1.6 1.6 RESOLUTTONS\LOCALLAWS\ENACTMENTICHAPTER 61-Outdoor Burnnig—Clarification--8-18-14 RESOLUTION ENACTING LOCAL LAW NO.: _ OF 2014 TO AMEND QUEENSBURY TOWN CODE CHAPTER 61 ENTITLED, "BURNING, OUTDOOR" RESOLUTION NO. 92014 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board wishes to consider adoption of a Local Law to amend Town Code Chapter 61 entitled, 'Burning, Outdoor," Section 61-3 entitled, `Burning of garbage, rubbish and/or brush" to clarify that no person shall burn, cause to be burned or permit to be burned in the Town of Queensbury any garbage, rubbish, brush, construction materials and/or treated lumber by open fire on the ground or in trash burners or barrels or in pits, and WHEREAS, such legislation is authorized in accordance with New York State Municipal Home Rule Law §10 and New York State Town Law Article 16, and WHEREAS, the Town Board duly held a public hearing on Monday, August 181', 2014 and heard all interested persons, and WHEREAS, a copy of the proposed Local Law has been presented at this meeting and is in form approved by Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby enacts Local Law No.: of 2014 to amend Queensbury Town Code Chapter 61, entitled, 'Burning, Outdoor," as presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Queensbury Town Clerk to file the Local Law with the New York State Secretary of State in accordance with the provisions of the Municipal Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing with the Secretary of State.
