? SUPERVISOR STROUGH-Yes, I was. MR. SCHODER-Okay, there's currently in this area a stone and timber retaining wall, the timber wall is kind of leaning over and that kind of thing, back behind that where the grade is up high, okay, I dug a hole at this location. I dug a hole at that location. (referred to drawing/diagram) Interestingly, there's bedrock that creeps out right along this boundary which is shown on the drawing. I was pleased to find that at test pit one (1), I had basically forty-four inches (44") of soil to bedrock which was a good deal. I also hit a remnant of an old septic system in there which I think was part of what that original thing that was installed down here and trying to pump up the hill was for. When I hit test pit two (2), it was still reasonable but not highly favorably. At test pit number two (2)we had bedrock about three feet (3'). Now as you would know we're within, what is it, a thousand feet (1,000') of the lake; therefore we need three feet (3') of separation to bedrock from the bottom of the system. So, I knew we had some problems but it was a heck of a lot better than the eight inches (8") we found on the other side of the driveway so we pursued this. In pursuing it and also because the site is so space limited, we first started looking at options like either an Eljen or a Presby, recognizing there was no way for a three (3)bedroom, that were going to be able to get an conventional system in. By the way, we REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 899 did perk it and the perk rates reasonable, again about four (4) minutes per inch stabilized perk rate at test pit number two (2) and number one (1)was six (6) minutes per inch. So, reasonable soil but none the less, footprint wise, we simply do not have the area. So we looked at either a Presby or an Eljen and decided on a Presby. Is everyone familiar with what Presby systems are? SUPERVISOR STROUGH-I am now. MR. SCHODER-Okay, you looked that up. COUNCILMAN VANNESS-I am not. MR. SCHODER-Alright, let me backtrack for a second. Matter of fact, we have got a, kind of a handy working drawing for it. The Presby system is termed, under the Department of Health as a, let me get this right, media-wrapped corrugated pipe sand lined treatment system. What that mouthful means is twelve inch (12") diameter pipes, I am going to show you a cross section in a second (referred to drawing/diagram), what that means to us, this is a cross section of the system. These twelve inch (12") diameter pipes are installed at a certain spacing, one foot eight (1'8) is the spacing and at that configuration in a matrix of sand. Now the sand that's used is a very specific sand, that if you can think of mason sand for building, that's affectively what it is. The important thing about a Presby is, is it uses an aeration method that lets this, let's air come in contact with the waste as it's trying to be treated in the leach field. And the way that's done, and let me flip you back again, a vent will be installed and the vent has a high vent which is about thirteen feet (13') off the ground and a low vent which is about three feet (3') off the ground. The reason for the two (2) vents and the difference in heights is a chimney affect. Air comes in the bottom, goes out the top just as a conventional chimney. What happens is, at the end of the system, you dump in, basically like, you can almost think of conventional systems, come into each one of these pipes, at least in the configuration we've chosen, the other end of the pipes is tied together by a header and that header is a vent header which goes over and again, goes to the low intake. There's also a vent supplied at the distribution box end of this system which goes to the high vent, hence the chimney, hence airflow is constantly going through. If you ask me what time it is, I'll tell you how they made the watch. Did I cover a Presby far enough? Engineers, sorry. SUPERVISOR STROUGH-Yes, and you also have to be a certified person to be able to install this and you say in your notes that will be the case. MR. SCHODER-The Town of Queensbury actually has some Presbys in it, I have designed a couple but yes that will be the case, it has to be the case. When this system is built, the owners hired us to design but we don't, we just design. We will be out inspecting this and at the end of this, this will be designed and built in accordance with what we want. For that matter, the notes on the drawings specifically require that any builder that puts in a Presby is certified by Presby to do this. If not, you void the warranty of the system; it would be self-defeating to do that anyway. But I guess what I am trying to tell you is that there's two (2) sets of assurances here. First off, you've