Councilman Olson- disqualified himself from the hearing due to a possible conflict of interest. . . 2 Mr. Nolan-Colonial Cablevision-reviewed the previous rate increase of four years ago commented on the cost of living increase—requested that the board would consider a 10% increase $6.75 to 147.25 Commented on meeting with the four other municipalities and wish when this hearing is completed to set up a meeting between these bodies so that a final decision can be made on the proposed increase. Presented the Board with copies of Auditsc � 97L Councilman Barber- How many customers do you have in Queensbury? Mr. Nolan- 1861-the revenues paid to Queensbury last year from the franchise was $10,170.44 also subject to school, town and county taxes. Councilman Robertson- questioned Mr. Nolan.; on service to areas such as Glen< Lake. Mr. Nolan- commented on a survey that has been taken in the area, unless there is sufficient density we cannot recommend service. . . figures on the Glen Lake Area forthcoming. . . Councilman Walter- questioned the service documenting an instance of lack of service. . . Mr. Nolan- apologised for the problem noting that there is a record kept of all calls. . . listed the number of employees and their functions. . . Councilman Barber- asked when the Twicwood Area would be completed? Mr. Sutfin- it dould be completed by the end of the summer. . . . Mr. William Bodenwieser-Atblu&nted that he feltkhey should have in increase. . . commented on the good service that he had experienced at his place of business. Supervisor Brandt- declated:-O the hearing closed 7:58 P.M. Councilman Barber! -commented on hearing from Mr. McPhillips who wishes Cable T.V. in the Glen: Lake Area. . . Mr. Sutfin- reviewed 'the figures for installation of line, ' to the Glen Lake Area. . . . $12.00 per month for service connection charge $25. 00 based on a 170 service. . . Councilman Barber-questioned the number of users in the Glen- Lake Area as being so small. . . will give figures to' the` G1en Lake Association and they can come back to you. RESOLUTIONS RESOLUTION TO CHANGE NAME OF HIGHWAY RESOLUTION NO. 89 Introduced by Mr. Daniel Olson who moved its adoption, secondet by MS. Robert Barber: WHEREAS, it has been requested by Michael Yaffee and Richard Day to change the name of Reids Lane to Hickory Hollow, Now, Therefore be it RESOLVED, that the Town Highway presently known as Reids Lane described as, beginning at Stonewall Drive and continuing easterly . 11 miles to Lyndon Read, be and the same is hereby renamed Hickory Hollow. RESOLUTION TO INCREASE NUMBER OF MEMBERS OF TOWN OF QUEENBBURY ZONING BOARD OF APPEALS RESOLUTION NO. 90, Introduced by Mr. Robert, Barber who moved its adoption, seconded by Mrs. Frances Walter: WHEREAS, the number of members of the Zoning Board of Appeals of the Town of Queensbury is presently set at five, and WHRREAS, the provisions of Town Law Section 267 (1) empower the Town Board to increase, by resolution, the number of members of the Zoning Board of Appeals to seven, and WHEREAS, it appears that it would be in the best interests of the Town of Queensbury to increase the number of members of said Zoning Board of Appeals from five to seven and to benefit from the views , ideas and experience of the two additional members thereof, NOW THEREFORE BE IT RESOLVED that the number of members of the Town of Queensbury Zoning Board of Appeals be increased from five to seven and that said additional two members be appointed for terms to two and four years , respectively, as provided by law, and be it further RESOLVED, that this Resolution will take effect upon the appointment of the two additional members to the Zoning Board of Appeals. None Absent: None DISCUSSION ON OPERA FESTIVAL CONTRACT Resolution Introduced by Mr. Robertson and Seconded by Councilman Olson Councilman Barber- noted that there were no representatives from the Opera in the audience, before voting he requested that an item be clarified. . . .has some of the p$rformances been moved from the Queensbury area? Supervisor Brandt- commented that he felt that the Stale and Federal Governments support the arts and I do not think it is necessarily intelLigent for the Town Governments to do the same thing. . . commented in the demands on the Town Budget fortroads etc. Councilman Olson- spoke an his research in the past funds given to the Opera Festival noting the decline iince 1970. . . felt that the funds were in the 1977 Budget and should be given bo the Opera Festival . . .did note that in the up-coming budget that the Contract would be looked at bo,�-the Board and prok&',Ibly be reduced or eliminated. . . Councilman Barber-requested that this item be tabled until he could receive more information from the Opera Festival. . . Councilman Waster- commented that for every. dollar spent on the Opera Festival there is a multiplier principal . . . . consider changes