There is a copy of the agenda on the back table. There's also a public hearing information sheet. Most of the items do have a public hearing scheduled and we'll get into more details when we open the first public hearing. The first item on the agenda is a tabled item. TABLED ITEM: SITE PLAN NO. 24-2014 WILLIAM & PAMELA ROBERTS: FOR FURTHER TABLING CONSIDERATION MR. HUNSINGER-Staff is, well, we need to schedule it for after July 16th. Is there any more information, Laura,that you want to share? MRS. MOORE-No,there's no new additional information. Just the fact that they requested a tabling to a further date,and the Zoning Board tabled them to the August meeting. MR. HUNSINGER-August meeting. Okay. MRS.MOORE-Yes. MR. HUNSINGER-So we'd need to schedule it for the second August meeting or September, if the Zoning Board. MRS. MOORE-I'll explain what's happening with the applicant. The applicant had proposed altering the buildings in an architectural scheme, and the Zoning Board did their poll vote and it didn't look favorable. So the applicant said let me table it. We'll go back to the drawing board and see if there's something else, and at this point in time they're still, their previous application that was handled in January is still valid. So if they move forward on that,then this new alteration would go away. MR. HUNSINGER-Okay. MRS. MOORE-So tabling them to August or September is fine. You can do either one. I'm assuming by that time I will know whether they're abandoning this projector not. August is fine. MR. FORD-Second August meeting? MRS.MOORE-Yes. MR. HUNSINGER-The 26th. MR. KREBS-August 26th? MR. HUNSINGER-Laura? MRS. MOORE-Okay. Under Summary, I have the applicant has completed the Final Stage application for subdivision review of a 29 lot conservation subdivision. The applicant proposes that 29 lots less than 0.5 acres be developed for single family homes. The project includes designated open space areas with walking paths. The open space area is to be owned by a home owners association and a description of the HOA ownership is part of the final stage submission. The board may discuss decks pools and sheds to review setbacks for those items due to the lot sizes. The board may also consider discussing additional land to be set aside for future sidewalk along Sweet Road -this was mentioned at the Town Board during the sewer discussion. MR. HUNSINGER-Okay. Thank you. Good evening. MR. O'CONNOR-Thank you, Mr. Chairman. I'm Michael O'Connor from the law firm of Little & O'Connor. I represent the applicant,Al Cerrone,who is president of Cerrone Builders, Inc., and Dan Ryan, who is the project engineer. We have looked at the Staff comments and the proposed conditions to the resolution and we really have no issues with the questions. We'd be glad to answer your questions. MR. HUNSINGER-Okay. Questions,comments for the applicant? MR. FORD-As a result of a recent workshop that I went to on the Main Street development, and the smart development in America project, I keep getting e-mails about hazardous walking conditions in America and so forth, and when I saw that, what had been discussed the other night at the Town Board, I wondered if there would be interest and a willingness to set aside,without cutting trees or putting in sidewalks, but if we could designate a portion of the roadside for the potential for future sidewalk development. 2 (Queensbury Planning Board 06/26/2014) MR. O'CONNOR-If you look at the site, there is a space within the right of way, which a sidewalk could be constructed before you get to the trees, and typically I think if they're going to do a sidewalk in curbs, that's where they would put it. They wouldn't put it off of the road, requiring trees to be cut. That's already owned by the Town or whoever owns that road. It's not part of the development. There's about 10 feet in there. So if somebody has the will or sees the practicality of putting a sidewalk through there,there's the ability to do it. MR. FORD-And you know I'm not a great advocate of sidewalks that go to nowhere and connect to nothing, but, you know, who knows. Down the road, at least the potential is there. So that's a positive thing as far as I'm concerned. MR. O'CONNOR-We think it's there. MR. HUNSINGER-I guess the question that I would ask about that is, since that, well, it would be on the Town right of way so it wouldn't be up to the homeowners association to maintain. It would be up to the Town. MR. KREBS-Right,and the subdivision is already providing