got a certified installer, second off, you will have the design engineer doing the review as the system is constructed. Alright to build this, we have and again, we wouldn't be here if we didn't need variances. There are three (3) variances affectively that we are requiring or requesting in order to do this. We started with, probably easier one first and that is down near the building. If you see down near the building on your drawing, there's a heavy line drawn between the septic tank and pump tank and the building itself. Because of distance to the property line on the side, I can't get, I have no other location to put these tanks then where they are. Because of the height of bedrock, again, I am going to need to fill up over the tanks which was the reason to put, to raise the house up. To mitigate any sort of potential effect of say a leak in a tank, I am not too worried about the pump pit but septic tanks can leak, what we are proposing is putting a permeable barrier in there between the house and the septic tank and that REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 900 would be a piece of Hypalon roofing which we've used very successfully in the past, extended down to bedrock, extended past the tanks a certain distance, and you have a membrane that will keep the waste from heading toward the building. That's one (1). Two (2), what I am trying not to do here is build a big mound, I have very little yard for these folks. So in building what we have to build here, I can maintain a separation to bedrock by test pit two (2) of in excess of three feet (3') which is again from the bottom of the sand bed. But where test pit number two (2) is, which is on the backside of this, the driveway side of it, if you will, what we're requesting is a variance from three foot (3'), from approximately two foot six (2'6) to three foot (3'). Now, remember the type of waste that you have going into the ground here is a fairly polished waste, it's got an aerated type of a system above it, fairly hi-tech. I would submit that certainly we were complying with the Department of Health standards, there's something over and above the DOH standards which I recognize which is a three foot (3') requirement. But none the less, I think that the use of this type of a specialized system would service some mitigation to that six inches (6") that we're asking for. COUNCILMAN VANNESS-That's actually number three (3), correct? MR. SCHODER-That's, I think probably in the order of sequence, yea. Sorry about that, I am flying off the top of my head here. COUNCILMAN VANNESS-No problem. SUPERVISOR STROUGH-Did you consider bringing in extra fill? MR. SCHODER-That is what we will do. SUPERVISOR STROUGH-So that you don't even need the six inch (6") variance. MR. SCHODER-I probably could but I've got to push everything up another six inches (6") and it's only in that one corner and I'm going after a variance anyway and it really isn't going to, like eighty percent (80%), ninety percent (90%) of this field is going to be three feet (3') plus so it seemed to me to try and keep the grade down because I am trying not to have them have a big hump up from their driveway and then back down into the retaining walls. I am trying to make that a little bit of a usable area, at least for a lawn, that's the rationale there. SUPERVISOR STROUGH-Okay, well while we are on that mound which isn't that high above the surface and it's currently the area that seems to be used for parking. MR. SCHODER-No, not in the area that we are looking. SUPERVISOR STROUGH-Well that's where everyone was parking when I was there. Now, how are we going to prevent that? That's my question. MR. SCHODER-I can put stones there, I can put a fence, I can put anything we want because the last thing that I want is somebody in that field. SUPERVISOR STROUGH-Okay, that's right. MR. SCHODER-That's a given. Actually, you will have in the finished product an upslope of about a foot, okay, that will come up to the top of this. We can certainly put something in there, again, landscaping stones, plantings because we're well away from the field. You don't want to put plantings on these fields but you could put some shrubs out and prevent exactly that, that's a good suggestion actually. Third variance, third variance is sideline setback and again, this comes into the issue of having a very narrow site. As this drawing is proposed right now, we had said REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 901 zero setback because basically the sand filter portion of it sits right on the ten foot (10') setback line, you can see on our drawing. Now, to get to that point and because we have to bring in fill to raise this, there will be a down slope that will go to where a retaining wall