in the years ahead. . . Walter, Mr. Robertson, Mr. Brandt Noes: None Absent: None RESOLUTION TO SUBMIT A PROPOSITION AT A SPECIAL ELECTION RESOLUTION NO. 94, Introduced by Mr. Michel Brandt who moved its adoption, seconded by Mr. Robert Barber: WHEREAS, the Town Board of the Town of Queensbury, pursuant to Section 81, of the Town Law, does hereby upon its own motion deem it in the best interest of the Town to increase the number of Councilmen for the Town of Queensbury from four (4) to set (6) . Now, Therefore be it RESOLVED, that the following proposition: "The number of Councilmen in the i ' Town of Queensbury shall be increased from four (4) to six (6)" be submitted at a special Town election to be held at the Regular Polling Places on the 7th day of tune, 1977 , between the hours of 6A.M. and 9 P.M. Duly adopted by the following vote Ayes: Mr. Barber, Mr. Brandt Noes: Mr. Olson, Mrs.. Walter, Mr. Robertson Absent: None Supervisor Brandt- Wish to give the residents of the Town of Queensbury the right to examine an increase in the size of the Town Board . . . note the present five member board was designed when the Town was much smaller noted the sizable increase in the population has occured over a period of time which leaves a pretty strong concentration .of power between the five of us . It would be well to spread it out, to give the public better access to the government to give wider particigatdnn for the peopAt and their governments to give a 'wider variety of experience to the government. Councilman Robertson--commented that this was not a new idea. . ..noted that getting seven members together and havg 'a quorum is harder. . . 99% of the time this five member board has met at short notice and ' had a quorum. . .feels that the Town does get good representation. . . do not feel that the people of the Town have had problems in getting their views expressed. . . they �have access to me, the-rest of us are in the same boat— commented on the added cost to the town. . .questioned the material gain. . .basically not in favor :mf if. Conncilman •Olson- questioned when the -vote will be? Supervisor Brandt-June 7th-conjunction with the Sewer referendum. . . with a larger board there is less power with any individual member. . . more difficult to be partisan with more people, I am not saying this as criticism in any way I am saying this objectively and looking at the future of the Town of Queensbury and its form of government. 6 Councilman Olson- noted that he had never had a complaint from any resident of the Town of Queensbury that they felt that the board was too small. . . noted that he would need more time to review the proposal. . . Councilman Robertson-noted that on his years of service he knew of no one that excersised what I believe is power. . . credit to the Board that we. have reconciled differences in opinion. . . to get the job done. . . the largest concentration of effort that exists in this town rests in the Supervisor' s chair as it must, he is the chief executive officer the people look to him to be the leader of this town, certainly whether there are five member, four other members or six other members or what have you, this town the responsibility to get anything done rests in the center chair and there is no way we can change it nor do I intend to, I think it is a good system. Supervisor Brandt- Certainly what I am proposing here does somewhat ! dilute the power of the Supervisor, you say the Supervisor is the leader of the Town he is the guy who is going to bring forth the necessary changes or proposed changes. I have been here a year and a J little bit you know, the Supervisor only has me vote, his power is only to suggest and to chAtr meetings and to keep the books of the Town. I do not think that it is a great concentration of power I do not think it should be. Councilman Walter- announced that soon the Town Plan Survey will be sent out. . . it will also be available in other locationefor pickup. . . Councilman Olson- announced that he is turning over a letter from a resident of Tee Hill Road to the Highway Department in regard to placing another speed limit sign on Hall Road. . . Supervisor Brandt- questioned Councilman Olson in regard to the speed limit on Aviation Road in front of the Queesbytry School . . . Councilman Olson- Mrs. Shenk has gotten together all the letters in regard to this project. . .Mr. Garb has been requested to paint the road, Carl will also contact the State on the specification for the lights. . . Supervisor Brandt-commented that the County Traffic Safety Council is anew group-and he would bubmit the figures on the lights to this council. . . Councilman Walter- wished to have the following statement read into the record: April 12 , 1977 For Queensbury's growth and development, I fully understand and recognize the need for a sewer system in some parts of our town, I would work very hard to