John Bruning-Fireman for No. Qsby. -spoke on the concern that the Fire Company has for access to fires on the Assembly Point Road. . .noted that the road is narrow and runs along the lake. . .dangerous to pass parked cars with a large fire truck— this is the only way in and out of 168 The Assembly Point area. . . Unknown- noted concern for the safety of cars passing parked cars. . . Mr. Bruning- noted that the Rnad borders the lake and there are no guard rails to prevent anyone from going off the edge. . . Mr. Paul Lars- Assembly Point- voiced his concern over School Busses passing parked cars. . .noted the danger. . . Councilman Walter-Meeting with the Fire Chiefs , they felt it was very important to them in moving their vehicles through. . . RESOLUTION TO ADOPT ORDINANCE NUMBER 48 ENTITLED ORDINANCE TO ESTABLISH A NO-PARKING ZONE ON ASSEMBLY POINT ROAD FOR NINE TENTHS OF A MILE FROM BRAYTON LANE TO BAY PARKWAY-BOTH SIDES RESOLUTION NO. 325 , Introduced by Mr. Hammond Robertson who moved for its adoption, seconded by Mrs. Frances Walter: WHEREAS, the Town Board deems it necessary to adopt an ordinance Number 48 entitled Ordinance to establish a No-Parking Zone on Assembly Point Road for Nine `_;tenths of a Mile from Brayton Lane to Bay Parkway-Both Sides, and WHEREAS, aproposed Ordinance was presented to the 'Board and after due notice a Public Hearing was held thereon by the Town Board on the 28th day of November, 1978 at 7 : 30 P.M. at the Town Office Building, Bay and Haviland Roads, Glens Falls, New York 12801 and that the Town Clerk gave notice of such hearing by publication thereof in the Official Town Newspaper at least once prior to the date specified for such hearing, specifying the time when and the place where such hearing will be held and in general terms describing said proposed Ordinance, and WHEREAS, all persons were heard both in favor of and opposed to said Ordinance, NOW, THEREFORE BE IT RESOLVED, that Ordinance Number 48 of the Town of Queensbury be as follows: ORDINANCE TO ESTABLISH A NO-PARKING ZONE ON ASSEMBLY POINT ROAD FOR NINE TENTHS OF A MILE FROM BRAYTON LANE TO BAY PARKWAY-BOTH SIDES BE IT ENACTED AND ORDAINED BY THE TOWN BOARD OF THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, AS FOLLOWS: Section 1. For the purpose of this ordinance the word "vehicle" "park" and "standing" shall have the meaning defined in the Vehicle and Traffic Law of the State of New York. Section 2. No vehicle shall be parked or left standing on the ,Assembly Point road for nine tenths of a mile, from Brayton Lane to Bay Parkway, in the Town of Queensbury. Section 3. All ordinances or parts thereof of the Town of Queensbury inconsistent with the provisions of this ordinance are hereby repealed;pro- vided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be in addition to the other ordinances regulating and governing the subject matter covered by this ordinance. Section 4. Any person violating any provisions of Section 2 of this ordinance shall upon conviction be punishable for a first offense by a fine not to exceed TEN DOLLARS ($10.00) and for a second offense by a fine not less than TEN DOLLARS ($10. 00) nor more than TWNETY FIVE DOLLARS ($25.00) by imprisonment for not less than TWO (2) nor more than TEN (10) days. The third or any subsequent offense within one (1) year shall be punishable by a fine not to exceed ONE HUNDRED DOLLARS ($100.00) or by imprisonment not to exceed THIRTY (30) days or by Soth such fine and imprisonment. In addition to the aforesaid penalties, the Town Board of the Town of Queensbury may institute any proper action, suit or proceeding to prevent, restrain, correct or abate any violation of this ordinance. Section 5. This ordinance shall take effect immediately. RESOLUTION RECOMMENDING HIGHWAY TRANSFERS OF MAINTENANCE JURISDICTIONS RESO . tTION NO. 3" Introduced by Mr. Daniel Olson who moved its adoption, seconded by Dr. Charles Eisenhart: WHEREAS, the Superintendent of Public Works of Warren County has recommended the transfer of maintenance ,jurisdiction of certain highways and WHEREAS, the County Board of Supervisors as per their Resolution No. 310 of 1978 has proposed the following transfers of jurisdiction: 1. C.R. #42 Dix Avenue from the Washington County Line to Highland Avenue be transferred from County to State maintenance. 2. T.R. #5 Highland Avenue in its entirety be transferred from Town of Queensbury to State maintenance. 3. S.H. #656, the Boulevard (Rt. 32) from the Washington County Line westerly to the Highland Avenue-Lower Warren Street Intersection r be transferred from State to County maintenance. NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury agrees with the transfer of maintenance ,jurisdiction believing this will provide for a more orderly State-County maintenance operation, and be it further RESOLVED, that a copy of this resolution be forwarded to the State Department of Transportation, changes be made in the official road books of the Town of Queensbury, and a Highway Charge Form be forwarded to the Department of Public Works of Warren County. Supervisor Brandt- The State at this time poses no changes in traffic lights; When the State transfers to the Countypmaintenance would become our responsibility. It is the feeling on the County level if there is a change where Highland Avenue is made into a major road then ---� lights have to be eliminated on some of the other roads, possibly the Boulevard. Councilman Robertson- It is my opinion that you can' t do it. Councilman Olson- in questioning Mr. Austin he stated that the State wanted in requesting this, was, from Washington County,Burgoyne Ave. , continuing over Dix Ave. going down Highland to Warren Street which is a State Road, they would like to- continue the circle. . . Councilman Robertson- No, we do not have any ordinance. . .an ordinance could be passed such as exists in the City, stating that a sidewalk must be shoveled with a certain amount of time after a snow storm, if not done the DPW or Mwiever will shovel it and the expense of such will be placed on the owners tax bill. . . Mr. Joseph Daire-questioned the statia.s of the zoning on Dix Ave. . . . Supervisor Brandt-we are awaiting the County' s input before a public hearing can be set on a specific motion. . .