tails back out to natural grade. We had set that retaining wall approximately a foot back from the property line but suffice it to say, by the time you get through everything it seemed to me that it was reasonable to say that that is a zero setback. Earlier today, we met, I met with the neighbor or the son of the neighbor, Joe Roulier and we discussed this and he has some concerns relative to making sure that drainage stays on this property. What we had come to a consensus on and I think that Joe will be speaking in a little while about this but what we had come to a consensus on is that we would propose to move that wall and the leach field, everything except for the steps that are shown going out here, towards the steps another two feet (2') so that we have a total of three feet (3') from the property line to the toe of wall. And what I will do because currently grade goes up towards his property anyway, I will just continue that slope down so that any water that goes around this wall, would flow in that area. Now as far as additional water is concerned, I took a look at original grading and where the break in grade was and I took a look at where the break in grade would be with this plan, the difference is approximately three hundred and fifty square feet (350') of additional grassed area. From an additional water point of view, you're talking about extremely small amount of runoff. However, that said, there is existing runoff and in pulling that wall back to three feet (3') off the property line, it allows me to make a ditch. The second thing that we had discussed... SUPERVISOR STROUGH-Does the plans show that? MR. SCHODER-It does not and I would offer that I'd like to update those plans and if you folks can see your way clear to making that a condition on approval or whatever we need to do, that's up to you but what I would show would be that, I would take that wall and literally slide it three feet (3') down the drawing to the south to get us our separation. Second point is that, Joe had brought up that I think is a good point, currently drainage from this area, as I say, well, currently drainage from this area goes out along the Swale, following my finger, cuts in around that phone pole, cuts down the grade here and eventually meanders over onto the neighboring property. He has concerns about that. We can address those concerns quite easily. If we create along the property line, in some areas a bit of a berm,just enough to keep the water back over onto our property and in other areas possibly swale that out a little bit instead of a berm, we can direct that water which is currently going off to Lake George here, here fifteen (15), twenty feet (20') away. But keep it off of the neighbor's property. It's a very easy thing to do, it requires very little work. A grass swale will do the job quite nicely and that's what we would propose adding to address Mr. Roulier's concerns, and I butcher the name again I am sorry. In a nutshell, that's why we're here. SUPERVISOR STROUGH-Okay, thank you. Does the board have any questions? COUNCILMAN VANNESS-There's a lot of corrections obviously that are going to be, I mean, from what we have sitting in front of us and what we've had for a week now, a week and a half we've looked at the map, and again, I apologize that I didn't get out there to see it but I would like to go out and if possible meet someone out there, a representative of it to have them show me what they're going to do. I know the last time we talked about one like this, we actually went out and looked at it and we talked in the next workshop and basically went through it the next workshop. But I would feel more comfortable going out and personally taking a look at this, having someone explain to me what they're doing out there and what the corrections are going to be that you're going to make if that's possible. SUPERVISOR STROUGH-Well we will see what the will of the board is Bill. COUNCILMAN VANNESS-Okay. REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 902 SUPERVISOR STROUGH-I certainly have heard you and let's see what the public has to say and see how the board feels. COUNCILMAN VANNESS-Okay. SUPERVISOR STROUGH-Anything else, any other questions on behalf of the board at this time? Thank you Mr. Schoder. MR. SCHODER-My pleasure. SUPERVISOR STROUGH-If you want to have a seat in the audience please, I will ask if members of the audience would like to come forward and speak to this application for a variance, a septic variance. Joe? MR. JOE ROULIER-My name is Joe Roulier, I am here representing myself because I am a neighbor up there but more importantly my father who is the adjoining neighbor to the proposed septic system. When I, I am going to address the sideline requirement from