some walking area. MR. O'CONNOR-Internally within the subdivision there are walking paths that we're going to establish. MR. KREBS-Yes,which is much safer than having them walk along Sweet Road. MR. HUNSINGER-Any other questions or comments from the Board? Did you have any comments about some of the Staff comments about decks and other issues? MR. O'CONNOR-We believe that we can live within the setbacks for the zone with those items. I think you can build accessory buildings or sheds up to a certain size at five foot setback from your property line. MRS. MOORE-Correct, less than 120 square feet. So once that shed goes over 120, then you're subject to the setbacks of that zone. So I was just, I just wanted to make sure that there weren't lots or things like that; that you're setting yourself up for a variance. MR. O'CONNOR-I think that's why we specifically asked for the side line setback. So people wouldn't be coming in for variances,particularly if they ask for a side load garage. If you remember the early discussions we had about that. The normal rear yard setback is 30 feet,for the structures. MR. CERRONE-The Town regs as far as pool setbacks? MRS.MOORE-It's 20 feet from the rear. MR. CERRONE-Is 20 feet from the rear? Okay. MR. HUNSINGER-I mean, some of the lots on the inside of the circle, I can see where there may be issues. Certainly the ones on the outside of the circle you've got plenty of rear yard space. MR. FORD-I notice there are a couple of places where, once place in particular where it's a subdivision for 29 three bedroom homes, and another place the bedrooms were not specified as just three bedroom. MR. O'CONNOR-We did the three bedrooms to make sure that we had the conservative or maximum flow for sewer purposes, and we will get charged for that when we buy into the sewer district, and we won't get into an issue of counting bedrooms, if, perhaps, that is the market, and we don't think that's the market for these houses. We think the market is two bedrooms,but we wanted to have a flow rate that somebody wouldn't come along and say, well, what happens if you build three bedrooms. MR. FORD-It makes sense to me. Stormwater issues have been addressed to your satisfaction? DAN RYAN MR. RYAN-Yes. We did re-issue an updated stormwater plan and SWPPP and at this point I believe there's six minor administrative type comments that are addressing a couple of calculation 3 (Queensbury Planning Board 06/26/2014) clarifications and detail clarifications, none of which would ultimately change anything related to the project design. So it's really just more of providing those clarifications, and I believe we would have the engineering signoff without too much trouble addressing those. MR. O'CONNOR-I think your resolution is set up for, your resolution for approval is set up that the Chairman won't signoff until we have that engineering approval. MR. HUNSINGER-Yes. MR. FORD-I just wanted to make sure that there weren't any issues that the applicant wanted to address. MR. HUNSINGER-Anything else? Any other questions,comments, Laura? MRS. MOORE-I had a phone call from Mike Shaw, Department of Health,today saying that they're in the process of reviewing the materials, and they didn't have any objections at this time, and they're satisfied with the information that's presented so far. So he wanted to make sure that you were aware of that. MR. HUNSINGER-I'm not even sure we'd have this many questions if so much time hadn't gone by since the last meeting. A lot of it's just a refresher or things we'd talked about. MR. O'CONNOR-There's a lot of submittals. Well, we had to wait for the finalization of the sewer district, and the resolution of the Town Board is a permissive resolution, or it's a resolution subject to a permissive referendum. So we had to wait 30 days after their resolution, even though we waited some time for them to schedule their resolution. MR. MAGOWAN-Can we make it any more complicated,right? MR. O'CONNOR-We tried to dot the I's and cross the T's. MR. FORD-I believe that it is one of the outstanding projects to be advocated in the Town of Queensbury in recent memory, and I applaud you for doing it and I thank you for bringing it to Queensbury. MR. CERRONE-Thank you. MR. HUNSINGER-Any other comments or concerns we haven't addressed? Okay. Are there any members that feel a need for any special conditions on the resolution? I guess it's up to you. MR. KREBS-Okay. RESOLUTION APPROVING FINAL STAGE SUB # 8-2012 CERRONE BUILDERS, INC. A