To Whom it May Concern:
Please find the enclosed "Accessory Structure Building Permit Application." The application requests the
placement of a 12'X18' shed on my property at 33 Helen Drive in Queensbury, Parcel # 301.12-1-41, 8'
off the rear property line and 30' off the right side property line. I have based these measurements on
existing survey stakes in the rear lot corners. I have attached the following information:
• Two copies of a plot plan indicating the present house and setbacks as well as the location of
electric,gas,water and septic lines;
• Current tax roll information;
• Two sets of basic structural drawings showing the outside dimensions(front and end)of the shed;
• A price quote from Garden Time who will be installing the shed as well as a picture from their
brochure;
• Several pictures of my lot which include:#1 and#2 survey stakes in each back corner;#3 an existing
7'X7'shed that will be removed when the new shed is installed approximately in the same area;and
#4,#5,and#6 showing the back yard.
• Additionally, there is a precedent with regard to the placement of a shed of similar size by my
neighbors. Picture#7 shows their 12X16 shed which is five feet or less from the rear property line.

Introduced by Joyce Hunt who moved for its adoption, seconded by Ronald Kuhl:
33 Helen Drive. The applicant proposes installation of a 216 square foot shed within the rear
setback of a parcel located in the Evergreen subdivision. The applicant requests 22 feet of rear
setback relief from the 30 foot rear setback requirement of the Evergreen subdivision approved
in 1973. The criteria for considering an Area Variance, according to Chapter 267 of Town Law,
whether there will be an undesirable change in the neighborhood character or to nearby
properties, and the aesthetics of the neighborhood will not be affected. Whether the benefit
could be achieved by any other means feasible to the applicant. I think that wanting to have
the shed in the back is what generated this variance. Whether the area variance is substantial.
While 22 feet 73% from the 30 foot rear setback for the Evergreen subdivision may be
considered moderate to severe, it's still not going to have much of an impact on the
community. Whether the proposed variance will have an adverse effect or impact on the