ten (10)to zero (0) but after my meeting today with Mr. Schoder, we agreed that the toe of the mound would be a three feet (3') and after we had discussed the swale that could be incorporated into that area and the proposed drainage from that area, I feel very comfortable that the system can be adequately installed in that particular area. My biggest concern was that it did represent a significant relief from the requirement from ten feet (10') down to zero (0)but and I know that the original proposal as it stood in a normal rainfall, would never be a significant problem in that area. But as I pointed out to him, that in the last three (3) years we've had some significant downpours as a result of the hurricanes up the coast and my biggest fear was that because of this mound system in that area, that there would be a substantial amount of water, not only put onto my father's property but ultimately going up against the foundation of his home. So, after our meeting today, I feel that the three feet (3'), I know it's still a substantial amount of relief from the variance or the ordinance, okay, but it does give us some room that if, in addition to the Swale, we needed to address possibly some other type of berming or other improvement that may, that could be unforeseen at this particular point, it gives us some room to work with down the road. As I stand right now, I am very, very comfortable with the proposal. I think it's an outstanding system that will be installed in that area compared to what essentially was a nonexistence septic system for a multiple of years. I think it will be beneficial to my neighbor who is making significant improvements to the property over the long run. I don't think it's going to have any detrimental effect on my father's property or if somebody purchases my father's property down the road and for these reasons, I think that the board should give it serious consideration and ultimate approval for this variance. With that being said, I would only ask of Mr. Strough since he is the only one up there, would it be possible that I could hear your comments while we can still have a public opportunity to comment on them. SUPERVISOR STROUGH-You mean my comments on this? MR. ROULIER-Yes. SUPERVISOR STROUGH-Most of them, he answered. The residing concerns that I had I was asking while he was deliberating. You know, first of all, my first question was, why can't he move it over next to the shed, further away from the lake, further away from the neighbors, everything else. He responded that, and I suspected that because I see the big rock out croppings there that he only had about eight inches (8") to the rock out cropping there. Okay so then we're back at the current location which does seem to be an area used for parking but after I expressed that concern, he also said that he wouldn't, you know prevent parking with some kind of landscaping there and the parking would be over towards the shed from now on. And my other REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 903 questions, I have my whole list here and he did, you know, I asked him, while wouldn't he add another six inches (6")to the sand bed and just not require that variance and he responded that, that six inch (6") variance is only for one small corner of the system and the system is a very efficient system and I did look it up. It's highly regarded as a very efficient workable system. You know, Maine, Massachusetts, New Hampshire, they like this system and the more I read about it, the more I liked it too. MR. ROULIER-So, you're comfortable with it? SUPERVISOR STROUGH-Yes, I am very comfortable with it. I was going to ask the number of bedrooms after they rebuilt it; he answered that by saying the same as it is now, three (3) bedrooms. I also wanted to know why the setback from the property line and the slope, you know, could we have done better there but he answered that and also added that at least one (1), maybe two (2) swales would be added to these plans, wanting to abate your concerns about running water, not going on your property or your father's property, as the case might be. MR. ROULIER-Right. SUPERVISOR STROUGH-After reviewing it, those were my questions I had written down. And I did go out and do a site visit and so I see this as probably the best that one could do given the situation up there and I was very gratified to see that the AES Presby system, the aerated system is a good one and he decided to go with that rather than conventional system which made me feel better. MR. ROULIER-Well I will tell you, we kicked around a couple of different scenarios while he was up there today, possibly moving the laterals, extending them but after we got done with the conversation and we talked about the