subdivision application has been made to the Queensbury Planning Board for the following: Applicant proposes a 29 lot conservation subdivision for 29 three bedroom single family dwellings along with associated utilities & infrastructure, common HOA land and passive recreation. Subdivision of land requires Planning Board review and approval. SEQR Negative Declaration and Preliminary Stage approval on 1-28-2014; Town Board of Health approved a sewer district extension on 2-24-2014 (BOH resolution 75.2014); A public hearing was scheduled and held on 1-28-2014; This application is supported with all documentation, public comment, and application material in the file of record; MOTION TO APPROVE FINAL STAGE SUBDIVISION NO. MOORE-I was hoping, tomorrow's our typical timeframe that we put packets together for the engineer,and so we should chat about how soon you can get that information to us. MR. O'CONNOR-Hopeful the end of next week. MRS.MOORE-Okay. MR. HUNSINGER-Is that soon enough? Because I know we're looking to finalize the agenda for July. MRS. MOORE-Right. Currently it's not on the July agenda. So it would be added to the second meeting in July, if the Board wanted to do that. Again, I don't know, I'm in a Catch-22 because I know the information is subject to this parcel, and we do need to review the landscaping, lighting, stormwater, and some of that information gets forwarded to the Town Engineer. We try to get that information in a timely fashion so that the Town Engineer has that amount of time to review it. MR. HUNSINGER-Right. MRS. MOORE-I know the applicant has proceeded with gathering some of that information, so I just don't know where they're at. MR. O'CONNOR-It's a 1340 square foot building with 10 parking spots I think on the site. It is not going to be that complicated. It's a very small site,too. I think it was 1340,wasn't it? MRS.MOORE-Right. It's not a very big building. MR. SCHONEWOLF-So we table it until the second meeting in July? MR. MAGOWAN-1320. MR. O'CONNOR-1320. Okay. MR. HUNSINGER-Last week,or last night. 8 (Queensbury Planning Board 06/26/2014) MR.TRAVER-So the next step in the process, sir, is they would be returning,the applicant would be returning on July 22nd again before us that evening,and we'll talk about site issues,that is to say the building itself,the grounds,what changes,what impacts,all of that kind of thing. MR.WALKUP-Okay. MR. MAGOWAN-How many parking spots,how many cars would be allowed,blah,blah,blah. MR. WALKUP-Before that the discussion has only been on whether or not the use could be permitted, and to do that, they not only had to talk to us, but they had to go to the Town Zoning Board, which they've successfully been able to do, but then they have to come back and talk about specifically what are they building on the property and that type of thing,specifics. MR. WALKUP-I want to know big the building is, how many cars are going to be allowed to be parked on there. MR. TRAVER-You also would have an opportunity, along with the rest of the public, to stop by the Town Planning Office and examine the actual plans that have been submitted for the project. MR.WALKUP-Well, that's hard for me because I go to work, I have to be in to work at 6 and I don't get out until 6 and I have a 35 minute drive. That's the reason I had to rush to get up here. MR. HUNSINGER-Sure. MR.WALKUP-And that's why I didn't make it last week. MR. HUNSINGER-The applicant's agent has offered to show you the plans and stuff this evening. MR.WALKUP-I'll look at it and stuff,but I'm not really happy about it,because I don't think it's. MR. HUNSINGER-We'll be happy to hear your concerns. You can either come to the meeting on the 22nd of July or you can submit them in writing to the Town Planning Office. MR. MAGOWAN-And they'll be read in. MR.TRAVER-Or both. MR. HUNSINGER-Yes,or both. Carl Schoder from Schoder River Associates, representing the applicant. I believe that the situation says it all. We wound up getting our variance yesterday 12 (Queensbury Planning Board 06/26/2014) evening, as far as the area variance requirements. I believe we presented to this Board a week ago what the project particulars were. So I won't belabor that, and I guess we're here to answer questions relative to the site plan. MR. HUNSINGER-Okay. Questions, comments from the Board? Everyone's flipping through their notes. MR. FORD-Would you please re-visit the septic application? MR. SCHODER-Absolutely. As we noted before, the site is basically bedrock and shallow