achieve a system suitable to Queensbury' s needs. Although:;,. the Warren County Sewer Agency' s proposal may be of some benefit to the county as a whole, it is the residents of Queensbury who are my first coneern. These people will bear most of the tax burden and they are getting the "short end of �? the stick". Queensbury residents will pay the greatest share for the proposed treatment plant, the size of which is dictated by the seasonal transient population, We will pay most of the cost of the pumps and interceptor sewer which will lie mostly out-of- town to the north. Operations costs will be unussally high for a sweeping county- system mainly because of all the pumping required to transport wastewater from 25 miles north to the Hudson River treatment plant. As energy costs increase, imagine the increase in operating costs to the Queensbury homeowner who will be paying more than his share for the next thirty years! The first year of operation and- maintenance is currently estimated to cost $1,695,000. In examining the county proposal, you must keep in .mind that these -are county costs. The costs of the local collectors gre not included but will be at least once again the county cost. Thus the total cost in Queensbury will be at least twice the proposed county charge, and probably more. IncLuged in the Warren County District are many areas in Queensbury that. -do not need a sewer system and realistically will never get one. These are areas of high valuation and residents are being "used" to defray costs of other towns in the county who do, in fact,. need a sewer system. `—' In the present proposal Queensbury is also picking up part of the indebtedness of other towns for the sewer systems that are currently in operation, such as in the Town of Bolton. These proposals in the county scheme, along with other questionable items, are unacceptable to me and other residents in the Town of Queensbury. Although 'these questions were raised before the County Board of Supervisors prior to tedays vote approving the District and scheduling a referendum, no adjustments on these vary critical issues were made. In view, then, of the inequitable allocation of costs to the Queensbury residents who will bear the largest share of this tax $burden, I regretfully cannot support the Agency's proposal as it now stands. We may need sewerage but this proposal is not the answer. . Councilman Barber- reviewed the areas of the Town of Queensbury which are in need of sewaaa7lines. . . commented that at the Warren County -- Meeting we could not prevail upon the members to redesign the regional sewse• dtatrict in the Town of QueensburyAccording to the thoughts and. . desires of the citizens who live in areas of the Town. . . noted that it will be hard to sell the idea of a sewer district in the Town of Queensbury, which is needed in very distinct areas but not in the areas as put forth . . . Councilman Olson-Thanked Mrs. Walter for her work and effort in this project. . . agree. with Mrs. Walter and BoU , afraid this project will } be a think of the past. . . I know the fellow Board Members are not trying to turn down a sewer program . . . . it is only to sake it smaller and make it useful where it is needed, and not spread. it. o ut into such a monstrosity. that the cost maybe my children and my children' s children can not afford to pay these prices . Councilman Barber- commented that he did not feel the residents are well enough informed in regard to the proposed sewer project. Supervisor Brandt-reviewed the progress of the Warren County Sewer Agency . . there is a referendum for the people to decide it has a lot of merttt there may be some areas that have complaints, I think that we have to examine that closely. I believe, that in the end it is the voter that will decide the issue the best thing is to try and get as much information as possible to the voters so the. voters can make an intelligent decision at the polls, I intend to do that, this has tremendous importance to the Town of Queensbury for its commerce and industry. We had better not take it lightly, we had better consider it very carefully and look at all the advantages and disadvantages . Commented that the total cost is less than the system that was proposed some years ago. . . OPEN FORUM John Bowman- Can you state with some certainty the figures that. Mrs. Walter and Mr. Barber have presented on the sewer project cost to Queensbury? U Supervisor Brandt- I do not know that they base their figures on. Councilman Walter-the figures are based on the full evalubtenn, Queensbury is paying 55% on the pumping station and the interceptor. . . John Bowman- Is it true that some areas will'�inever see the. sewer? Councilman Walter- The County District enconmpaseep/quite a bit� and the local plan in some areas will not encompass them in. . . Supervisor Brandt- spoke in behalf of the Supervisors of Towns ghat