swales that we could incorporate into that area and the, really the state of the art technology of this particular system, I as my father's representative and as a neighbor, I feel totally confident that it will be more than satisfactorily for the area and for the lake. So, I don't think this board should, at this point, have any issues or any questions and quite honestly I think it should go,just approve it, okay. SUPERVISOR STROUGH-Okay, thank you Joe. MR. ROULIER-Thank you very much gentlemen. MR. HAROLD GORDON-Good evening, my name is Harold Gordon, my wife Donna and I are the neighbors immediately adjacent on the south and there's really very little more I'd like to add then Mr. Roulier had to say to you. We had a bad situation beforehand with the septic system that exists and not only is that going to be addressed by this and not only is the one issue that Mr. Roulier raised on his side going to be addressed as far as the drainage is concerned but this system appears to be truly state of the art and topnotch. So, we hope again, as he said, that the board will act as quickly as possible because the sooner it gets addressed, the better and I want to complement our new neighbors on really putting in a very fine system and being very considerate of their neighbors. SUPERVISOR STROUGH-Thank you Mr. Gordon. MR. GORDON-Thank you. SUPERVISOR STROUGH-Any other member of the public wish to speak to this application? Seeing none, let's go back to Town Board discussions. Now, here we are, we're with a plan that's pretty satisfactory however, it just needs three (3) conditions, adding two (2) swales along REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 904 the retaining walls and some type of landscaping to prevent parking. Now, after your due consideration, do you still feel that we can accomplish something tonight? COUNCILMAN VANNESS-Yea, after listening to the neighbors, I mean on both sides, the neighbors coming up here and being satisfied, that was one of main concerns other than the, you know, somehow making it to the lake. I think they have been addressed and as long as were guaranteed that these issues are going to be addressed and they will be included in the map when it's handed in. SUPERVISOR STROUGH-So what we'll ask is, then Mr. Schoder to volunteer description, Town Counsel, if you will, try and amend the resolution appropriately as we proceed here in a minute and then see how you feel. MR. SCHODER-Quick comment. SUPERVISOR STROUGH-Yes. MR. SCHODER-This project is going to go in front of the Planning Board and the ZBA for the area variance. We will be rolling out obviously the updated map with the modifications as proposed here so if you're looking for a back-check on exactly what had happened, or what we are proposing as a final if you will, that's what will be in front of the Planning Board in accordance with what your minutes will note as a conditional approval. SUPERVISOR STROUGH-Okay. There's three things that I think need addressing by you. One is, as Joe's concern, Joe Roulier's concern is the swale along the retaining wall. Can you give us an engineer's description using fairly precise terms of exactly what you are proposing? MR. SCHODER-Along the retaining wall will be a swale that will direct drainage... SUPERVISOR STROUGH-Now is that the retaining wall on the east side? MR. SCHODER-I'm sorry, I will be very specific. The retaining wall at question on the north boundary, at the north property line which will be relocated from the one foot (1') setback right now to the three foot (3') setback, will have along its face on the wall running east to west, will have a slope that will come down toward the face and then probably the last foot, come back up to the wall such that the swale is created, low point of the swale being approximately six inches (6") from the wall. I'm sorry, twelve inches (12") from the wall. I will continue the existing slope from the neighbor's property down to that point and then back up to the wall. Now that pitch is downhill currently, I am going to follow obviously the property line grade. I am not proposing grading across the property, pick up that grade and bring it in. SUPERVISOR STROUGH-Now how far above grade after you create this swale will be the retaining wall? Six inches (6")? MR. SCHODER-It will vary. The retaining wall will vary to nominally about four inches (4") at the shallow end which is the west end of the wall to a height of approximately three feet (3') as it wraps around the corner by that phone pole, then will get substantially higher in the north south direction but the swale will only be on the east west area. SUPERVISOR STROUGH-Yea, so the swale is going to... now the retaining wall curves? MR. SCHODER-Right