soils with the exception of one area that has usable soils on it. The area would not hold a typical stone and trench type wastewater system. Instead what we are proposing, and what we received the septic system variance for the Town Board of Health was for the construction of something called a Presby system. A Presby system is an aerated type of a system. It keeps the medium in an aerated state which is important because in septic systems the bugs like air, at least in the leach field they do It has a sand filtered medium around it which winds up, if you will, polishing that waste. That's where those bacteria live that do that. Therefore the waste that comes out of it is of a higher grade than what you would normally expect from a conventional stone trench system. To build that system, because of bedrock considerations, etc., in again, the only feasible location as we had noted to the Town Board of Health,would require bringing in some fill. To bring that fill in,and towing off the slopes the side slopes of that fill, put us in a situation where we required variances for two different provisions. One was,at least as far as a leach field,one was separation to a side line,which is measured from tow of slope, if you will, the other was for separation of bedrock, three feet required. I can get, based on quite a few test pits, actually, to try and verify that we actually had something to work with, I can get about two and a half feet. So close but no cigar. Obviously if I made that higher, it would get wider, I'd have more problems with the side line. So, it was decided to go with this design, which, again, the Board of Health had approved. In constructing this, and being able to put that fill in to retain that fill, because again, we've got about a third of an acre to work with,here,very little space,will require the construction of two masonry retaining walls. The drawings note something called a wall by Rockwood. I believe it may actually be a wall by Versa Lock, but that would be an equal in my professional opinion to Rockwood. Same thing, just different manufacturer. That wall would create, retain the earth that is being used to create that wastewater system. As it steps down, you're going to have another lower shelf, if you will, or terrace to that well system. Really the intent of that is, One, aesthetics. It would look nice, be able to put plantings by the wall. Secondly it gives us a little bit of stormwater infiltration in that area. I'm surprised you folks haven't asked me about that as of yet, but we're doing the best we can with a third of an acre of a pile of rock. Actually we've got some pretty good things going on there. And that is part of that. You ask me what time it is, I tell you how to make the watch. Engineers. One point, I'm sorry, there was one other variance issue that had to do with the septic tank. Available space to be able to install the required size of the septic tank simply isn't there between the adjacent property. There's no other place to put it and keep it far enough away from the lake. So what we chose to do was hold that separation distance requirement of 10 feet to adjacent property line for that tank and also for a pump pit, but infringe on the separation distance to the new, or not the new,but to the existing structure. What we will do, as a way of mitigating that,would be to put an impermeable membrane, basically a hypalon type of a material, down and extending beyond those tag installations to prevent any lateral migration should there be a leak in the tank. Okay. MR. FORD-You've had your challenges there,haven't you? MR. SCHODER-Yes, I never get the easy ones, but then again on Lake George most of the easy ones unfortunately are done. MR. FORD-Fortunately they found your reputation. I'm sure they're happy that they found out about your reputation. MR. SCHODER-Am I in trouble? MR. FORD-Not yet. MR. SCHODER-Thank you for that. We've had some good successes in tough sites, and it's good for the lake. MR. FORD-Obviously. MR. SCHONEWOLF-Well,that's a tough site but it's a beautiful site there. 