are not in the distttct, they have allocated and spent monies of the county to make a study of this system for the people in the district, out of their tax dollars., I think that they deserve credit. . . J*hri Zboigam -- questioned the Board if it was true that we will have to pay debts that were incurred by other towns? Councilman Olson —outstanding debts service and interest. . . Councilman Walter- on existing sewage treatment facilities. . . reviewed the inequities in the existing sewer plan... . Les Baird- commented that the sewer district was not needed in the west end Out there weee other areas in the town that were in need of a sewer-district. Supervisor Brandt- I know the soil conditions in the western part of the town and have pushed hard not to include that area, I think that there are some things that are being said tonight that are somewhat irresponsible . The Town of Queensbury in their own study district included Westland, to be studied and to design sewers in that district that is our input of this board and I think this board ought to look into the mirrow when it starts critteing the county, for including that part in the county district, because we included it in the Town District. F1 Councilman Barber .- noted that this was brought to the attention of the Town Board add we could not sell it to the residents of Westland at that point and we should go to the county, .. and try to have them re-evaluate the Westland, West Glens Falls area. Supervisor Brandt- noted that all the facts and figures were not generated until a few weeks ago, the study has been on going the the figures have just come out, this could not be voted on until the public hearing was held, after that meeting I made the motion to table the resolutions so that there could be more inputs more time to consider it, and more dialkalte>ion among the members. Since then there have been discussions, and I can under- stand the frustrations of the people that have spoken. I did sit in on som-. - cf the meetings, I do know there were caucuses of the Queensbury Supervisors specifically about these qubstions . . . I think that it behooves us to include in the Town District as much as we possibly 'tan of the County District, and service it so that people are not paying for something that they are not getting. Les Baird- What is the link between the County Supervisor and you? Supervisor Brandt- They are your representatives, noted that few people coan,c�to the County Meeting even though the propositions are more expensive,.. it would behoove the citizens to scrutinize the county form of government just as hard as it scrutinizes the Town form of government. Les Baird- What if the Town of Queensbury votes the sewer--,dist. down, what happens? Supervisor Brandt- it is a matter of the majority of the district what ever the vote is . . . if 'Queensbury said no it would be defeated. . . If the district passedlbut Queensbury was a slight negative vote it woull be a legal district and you would be taxed for the County system, it would then be our job to present a refeandum to the Town for a Town District to tie into the County System and we are preparing that. . . Harry Engleston- Twicwood-questioned who reviewed this project for the Supervisors and who did he answer to? Questioned 'the two studies: that were made. . . � J Supervisor Brandt- They were a continuation, one was a preliminary study and the second one was a continuation of that study. . . there wan not one person that reviewed the work of the engineering ftrms. . .we all had a chance to review it. . . Harry Engleston- questioned what �*ould happen if there was a power failure? Supervisor Brandt-the major pmptng station are set up with their own power generator. . . Harry Ingle*on- questioned kow the system would work - in areas of ledge rock. . . Supervisor Brandt- explained the gravity process and pumping and holding tanks. . . Reviewed other possible system of sewage Oteposals. . . .in the lake George Area. . Clayton LaPlant- Columbia Avenue- representing 60 residents of Queensbury- request sewage in the Columbia Avenue area. . . Supervisor Brandt—That has been discussed and this will be studied. . .possible tie in with the City System in the Holden Avenue area. . . you are included in the County District. . . Claytnn LaPlant- questioned the possibility of drainage system in the Columbia Avenue area. . . Councilman Olson- commented that there was a survey done on that road last year and he will bring this to the Highway supt. attention. . . Mr. LaPlant- requested that the Board look into the problem of the City Trucks using Holden Avenue . . . . Councilman Barber- refer this to the New Acting Chief. . . Supervisor Brandt- We will ask for the cooperation of the City Mayor on that problem. . . . John Bowman- would like to see the Warren County Board meetings held at night for more participation from the public. . .