sir. REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 905 SUPERVISOR STROUGH-And it curves like this and your swale is going to follow that curve and empty out on the south side? MR. SCHODER-I will show you on a map. SUPERVISOR STROUGH-Okay, you can show me on that map so counsel can see as well. Can you see okay Mark? TOWN COUNSEL SCHACHNER-Yea but I am not the important one, you guys are. MR. SCHODER-Alright, this is the end approximately of the existing wall and remember the wall will move over two feet (2'). COUNCILMAN CLEMENTS-The wall will move over two feet (2')? MR. SCHODER-Two feet (2'), a total of three (3). It's currently a foot away from the property line, it will be a total of three (3) altogether. COUNCILMAN CLEMENTS-Okay. SUPERVISOR STROUGH-Okay so you're going to move the retaining wall three feet (3') from the north property line to the face of the retaining wall? MR. SCHODER-Correct sir. SUPERVISOR STROUGH-Okay. MR. SCHODER-The swale will continue down then along the face of that wall, the wall height will vary from about four inches (4") to, it drops off very quickly around this curve, so it's kind of hard to really say that okay but it will, at the point before it starts to drop, about two and a half, three feet (2'/2' -3') high then grade starts to drop off. What I would likely and the swale will follow, again along the face of that wall, where the swale starts, where the wall starts to drop, I will probably riprap that area to prevent any erosion, with probably a round riprap type of an affair and allow the wall or allow the drainage to continue as shown up past the lower wall, recognizing that there is a grade that's dropping from the neighbors in that location. SUPERVISOR STROUGH-Okay. MR. SCHODER-I'll continue that down now such that a berm or a shallow Swale, I haven't designed it yet but berm or shallow swale will be created approximately along the property line all the way down to where we pass the end of the existing house and down to where we come to a point near the lake right where the grade starts to drop off to the lake to intercept any water and to collect and discharge any water instead of allowing it to flow onto the northern property line. SUPERVISOR STROUGH-Alright, well, because we want to be specific about these plans, let's call that a berm. MR. SCHODER-Okay, we're talking about something that's a distance of probably nine feet (9'). SUPERVISOR STROUGH-Now... MR. SCHODER-If I had a one foot (1') high berm with a one (1) on two (2) side slope, that's two (2), four(4), that's five feet (5'), six feet (6') roughly, you'll have nine feet (9')that I am chewing up. SUPERVISOR STROUGH-Can you add some more riprap before it goes into the lake? MR. SCHODER-I most certainly can. SUPERVISOR STROUGH-Alright so then we'll call it, it's more likely to be a swale then? MR. SCHODER-At that location, it's more likely to be a Swale, that's correct. And again, I am assuming Planning Board will look at that pretty closely. SUPERVISOR STROUGH-So let me review what I understand, okay. MR. SCHODER-Yes sir. SUPERVISOR STROUGH-That the retaining walls location running parallel and alongside the northern boundary line of Mr. O'Leary's property, will be moved an additional two feet (2') so that it will be a total of three feet (3') from Mr. O'Leary's property line, the property line that he has in common with Mr. Roulier. And that a swale will be added between the retaining wall and the property line to direct storm water towards the lake, at least down to the retaining wall that is closer to the lake, the lower retaining wall. Then an additional Swale, oh, and riprap will be added at the point... MR. SCHODER-Between the walls. SUPERVISIOR STROUGH-Between the walls. MR. SCHODER-The area between the walls. SUPERVISOR STROUGH-Between walls, riprap will be added between the upper and the lower retaining walls. MR. SCHODER-Correct sir. SUPERVISOR STROUGH-And then there will be a swale that runs parallel and alongside the common property line towards the lake. MR. SCHODER-Correct. SUPERVISOR STROUGH-Where approximately ten feet (10') from the lake will be another body of riprap to try and prevent any first flushes from going directly into the lake. MR. SCHODER-Probably more than ten feet (10')but yes, at least ten feet (10') say as a minimum. SUPERVISOR STROUGH-At least ten feet (10'). Well, I don't want it to be too excessive. When you brought the question up, you know those little lights that pop in the back of your head, you go, oops. I should have had some stones or should have some landscaping shown in that location so that's an error on my part. You can't win them all. REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 908 SUPERVISOR STROUGH-Alright, how does the board feel about the