13 (Queensbury Planning Board 06/26/2014) MR. SCHODER-It is. It's nestled into the corner. It is,it really is. MR. HUNSINGER-And you have nice plantings along the shore. MR. SCHODER-Right. Well,what is there is there. We're not touching it. MR. HUNSINGER-Yes. MR. SCHODER-One exception is to the north we have, well, actually not by the shore. The shore we're leaving alone, but up on the side adjacent to that property, it came up in the wastewater system hearings, that the adjacent owner wanted some assurance that runoff, and he's speaking of stormwater, wouldn't wander over onto his property because he does have a septic tank down in that area. It was easy enough to do,just gave him a little berm and we created a little swale. It'll all be grassed. You won't know it's a berm and a swale when it's all done. The applicant had modified the plans to address the Planning Board's concern at Planning Board recommendation. Those were presented to the Zoning Board,where there's designated parking and designated landscaping to the rear of the property as well as planters to the front of the property that you requested as a Board. MR. HUNSINGER-Okay. Thank you. Good evening. MR. CENTER-Good evening. Tom Center, Nace Engineering, along with the property owner, Mr. Ringer. As you can see by the recently revised drawings that you have before you, we added a landscaping plan and incorporated some comments from Staff from the last time, including parking spaces in the rear,reconfigure the parking along the building to take into account the location of the transformer in the northwest corner. Remove the parking space from up there. Also added some green space, and showed only one exit on the rear of the parcel out to Linda Avenue, added four arborvitae along the west side, if you will, of the Linda Avenue frontage to discourage anyone from driving through off that section direct to the single exit door out to Main Street. We've also added several planters along the walkway at the front of the building to try to incorporate some green to the front side or north side of the building. The stormwater plan just changed in regards to the added green space in the rear and the reconfiguration of the parking lot. The grading still maintains the same. Everything still goes to the same drywells in the center of the parcel, of the back parcel there to make any stormwater management in that area. By adding the green space we reduced the requested variance by a couple of percent with the added green space. So we asked for less relief which we received at the Zoning Board last week. MR. HUNSINGER-Thank you. Questions, comments from the Board? I guess I would just add, you know, I think you did a good job addressing the concerns that we had raised, and we appreciate that. MR. FORD-And quickly. MR. HUNSINGER-Yes. Did we talk about lighting when you were here? MR. CENTER-I don't believe so. MR. The operation of the doctor's office s early evening. MR. RINGER-The operation's like,you know, 'til five o'clock. I had planned,there's a pole out there, and I had left it there for a reason. Because I do want to put a light on that. I plan on putting a light there. When, as soon as possible. I did put some lights on the side of the building that light up. So if somebody was walking out in the wintertime. MR.TRAVER-Motion detection lights? MR. RINGER-Yes. I put them up,you know. MR. HUNSINGER-I didn't notice them during site review. What kind of lights are they? MR. CENTER-Are they all downcast lights on the? MR. RINGER-They're on the side of the building. There's one on the east side of the building, probably right towards the middle, and then there's one right on the west side of the building down back towards the corner. MR. MAGOWAN-Are they floodlight spotlight or are they? MR. RINGER-No,they're motion detector floodlights. MR. MAGOWAN-Okay. So they're not a downcast? MR. RINGER-No. MR. MAGOWAN-Okay. MR. RINGER-They're just floodlights. So when somebody pulls in or walks by, they could see going by. They seem to be working very well. Because it was brought to my attention. Where I've got them set now, they click on, and like I say, at some point in time, that's why I left the pole there. Tore the trailer down but left the pole,and at some point in time, I'd like to get a light. MR. MAGOWAN-Be careful if they're not the right ones. They've got to be a downcast. You can put them up,but you're going to be back here again. MR. FORD-They've got to be Code compliant. MR. MAGOWAN-Tom will give you a list of what you need. You're talking those big old ones that used to hang out and over? MR. RINGER-Yes,that's one of them. MR. MAGOWAN-Okay. MR. RINGER-No,but that is the plan of that. That's why the pole is out there. It's just, it's been a lot of undertaking because when it was all said and done, it threw me for a loop and the first year was like, I had to just clean it right up and that really solved the problem.