application with the conditions that we're imposing on them? COUNCILMAN CLEMENTS-I feel alright with the conditions but I almost think that I'd like to see the plans with the entirety on it. SUPERVISOR STROUGH-Okay, there's one. COUNCILMAN CLEMENTS-They're going to do that for the Planning Board anyway, right? MR. SCHODER-It will delay me to your next meeting is what the only issue would be. We are trying to get this built. COUNCILMAN VANNESS-And I think one of the important things on the delay is, is that one of the things that kind of turned me a little bit is, one of the neighbors came up and mentioned that there had been problems with this system before so I think the longer we delay it, the more problem were going to continue to have with it. So I mean that was one of my concerns that when the neighbor came up and said there were issues with it. SUPERVISOR STROUGH-And the other thing is, I am pretty sure that Joe, he lives there, he knows what was just stated and agreed upon tonight and if it varies from that, he'll come back to us. MR. SCHODER-Again, we'll be inspected this as well. COUNCILMAN CLEMENTS-Do you mind if I attend the Planning Board meeting? MR. SCHODER-I would love it if you did. COUNCILMAN CLEMENTS-I'll be there. MR. ROULIER-When you're talking about the berm down towards the lake, I think this is where Carl was talking about, referring to this particular area... I would just throw this out to the board as a suggestion, okay. This is a very narrow area. First of all, the runoff that we're talking about probably, let's go on to say an A typical storm, okay, I don't expect quite honestly that we're going to, we're not going to be developing a stream in any way or fashion down through the Swale, it's only in the event of a hurricane, or something like that. I think to be perfectly honest with you, to incorporate riprap down in this particular area because quite honestly, what it would do, would be in effect, prevent anyone from walking from one property over to the other because you would have to cross a swale that's now incorporated or filled with stone. I would suggest to Carl that if there is a Swale, there's ornamental grasses up there or some type of natural landscaping. SUPERVISOR STROUGH-Well, Joe, if I have my way, I would put, I would make all of you along the shore, put a buffer on that shore in according with 179-8-040. REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 909 MR. ROULIER-And you're not going to get an argument from me. SUPERVISOR STROUGH-Okay. MR. ROULIER-But I think that instead of using riprap in that particular area, to incorporate some type, because I know that in the Town of Queensbury right now, different ornamental grasses or some type of natural greenery, it would be more favorable right there because we're really only looking at selective periods of time where we might actually have a flow of water. So rather than impede the walking area from one piece of property to another and it's quite narrow in that area,just have it so that there's more greenery in that area that essentially, it will work the same way as the riprap. SUPERVISOR STROUGH-Why don't I just define it and let the Planning Board deal with it as a permeable buffer area? COUNCILMAN VANNESS-That will work. MR. ROULIER-I will go with that. MR. SCHODER-Actually your point is very well taken. You're going to get more cleaning down there with a well-made riprap swale with almost a level bar that allows the water to come down that Swale, have grassed area and have it simply spill over that grassed area ... SUPERVISOR STROUGH-You don't want me to start talking about grass? MR. SCHODER-No, no, I am not talking about a manicured grass area. I am talking about something, actually I may be, I may be talking about placing sod because it catches quicker. SUPERVISOR STROUGH-Well, and you're allowed to do that but the thing about it is, I'd rather have the first fifteen (15), between the shoreline and upland, a buffer, a permeable buffer of natural vegetation, no invasive species, etcetera. MR. SCHODER-But still grass is of the types of vegetation that will filter that water. SUPERVISOR STROUGH-Alright, so we'll define that the termination near the shoreline of the lake will be some kind of permeable buffer. MR. SCHODER-Perfect. MR. ROULIER-Mr. Strough, if you were here backed up to that particular piece of property and you walked down to that particular location, that entire area actually from, there's a large tree right here but that entire area from my father's property almost probably ten (10)to twelve feet (12') over, is that type of vegetation already. MR. SCHODER-That's true. MR. ROULIER-So, there's no runoff just going directly right into the lake. I think you'll be very satisfied in another two weeks when it greens up, if you saw that. COUNCILMAN VANNESS-So it basically sits there and absorbs thru the soil already. MR. ROULIER-Already, yes. MR. SCHODER-What I don't want to do when I get down near the shore because the slope steepens, is make a ditch. What I wanted to do is get down to that location, fifteen feet (15') REGULAR TOWN BOARD MEETING 04-21-2014 MTG#17 910 from shore and spill out naturally over the soils that are there. If I had my ideal case because frankly, I won't be disturbing the soil on the shore of the lake less potential for erosion, as Mr. Roulier just noted, is indeed a vegetated area with natural vegetation. I am simply spilling into this, it's going to be the cleansing that you're going to wind up getting for your runoff that's coming down through here, the erosion potential will be nil. There's very little quantity of water that we're talking about in the first place here, it's not streams, it's very, very as you have noted, infrequent event that you would consider having anything .... noticeable water. SUPERVISOR STROUGH-Well we like to plan for the worst case scenario. MR. SCHODER-Absolutely but I don't want to make it an erodible area. SUPERVISOR STROUGH-Okay. MR. ROULIER-Thank you very much. SUPERVISOR STROUGH-Alright, thank you Joe. Alright so, we're going to have a motion soon on Resolution 1.1 approving Steven O'Leary's application for sanitary sewage disposal variance with the conditions as stated in this meeting but I will go over them again. Moving the retaining wall so that it is three feet (3') from the property line and a swale be added between the property line and the retaining wall directing storm water towards the lower, towards a permeable filter area that will be located between the retaining walls and another swale directing the water towards the lake with another permeable buffer prior to its entering the lake. MR. SCHODER-The area between the two (2) retaining walls because of the steepness of it, it does indeed need to be riprap, you may as well say that. I look forward to some discussion here with the Town Board in the very near future to take a look at some zoning changes and hopefully get things moving down there on that Main Street corridor. COUNCL,MAN IRISH(WARD III) • I would like again to thank the West Glens Falls fire Department for allowing us to have the event down there. It was a great venue, we had a great turnout as Bill stated. Thank you to Stu Baker, Senior Planner for putting it together and putting the grant together for the town. • I would like to remind everybody that we'll start to see a lot more people out bicycling now, it's getting nice out. The sides of the roads are still full of sand and pretty torn up. So I would just like to caution you to be careful, there's going to be a lot of people in the road on their bikes. COUNCILMAN CLEMENTS (WARD II) • Announced that there's going to be a meeting on May 1St from 6 to 8 p.m. at the Crandall Library downstairs held by Warren County Supervisors, it's regarding the sale of Westmount Facility to Specialty Care Group. • Announced that the Queensbury South Vision Plan public workshop will be held on April 29th from 7 to 9 p.m. at the South Queensbury Volunteer Fire Department on 409 Dix Avenue, Queensbury. This will be the second public workshop to discuss economic and community revitalization opportunities within the South Queensbury neighborhood. The purpose of the public workshop is to solicit input on the long term vision for the study area and to present the opportunities and ideas for the redevelopment of the Hercules, Ciba- Geigy site. Reminder to everyone, change your carbon monoxide detectors every five (5) years and smoke detectors every ten(10) years. He also noted, don't throw paints, stains and other maintenance products into the garbage, they need to be taken care of in a safe way. I have suggested to the county that we have a countywide hazardous waste day. DEC has warning out there regarding outdoor burning, it's dry right now. Certainly you can have that grill fire for cooking but the other outdoor burning is prohibited. Do not mix topsoil, rocks, sand, stones because we put this through grinders and chippers. I think it's important and there's a lot of questions that people are starting to have in the public that have been asked in private over the past couple of years so I wanted to thank you for voting on that. I know you and I have had some discussion about concerns and I think it was the right thing to do. SUPERVISOR STROUGH-I do have some concerns and Chairman Kevin Geraghty called me today and I expressed to him my concerns and I had questions and he said he would get answers to me so if they are satisfactory, maybe we can go forward, we'll see.
